HomeMy WebLinkAboutR-76-0353DW/to 3/24/76 RESOLUTION NO,_._ 76353 A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO MR, AND MRS, SAMUEL TARAVELLA, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $1,196.30 IN FULL AND COMPLETE SETTLEMENT OF PROPERTY DAMAGE AND TOWING CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, UPON THE EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL PROPERTY DAMAGE, TOWING CLAIMS AND DEMANDS. WHEREAS, Mr. and Mrs. Samuel Ta rave lla filed a claim against the City of Miami for alleged property damage and towing expenses, resulting from an accident involving a City owned vehicle on March 2, 1976, at about 2:55 P.M., at or near the intersection of South Dixie Highway and southwest 32nd Avenue, Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorneys office, in accordance with Ordinance No. 8417, which creates the City of Miami's Self -Insurance Program, and said Office recommends that this portion of the claim be settled for the sum of $1,196.30; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENT MDEX ITEM N " Section 1. That the Finance irec�or is hereby authorized to pay to Mr. and Mrs. Samuel Taravella, without the admission of liability, the sum of $1,196.30 in full and complete settlement of all property damage and towing claims and demands against the City of Miami, upon the execution of a release, releasing the City of Miami from all property damage claims and towing claims and demands. Lloyds At or trf E AT March 23, 1976 "uj- V 76-605 Samuel and Janis TaraVella Vs. The City of Miami & John J. Hickey D/A : 3/2/76 P/A : South Dixie Highway & S.W. 32 Ave., Miami., Fla. Mr. and Mrs. Samuel Taravella have filed a claim against the City of Miami without the assistance of an attorney. This claim can be settled for property damage, towing, and loss of use, which should settle in total for approximately $1,500.00. The accident involved a City of Miami Police car, being operated with blue lights and siren on, but without being assigned to a code 3 by the dispatcher. The vehicle ran a red light without the proper precautions being taken when its front end made contact with the right front of a vehicle which had a green light. Liability is considered questionable against the City operator. The property damage to the claimant vehicle is $1,182.30, and there is a towing expense of $14.00. Mr. Taravella received a minor injury to his foot; however, there is no medical treatment at this point in time. The property damage and towing claim can be concluded for $1,196.30 which will include a release, presenting any bodily injury claim. JSL:PW:ro
