A RESOLUTION RATIFYING AND CONFIRMING THE ACTION
TAKEN BY THE CITY MANAGER. IN CONVEYING THE DEED
TO DAIDE COUNTY FOR TEN FEET OF RIGHT OF WAY ON
N, W, 5TH STREET ABUTTING THE NORTH BOUNDARY OF
BLOCKS 76N AND 76E,
WHEREAS, to avoid loss of funds and delaying the construction of
the proposed State Office Building in the Downtown Government Center,
Dade County has requested the City convey to them 10 feet of right of way
abutting the north boundary of Blocks 76N and 76 E; and
WHEREAS, this deed is conveyed under the express condition that
the right of way conveyed is to be used for public sidewalk purposes only;
and
WHEREAS, it is to the City's advantage to cooperate and do every-
thing possible to assist in the completion of the State Office Building project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the action taken by the City Manager in conveying
the deed to Dade County for ten feet of right of way on N. W. 5 Street
abutting the north boundary of Blocks 76N and 76E is hereby ratified and
confirmed.

10' Dedication at State Office wilding
Site in Government Center

ENCLOSURES:
On March 10, Mr. William F. 1-iampton, Special Assistant to the County
Manager, informed me of a problem regarding the site of the proposed
State Office Building in the Downtown Government Center. Because of
funding deadlines, Dade County was expected to deed to the State the site
for this project, all of Blocks 76N and 76E, no later than March 19, 1976
and on this basis, the County Attorney drafted an agreement for the deed
with the State. Subsequently, the County surveyor pointed out that "a11 of
Blocks 76N and 76E" includes a 10' wide strip of dedicated City right of
way and at that time, the County became aware that they did not have title
to the. northerly 10' of these two Blocks.
We have been further informed that to now redraw the agreement between
the County and State and present it to the Governor and Cabinet, the con-
struction funds for the project would revert to the State General Revenue
Fund. The State GSA is under direction from the Cabinet to have a signed
contract for the construction of this project by April 1, 1976.
It was under these circumstances the City was requested to deed to Dade
County this 10' of right of way so the County could in turn include it in
their deed to the State. The deed states that this conveyance is made
on the express condition that the 10' of property is to be used for public
sidewalk purposes only. Because of the deadlines involved and the desire
of the City to not delay the project, I have transferred the deed to this
right of vvay to Dade County and request the City Commission ratify this
action by adopting the attached resolution.
