MARTY, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $4,500.00, IN FULL AND COMPLETE SETTLEMENT OF ALL CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, UPON THE EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, Mr. Francisco R. Marty filed "SUPPORTIVE DOCUMENTS FOLLOW" a claim against the City of Miami for alleged personal injury, resulting from an accident involving a City owned vehicle on August 5, 1975, at about 12:42 P.M., at or near the intersection of N.W. 24th Street and N.W. 15th Avenue, Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's office, in accordance with Ordinance No. 8417, which creates the City of Miami Self -Insurance Program, and said Office recommends that this claim be settle "DOCU.MENT IN SEX for the sum of $4,500.00; i, ITEM NO. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Finance Director is hereby authorized . to pay to Mr. Francisco R. Marty, without the admission of liability, the sum of $4,500.00 in full and complete settlement of all claims and demands against the City of Miami, upon the execution of a release, releasing the City of Miami from all claims and demands. SUBJEC1 REFERENCES ENC:LC:7' PRES. March 3, 1FILE: .976 V-75-502 Settlement of claim of Mr. Francisco R. Marty Mr. Francisco R. Marty has filed a claim against the City of Miami through his attorney, Mario A. Lamar. This claim could have a value in excess of $7,000. for alleged personal injury, resulting from an accident involving a City vehicle on August 5, 1 97 5, in the intersection of N.W. 24th Street and N.W. 15th Avenue, Miami, Florida. The accident involved a City crane which was being operated from the rear crane operator's seat. It passed through a stop sign and the front end rude contact with the left rear side of a vehicle on a thru street as it proceeded through the intersection. Liability is fully against the City operator. — The property damage to the claimant vehicle was $438.36 and has been paid. Mr. Marty had been treated by two doctors, as well as being an in -patient at Miami International Hospital. The total medical expense was $1,279.30. There was also a wage loss for a two week period in the amount of $424.16. The total special damages are $1,703.46. Injury consisted of multiple contusions, musculoligamentous sprain, a sprain of the para-spinal muscles of the cervical and lumbar spine. The bodily injury claim can be concluded for the amount of $4,500., which includes the personal injury protection lien of Fidelity & Casualty Company, Mr. Marty's insurance carrier. PW:ro 2(0 6
