A RESOLUTION AUTHORIZING THE CITY MANAGER OF
THE CITY OF MIAMI TO EXECUTE AN AGREEMENT
WITH METROPOLITAN-DADE COUNTY, THROUGH THE
MANPOWER PLANNING* COUNCIL OF DADE AND MONROE
COUNTIES, PURSUANT TO CITY OF MIAMI RESOLUTION
75-1069, TO IMPLEMENT A MIAMI CAREER DEVELOPMENT
PROGRAM, AND FURTHER TO ENTER INTO CONTRACTS.
IMPLEMENTING SAID PROGRAM SUBJECT TO RATIFICATION
BY THE CITY COMMISSION, AND FURTHER APPROVING
AND RATIFYING ALL MEASURES TAKEN 13Y THE CITY
MANAGER PRIOR TO THE DATE HEREOF TO IMPLEMENT
SAID PROGRAM, INCLUDING THE CARRYING OF PROGRAM
PARTICIPANTS ON THE CITY PAYROLL.
WHEREAS, the City of Miami is an integral part of the Manpower
Consortium Agreement for Dade and Monroe Counties; and
WHEREAS, the City of Miami is eligible, under the agreerrient,
to receive funds to operate programs funded by the Department of Labor;
and
WHEREAS, low income minorities or female residents of the City

of Miami will need this type of program to further their education and enhance
their employability potential;
NOW, THER EFOR E, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The authority of the City Manager to execute an
Agreement, copy of which is attaches, with Metropolitan -Dade County,
through the MANPOWER PLANNING COUNCIL OF DADE AND MONROE
COUNTIES pursuant to City of Miami Resolution No. 75-1069, for the
purpose of receiving funds to operate a Miami Career Development
Program curing the fiscal year 1976 is hereby ratified.

Section 2. The City Manager is further authorized to expend
funds and enter into contracts implementing the aforesaid program,
subject to ratification of said contracts by the City Commission,

ratified,

ENCLOSURES.
Resolution No. 75-1069, passed and adopted November 24, 1975, authorized the
execution of a Career Development Program (Title I) contract for $54,211. At
that time, and in accord with the wishes of Dade County, $87,483.00 was to be
provided for the Career Development Program from Title VI. In December, how-
ever, Dade County determined that all Career Development funds must be allocated
and expended from Title I. Consequently, the amount allocated, under Title I,
to the City of Miami has been increased by $87,483.00 to $141,694, thereby
making it necessary to execute a new contract for that amount. There are no
other changes in the contract.
The Career Development Program is composed of two simultaneous phases: academic
studies and on-the-job training. Program funds will provide part-time tuition
and books at Florida International University so that the participants may
complete their baccalaureate degree. The program will also provide part-time
employment at $4.00 per hour in various City departments to supply valuable work
experience in the student's major. Approximately thirty individuals will be
served. Since the Program initially began October 1975, actual program implementa-
tion is geared toward serving the total of thirty persons.
The increase in the allocation will be utilized to pay the salary portion of the
Career Development Interns and the program will be completely self -funded.

WITH SSE1H THAT:'
WHEREAS, it is the purpose of the Comprehensive Employment
and Training Act of 1973, as amended, to provide, through grants
to local prime sponsors, additional public service jobs and
training, designed to have an immediate impact in areas of high
unemployment, AND
WHEREAS, the Counties of Dade and Monroe, and the Cities of
Miami, Hialeah and Miami Beach, hereinafter referred to as the
Consortium, have entered into an intergovernmental agreement,
effective February 22, 1974, pursuant to the Florida Interlocal
Cooperation Act of 1969, Section 163.01 Florida Statutes (1971),
to provide for coordination in the use of manpower resources
through the OMPC, AND
WHEREAS, the OMPC, by and through the County Manager on be-
half of Metropolitan Dade County, after the effective date of said
agreement and the individual review and approval of duly authorized
representatives of each and all parties thereto, has been desig-
• nated as the authorized and delegated agent, authorized to act
for and on behalf of, said parties in any and all matters, AND

6. B. Purpose of Contract
7. The purpose of the Contract is to state the covenants
8. and conditions under which the Contractor will implement
9. the Career Development Program
10. Program, pursuant to Title I of the Comprehensive
' 11. Employment and Training Act of 1973, as amended.
12. C. Obligations of the Contractor
13. The Contractor agrees to implement and operate a program,
14. described in detail in the proposal appearing in Article II
15. hereafter, in accordance with the following: The provisions
16. of the Comprehensive Employment and Training Act of 1973, any
17. Federal, State and/or County laws, ordinances, regulations and/
18,, or guidelines, and with the provisions of Grant No. 12 6 0110
19. 10 , with any OMPC directives or instructions, and any addi-
20. tions, deletions or amendments to any of the above which are
21.' in effect at the inception of the Contract, or which may be
22. promulgated during its life. The Contractor shall not per--
23. fore in any way inconsistent with the terms of this Contract
24. except as approved, in writing, by the OMPC. Adjustments in
25. the services to be provided under Article II below, may not
26. be made without written approval of the OMPC.

C. B- The purpose of the program is to develop City of Miami
management potential 'among eligible residents, particu-
larly women and ethnic minorities.
This two years program is intended to qualify 30 City residents
to become professionals in various careers needed to conduct
future City of Miami planning, management and other professiona
functions. The program will consist of 2 simultaneous com-
ponents a). On the job training internships in various City
departments 20 hours per week and b) . .academic training (2-3
courses per quarter) at a public university, majoring in care-
ers compatible with City departmental needs. Elective subjects
will be taken in fields specifically designated to develop the
participants managerial and technical acills in order to enhance
their employment opportunities with the City of Miami at the
end of the program.
II. GENERAL PROGRAM PLAY

11. This Contract shall become effective upon execution by the
12. County Manager, on behalf of Metropolitan Dade County, as of the

14. Contractor are to commence as soon as practicable after the effec-
15. tive date and shall be completed, in light of the purposes of this
16. Contract, no later than the 30th day of June

18. ARTICLE IV - COMPENSATION AND METHOD OF PAYMENT
lg. A. Reimbursement - Method of Payment
20. The OMPC agrees, to reimburse, or directly pay, all costs,
21. reflected in the approved budget appearing as part of Article
22. II above, and allowable under Federal, State and County guide-
23. lines. Requests for payment shall be made by way of the
24. Metropolitan Dade County Reconciliation and Reimbursement
25. Forn 401, or Direct Payment Form 501, and proper documentation,
26. in support of such request, shall be attached thereto and sub-
27. mitred to Ot•1PC for approval. Payment shall be made by the
28. Dad: County Finance Director, upon proper presentation of re-
29. quests and documentation, when approved by the OMPC Director,

6. D. Reimbursement Timely Submission

11. during the life of this Contract, shall not be honored if
12. received by OMPC ninety (90) days following the expiration

14. C. Maximum Compensation
15. The Contractor agrees to accept as full payment for
16. services rendered, in a manner satisfactory to the OMPC,
17. the lesser of the following: (1) the amount of $ 141,694.00
18. OR (2) the amount of cash expenditures made by the Contractor
19. for purposes of carrying out the services hereunder. It is
20. expressly understood and agreed that in no event shall the
21. total compensation to be reimbursed hereunder exceed the

24. Funds may not be shifted by the Contractor within and

3. To be eligible for reimbursement for personnel costs,

21. by OMPC or COL, or both. The continuation of the Contract
22. shall be contingent upon satisfactory evaluative conclusions.
23. Monitoring and evaluation shall include, but not be restrict-
24. ed to, an assessment of adherence to the terms of this Con-
25. tract, qualitative analysis of program services, interviews
26. with clients, former clients, public and private employers
27. who deal with the Contractor, and comparisons of planned
28. versus actual progress.

The Contractor agrees to cooperate with existing manpower

5. ARTICLE VII - PURCHASIidG
6. Funds allocated under ,this Contract for public service
7. employment shall not be used for the acquisition, rental or
8. leasing of administrative supplies, equipment or materials, pro-
9. vided, however, that training materials, work tools or other
10. equipment, which are, 1) ordinarily provided by the Contractor
11. to its regular employees, 2) to be for the benefit and owner-
12. ship of the participants, and 3) reflected in the budget appli--
13. cation listed in Article II above and attached hereto as
14. Exhibit C, may be purchased with funds hereby obligated. All
15. purchases of materials, supplies and/or services, made by the
16. Contractor pursuant to this Contract, shall be made by purchase
17. order or by written contract.
18. ARTICLE VIII - BONDING AND INSURANCE
19. The Contractor shall maintain during the term of this Con-
20. tract, the insurance and bonds specified below:
21. a) Workman's Compensation insurance as required by
22. Chapter 440, Florida Statutes.
23. b) Public Liability Insurance, on Comprehensive basis,
24. including Contingent Liability, in amounts not less
25. than $100,000 per person, and $300,000 per occurrence
26. for bodily injury, and $25,000 per occurrence for
27. property damage.

21. in the performance of this Contract.
22. All insurance and bonding required above shall be issued
23. by companies authorized to do business under the laws
24. of the State of Florida, which meet the following quali-

28. (2) no less than "AAA" as to financial strength
29, according to the latest edition of Best's Insurance

7. The Contractor understands' and agrees that it is an indepen--

10, legal or equitable, for or on account of any and all claims, de-
ll. mands or suits, in contract or in tort, actual or threatened, and

15. ARTICLE X - MAINTENANCE OF EFFORT
16. It is understood and agreed that the level of services, acti-
17. vities and expenditures by the Contractor, in existence prior to
18. the initiation of services hereunder, shall be continued and not
19. be reduced in any way as.a result of this Contract except for re-
20. ductions unrelated to the provisions or purposes herein stated.
21. It is further understood and agreed that the program funded
22. through this Contract will not result in the displacement of
23. employed workers, impair existing contracts for services or re-
24. suit in the substitution of funds allocated under this Contract
25. for other funds in connection with work which would have been

2, The Contractor Covenants that no person, under its employ,
3. who presently exercises any functions or responsibilities in
4. connection with the OMPC or the CETA funded projects or programs,
5. has any personal financial interest, direct or indirect, in this
6. Contract. The Contractor further covenants that, in the perfor-
7. mance of this Contract, no person having such conflicting inter-
8. est shall be employed. Any such interest, on the part of the
9. Contractor or its employees, must be disclosed, in writing, to
10. the OIIPC. Provided, however, that this paragraph shall be
11. interpreted in such a manner as not to unreasonably impede com-
12. pliance with the statutory requirement that maximurn Opportunity
13. be provided for employment and participation by residents of
14. the area.
15. The Contractor, in the performance of this Contract, shall
16. be subject to the more restrictive laws and/or guidelines re-
17. garding conflict of interest promulgated by Federal, State or
18. local governments; in particular, Dade County Ordinance 72-82,
19. as amended. Continuation of this Contract shall be contingent
20. upon timely disclosure of any conflict of interest to the OMPC
21. as above described.
22. ARTICLE XII - PROJECT PUBLICITY
23. The Contractor will take affirmative action to inform resi-
24. dents of the geographical area to be served hereunder, of the
25. services to be offered by:
26. a) Utilizing any available means for advertisement,
27. as necessary for recruitment and outreach.
28. b) Transmitting copies of all news releases and
29, advertising, that will be, or have been sent to
30. the news media, to the OMPC,

17. val and execution by the'parties hereto.
18. ARTICLE XV - TERMINATION

Termination for Cause: If, through any cause, the Contractor
shall fail to fulfill, in a timely and proper manner, its
obligations under this Contract, or, if the Contractor shall
violate any of the covenants or stipulations of this Contract,

tract, in whole or in part, at any time, by giving written

5. of individual participants (section 703(13)).
6. 14) Individuals receiving training on the job shall be
7. compensated by the employer of such rates, including
8. periodic increases, as may be deemed reasonable under
9. regulations prescribed by 00t., but in no event at a rate
• 10. less than that specified in Section 6(a)(1) of the Fair
11. Labor Standards Act of 1938 or, if higher, under the
12. applicable State or local minimum wage law (section 111(b)).
13. 15) Persons employed in public service jobs under this Con-
14. tract shall be paid wages which shall not be lower than
15. whichever is the highest of (a) the minimum wage which
16. would be applicable to the employee under the Fair Labor
17. Standards Act of 1938, if Section 6(a)(1) of such title
18. applies to the participant and if he were not exempt
19. under section 13 thereof, (b) the State or local minimum
20. wage for the most nearly comparable covered employment,
21. or (c) the prevailing rates of pay for persons employed
22. in similar public occupations by the same employer
23. (section 208(a)(2)).
24. 16) It will comply with the labor standards requirements set
25. out in section 706 of the Act.

13. shall be construed to preclude persons or programs for
14. whom the foregoing goals are not feasible or appropriate
15. (sections 205(c)(4) and 604).
16. 18) To the extent feasible, public service jobs shall be pro-
17. vided in occupational fields which are most likely to
18. expand within the public or private sector as the unem-
19. ployment rate recedes, except where exempt under Section
20. 604 of the Act. (sections 205(c)(6) and 604).
21. 19) Special consideration in filling transitional public
22. service jobs will be given to unemployed persons who are
23. the most severely disadvantaged in terms of the length
24. of time they have been unemployed without assistance, but
25, such special consideration shall not authorize the hiring
26. of any person that is on lay-off from the same or any sub-
27. stantially equivalent job (section 205(c)(7)).

barriers to public employment and occupational advancement
for those whom it is the purpose of the Act to assist
17. (section 205(c)(18)).
18. 23) Where appropriate, it will maintain or provide linkages
19. with upgrading and other manpower programs for the pur-
20. pose of (1) providing those persons employed in public
21. service jobs who want to pursue work with the employer,
22. in the same or similar work, with opportunities to do so
23. and find permanent, upwardly mobile careers in that
24. field, and (2) providing those persons so employed who
25. do not wish to pursue permanent careers in such field,

24) Not more than one-third of the participants in the
program will be employed in a bona fide professional

17. 26) Only persons residing within the areas of substantial
18. unemployment qualifying for assistance will be hired to
19. fill jobs created under Title II of the Act and the public
20. services provided by such jobs shall, to the extent feasi-
21. ble, be designed to benefit the residents of such areas
22. (section 205(c)(3)).
23. 27) All persons employed under any program, other than necessary
24. technical, supervisory, and administrative personnel, will
25. be selected among unemployed and underemployed persons
26. (section 205(c)(20)).

28) Spcci tonsideration shall be given to eligible dis-
abled veterans, Special veterons, and individuals who
3. served in the Armed Forces and who received other than
4. a dishonorable discharge within four years before the
5, date of their application. Each Contractor selecting
5. participants for programs funded under Title II of the
7. Act, shall take into consideration the extent that such
8. Veterans are available in the area. Specific effort
9. should be made to develop appropriate full or part-time
10. opportunties for such veterans. 'In order to insure
11. special consideration for veterans, all public service
12. employment vacancies under Title II, except those to
13. which former employees are being recalled, must be listed
14. with the State employment service at least 48.hours be-
15. fore such vacancies are filled. During this period, the
16. employment service will refer those veterans specified
17. above. If sufficient numbers of veterans are not avail-
18. able, the employment service, upon request, may also
19. refer members of other significant segments. All other
20. applicants are to be referred after the 48-hour period
21. (section 205(c)(5)).
22. Each Contractor shall, on a continuing and timely basis,
23, provide information on job vacancies and training oppor-
24. tunities funded under Title II of the Act to State and
25. local veterans employment representatives and to other
26. veterans organizations for the purpose of disseminating
27. information to eligible veterans (section 104(b) of
28. Emergency Jobs and Unemployment Assistance Act of 1974).

10. tunities to persons residing in those areas of substan-
11. tial unemployment (section 603(a)(2)).
A11 persons employed under any program, other than
necessary technical, supervisory and administrative per-
sonnel, will be selected from among unemployed and under-
employed persons and that under Title VI preferred con-
sideration shall be given, to the maximum extent feasible,
consistent with provisions of the Act, to unemployed
persons who have exhausted unemployment insurance benefits,
19. to unemployed persons who are not eligible for unemploy-
20. ment insurance benefits (except for persons lacking work
21. experience) and to unemployed persons who have been
22. unemployed for 15 or more weeks.
