A RESOLUTION ACCEPTING THE PLAT ENTITLED COMFORT
MANOR SUBDIVISION, A SUBDIVISION IN THE CITY OF
MIAMI, AND ACCEPTING THE DEDICATIONS SHOWN ON
SAIb PLAT, AND AUTHORIZING AND bIRECTING THE CITY
MANAGER AND CITY CLERIC TO E EC1TE THE PLAT.
WHEREAS, the City Zoning Board and the Department of
Public Works have recommended the acceptance of the Plat entitled
COMFORT MANOR;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA
Section 1. The Plat entitled COMFORT MANOR SUBDIVISION,
being a subdivision of a portion of the NW 14 of the SW 14 of
Section 33, Township 53 South, Range 41 East, Dade County, Florida,
which by reference is made a part hereof as if fully incorporated
herein and the dedications as shown thereon together with all
existing and future planting, trees and shrubbery on said property,
to the perpetual use of the public, be and the same are hereby
accepted and confirmed by the City of Miami, Florida.
Section 2. Except for the construction of those
improvements provided for in the Agreement entered into between
the Owner and the Director of the Department of Public Works on
behalf of the City of Miami, Florida, dated January 21, 1976,
the requirements of Chapter 54, Section 54-20, Code of the City
of Miami, Florida as to improvements tPD�C1�'�EI
will hereby expressly be waived. tf

Section 3. The City Manager and the City
of the City of Miami, Florida, are hereby authorized
to execute the Plat.

The Proposed Record Plat entitled COMFORT i•:EANOR SUBDIVISION is a
subdivision of previously urplatted property lying on the south
side of Comfort Canal between N.W. 35 Avenue and N.W. 37 Avenue.
It is zoned R-1 and has a total arca of 1.76 acres. This.plat
is being forwarded to your office for City Commission action.
The attached detailed report from the Department. of. Public Works
recommends the approval of the plat by the City Commission of Miami,
Florida, and certifies its correctness as to form.

REPORT OF PROPOSED RECORD PLAT OF RUM
COMFORT MANOR SUBDIVISION
A SUBDIVISION IN THE CITY OF I1IAMI, FLORIDA

The accompanying Plat entitled COMFORT MANOR SUBDIVISION
was prepared by E. R. Brownell and Associates, Inc. It is In
correct forth for submission to the City Commission and is for-
warded with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING TEE PLAT:
(1) The property platted is a subdivision or previously
unplatted property lying on the south side of Comfort
Canal between N.W. 35 Avenue and N,W, 37 Avenue. It :is
zoned R-1 and has a total area of 1.76 acres.
(2) The location of the streets and the widths conform with
the standards of the Department of Public Works of the
City of Miami, Florida.
(3) As certified to by E. R. Brownell, Registered Land Surveyor,
this Plat complies with the plat filing lams of the State
of Florida.
(4) By authority of Resolution No. Z8-42-75, adopted April 7,
1975, the Plat was recommended for acceptance by the City
Zoning Board of Miami.
(5) The attached Certificate of Title Examination dated January
13, 1976, s:tgned by I3ernarr C. Cowan Esq., Attorney,
indicates that the fee simple title to the property platted
is correctly vested in B. & D. Enterprises of Miami, Inc.
and the Plat has been correctly executed.
(6) The area platted :is encumbered by mortgage and the mortgage
holder has executed the Plat and joined in its dedications.
(7) In accordance with the requirements of Chapter 54, Section
54-2.0, of The Code of The City of Miami, a Performance Bond
in the amount of 4 34 ,300. 00 has been executed by Goodwin,
Inc., as Principal, and American Fire & Casualty Company,
as Surety. This 1. and and the Surety's Power of Attorney
willaccompany the Agreement between the City of Miami,
and the Principal to guarantee the construction of

(8) Sanitary sewers are now under construction in the vicinity
of the property platted,
(9) The location of the property is shown colored in red on
the accompanying copy of a portion of City of Miami Atlas
Sheet No, 26,
(10) The attached Form of Resolution has been prepared for the
acceptance of the Plat by the City Commission of Miami,
