NORTHWEST FOURTH STREET, BLOCK 76-N, BLOCK 76-E AND RIGHT-OF-WAY OF NORTHWEST FIRST COURT AND NORTHWEST FOURTH STREET ABUTTING THE AFOREMENTIONED PROPERTIES AS PER A. L. KNOWLTON'S MAP OF MIAMI, PLAT BOOK B, PAGE 41, AFTER CONDUCTING A PUBLIC HEARING AS REQUIRED BY CHAPTER 380.06, FLORIDA STATUTES AND THE CITY OF MIAMI ORDINANCE NO. 8290, AND CONSIDERING THE REPORT AND RECOMMENDATION OF THE SOUTH FLORIDA REGIONAL PLANNING COUNCIL AND THE PLANNING ADVISORY BOARD OF THE CITY OF MIAMI SUBJECT TO THE CONDITIONS OF THE DEVELOPMENT ORDER ATTACHED HERETO AS EXHIBIT "A". WHEREAS, the Miami Planning Advisory Board at its meeting of January 21, 1976, Item No. 2, following an advertised hearing, adopted Resolution PAB 4-76 by a 5 to 0 vote (3 members absent) recommending the issuance of a development order with modification; and WHEREAS, the City Commission has considered the report of the South Florida Regional Planning Council and each element required to be considered by Chapter 380.06 of the Florida Statutes; and WHEREAS, the City Commission deems it advisable and in the best interest and the welfare of the City of Miami, as more specifically set forth in the City Commission meeting minutes of February 10, 1975, incorporated herein by reference, to issue a development order for the development of regional impact as hereinafter set forth; NOW, THEREFORE, BE IT THE CITY OF MIAMI, FLORIDA: RESOLVED immtif j s fflio F ITEM NO. Knowlton's Map of Miami, Plat Book B, Page 41, after conducting a public hearing as required by Chapter 380.06, Florida Statutes and City of Miami Ordinance No. 8290, and considering the report and recommendation of the South Florida Regional Planning Council and Planning Advisory Board of the City of Miami, and considering each element required to be considered in accordance with Chapter 380.06 of the Florida Statutes, be and the same is hereby granted and issued. LLOYD TY ATTORNEY AND CORRECTNESS: r `.•. ) i i i ,i 4)7 i ijtl 2, EX#IBIT "A" DEVELOPMENT ORDER Let it be known that pursuant to Section 380.06(7), Florida Statutes, the Commission of the City of Miami, Florida, has heard at a Public Hearing held on February 10, 1976, an application for a development of regional impact consisting of an office structure to be located in the downtown government center in the City of Miami beginning in 1976. The development shall consist of an office structure constructed in four stages comprising a total floor area of approximately 626,675 gross square feet, a total floor area ratio of approximately 3.99, a building coverage of approximately 29.66%, paved areas including walks and drives of approximately 29.34% and landscaped area of approximately 41.0% of the total lot area. Said development shall be in accord with the applica- tion for development approval as submitted to the South Florida Regional Planning Council and the Department of Administration Planning and Zoning Boards. Pursuant to Section 380.06 and after due consideration of the consistency of this development with regulations, and the regional report this body took the following action: approval of this development subject to the following conditions: 1. In the event that the Dade County Transit "SUPPORTIVE Stage I program is not operational by 1985, D O C U i_NTS proof shall be submitted to the City of Miami, t 0Wi? with a copy to the South Florida Regional Planning Council, that a minimum of 28 percent of the Service Center employees and 12.5 percent of its visitors are using transit before development 1 permits are issued for the Phase III building. In the event that the bade County Transit Stages II and III programs are not operational by 1990, the applicant shall submit proof to the City of Miami, with a copy to the Council, that a minimum of 32 percent of the Service Center employees and 16.5 percent of its visitors are using transit before development permits are issued for the Phase IV building. 2. In the event the Stage I transit program does -not become operational by 1985, and the Miami Off -Street Parking Authority cannot meet the Phas&III parking requirements for the proposed Service Center as stated in the ADA, the City of Miami shall delay permission for development of Phase III until such a time as parking for those employees and visitors can be guaranteed. In the event Stages II and III of the transit program do not become operational by 1990, and parking requirements for Phase IV cannot be met, the City of Miami shall delay development permits until parking requirements, as stated in the ADA, can be guaranteed. 3. The contract award should specify that local construction workers be used for each building phase to the maximum extent possible. to i l I r•N !Th, �, • 4. bade County and the State coordinate design plans for the Government Center and Service Center storm water system before plans for the Government Center are finalized. 5. The term "transit" as used herein shall be defined as including bus, rapid, rail or guideway systems, para-transit (including taxicabs, limousines), and group riding transit (GRT) and carpools. 6. Construction Phases II, III, IV, shall require additional approval and recommendation by the Planning Advisory Board and City Commission. 7. The vacation of N.W. 4th Street and N.W. 1st Court is conditioned upon the filing of a plat incorporating said closures prior to the completion of Phase I construction. 8. The South Florida Regional Planning Council shall be furnished with all proposals and updates of the application for the development of regional impact. The closure of these streets is an immediate necessity if the construction of the Regional Service Center is to be commenced and the reversion of project funds avoided.
