A RESOLUTION ACCEPTING THAT CERTAIN AGREEMENT
EXECUTED BY THE SCHOOL BOARD OF .DADE COUNTY,
FLORIDA RELATING TO THE INSTALLATION OF "CHILLER
PIPES" IN THE PUBLIC RIGHT--OF-WAY OF N.W. 43
AVENUE, FOR THE PURPOSE OF CONNECTING THE AIR
CONDITIONING POWER PLANTS OF THE KINLOCH PARK
ELEMENTARY AND JR. HIGH SCHOOLS LOCATED ON
EACH SIDE OF SAID AVENUE; AND AUTHORIZING AND
DIRECTINGTHE PROPER OFFICIAL OF THE CITY OF
MIAMI TO ISSUE A PERMIT THEREFOR, IN CONSIDERA-
TION FOR THE AFORESAID AGREEMENT.
WHEREAS, the School Board of Dade County, Florida
has requested a permit from the City of Miami to install two
5-inch "chiller pipes" side by side across and under the
public right-of-way of N.W. 43 Avenue in order to connect
the air conditioning power plants of the Kinloch Park Elementary
and Jr. High Schools; and
WHEREAS, the Department of Public Works found no reason
why this permit should not be issued, provided that the School
Board execute and deliver to the City of .Miami an agreement
stipulating, among other warranties for the protection of the
City of Miami, the relocation, removal, extension or abandonment
of said "chiller pipes" when and if the Director of the Depart-
ment of Public Works determines that this is necessary or
advisable; and
WHEREAS, in compliance thereto, the School Board has
duly executed and delivered to the City of Miami an agreement
containing all of the aforesaid conditions which has been
approved by the City Attorney; and

NOW, THEREF'OR'S, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The agreement executed by the School
Board of Dade County, Florida relating to the installation
of "chiller pipes" across and under the public right-of-way
of N.W. 43 Avenue for the purpose of connecting the air
conditioning power plants of the Kinloch Park Elementary and
Jr. High Schools, he and the same is hereby accepted and
approved.
Section 2. The proper official of the City of
Miami be and he is hereby authorized and directed to issue
the necessary permit to the School Board of Dade County, Florida
required for the aforesaid installation, in consideration of the
aforesaid agreement, on the part of the said Board.

ENCLOSURES:
The School Board of Dad - ounty requires a permit from the City of
Miami to install "chiller pipes" under and across the surface of the
public right-of-way of N.W. 43 Avenue for the purpose of connecting
the air conditioning power plants of the Kinloch Park Elementary and
Jr. High Schools.
The Department of Public Works has investigated this request and found
no basis upon which to refuse the issuance of this permit. However,
the School Board has been requested to enter into an agreement with
the City of Miami whereby the former will at its own cost and expense
relocate, remove, extend or abandon the aforesaid improvement when
and if the Director of the Department of Public Works determines that
this is necessary or advisable.
On November 6, 1975, the School Board duly executed and delivered to
the City of Miami the aforesaid agreement containing in addition to
the aforementioned condition, the usual warranties for the protection
of the City of Miami.
It is now in order for the City Commission to accept this agreement
and to sanction the issuance of the aforesaid permit.
THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS THE ADOPTION OF THE RESOLU-
TION ACCEPTING THE NOVEMBER'6, 1975, AGREEMENT EXECUTED BY THE SCHOOL
BOARD OF DADE COUNTY RELATING TO THE INSTALLATION OF TWO 5-INCH
"CHILLER PIPES" ACROSS AND UNDER THE PUBLIC RIGHT-OF-WAY OF N.W. 43
AVENUE, FOR THE PURPOSE OF CONNECTING THE AIR CONDITIONING POWER PLANTS
OF THE KINLOCH PARK ELEMENTARY AND JR. HIGH SCHOOLS SITUATE ON EACH
SIDE OF SAID AVENUE; AND AUTHORIZING AND DIRECTING THE PROPER OFFICIAL
OF THE CITY OF MIAMI TO ISSUE THE PERMIT THEREFOR.
