OF THE MIAMI CITY EMPLOYEES' RETIREMENT
PLAN (ORDINANCE MO.5624f MAY 2, 1956,
AS AMENDED) AS APPEARING IN CODIr•ICATION
FORM AS A PART OF CHAPTER 2 OF THE CODE of
THE CITY OF.MIAMI, FLORIDA,.1967, AS AMEND-
ED, MOREPARTICULARLY, AMENDING SECTION 2�1O8,
SUBSECTION l BY REMOVING THE CITY MANAGER
AS A MEMBER OF THE RETIREMENT BOARD AND ADD_
ING AN ADDITIONAL MEMBER OF THE CITY ADMINL
ISTRATION, APPOINTED BY THE CITY MANAGER
AS A MEMBER OF THE RETIREMENT BOARD; REPEAL'
ING ALL ORDINANCES, CODE SECTIONS, OR PARTS
THEREOF IN CONFLICT, INSOFAR AS THEY ARE
IN CONFLICT; AND CONTAINING A SEVERABILITY
PROVISION.
WHEREAS, the Miami City Employees' Retirement Plan
(Ordinance No. 5624, May 2, 1956, as amended) was not included
as a portion of the new Code of the City of Miami, Florida,
effective September 1, 1967, as adopted by Ordinance No. 7585
(July 25, 1967); and
WHEREAS, said plan now exists in the codified form
as it appears in Chapter 2 of the Code of the City of Miami,
Florida, 1957, as amended,. in addition to basic ordinance form;
and
WHEREAS, any addition or amendment to said plan: can
thus be made .byreference to the section designations as they
appear in said Chapter 2 of the Code of the City of Miami,
Florida, 1957, as amended;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA;
Section 1, It is hereby amended, by amending Sub-
section 1 of Section 108 of said Chapter 2, to read as follows.

board consisting of nine (9) persons
as follows: fotir (4) persons elected
by the membership of the RetireMent
Plan; eme-44.-e4t -manager; one (1)
director of . finance; twe-44 three :._,(3)..
members of the city administration,
appointed bythe city manager; and one
(1) city commissioner, appointed by
the City Commission. The city com-
missioner so appointed shall serve only
for such time as he remains a city
commissioner.1/
Section 2. All ordinances, code sections or parts
thereof in conflict herewith, insofar as they are in conflict,
are hereby repealed.
Section 3. If any section, sentence, clause, phrase
or word of this ordinance is for any reason held or declared to
be unconstitutional, inoperative or void, such holding or
invalidity shall not affect the remaining portions of this
ordinance; and it shall be construed to have been the intent
of the Commission of the City of Miami to pass this ordinance
without such unconstitutional, invalid, or inoperative part
therein; and the remainder of this ordinance, after the exclu-
sion of such part or parts, shall be deemed and held to be valid
as if such parts had not been included therein.

It is requested that the Law Departn-.rnt prepare an .ip;,ropriate ordinance
that will grant the City Manager the authority to appoint one additional
member to the City's Retirement Plan 13oard. This position that the City
Manager would appoint would replace the position now held by the City
Manager.
In effect, the City Manager would be naming the individual to fill his
vacated po3ition and would continue to fill this position by appointment.
