HomeMy WebLinkAboutM-77-0929RFC/rb 12/15/77 ORDINANCE NO, AN ORDINANCE AMENDING SECTION 39-25 OF ARTICLE II, "MIAMI ORANGE BOWL MEMORIAL STADIUM", CHAPTER 39, "PARKS AND RECREATION", OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY REPEALING SAID SECTION, WHICH HAD PROHIBITED SALE, USE, OR POSSESSION OF ALCOHOLIC OR INTOXICATING BEVERAGES IN THE MIAMI ORANGE BOWL MEMORIAL STADIUM, WITIH CERTAIN EXCEPTIONS, AND SUBSTITUTING A NEW SECTION 39-25 ALLOWING AND AUTHORIZING THE SALE OF BEER AND/OR MALT BEVERAGES IN SAID STADIUM AND ALSO PROVIDING FOR TIIE CITY MANAGER TO AUTHORIZE SUCH SALE UPON SUCH TERMS AND CONDITIONS AS SHALL IMPLEMENT CITY COmNISSION POLICY, WITH THE EXCEPTION THAT SUCH SALE NOT TAKE PLACE BEFORE, DURING OR AFTER ANY HIGH SCHOOL EVENT OR MUSICAL E' ENT COMMONLY REFERRED TO AS A "ROCK CONCERT"; FURTHER PROVIDING THAT SAID SUBSTITUTED SECTION SHALL RESULT IN NO CHANGE IN EXISTING AGREEMENTS BETWEEN THE CITY AND STADIUM CONCESSIONNAIRES; ALSO AUTHORIZING THE SERVING OR DISPENSING OF INTOXICATING BEVERAGES IN AREAS OF THE STADIUM SPECIFICALLY DESIGNATED BY THE CITY MANAGER UNDER SUCH TERMS AND CONDI- TIONS AS SHALL IMPLEMENT CITY COMMISSION POLICY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. 7 7 - 9 2 9 BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 39-25 of Article II, "Miami Orange Bowl Memorial Stadium", Chapter 39, "Parks and Recreation", of the Code of the City of Miami, Florida, as amended, is hereby further amended by repealing said section in its entirety and substituting in its place, the following: "Section 39-25. Alcoholic and Intoxicating Beverages. 1. (a) Beer and/or malt beverages may be sold in the stadium by the city provided that such beverages are not dispensed to the consumer in cans or bottles. (b) The city manager may authorize the sale of said beverages in the stadium by licensed vendors. (c) The aforesaid sale shall not be authorized (i) before, during, or after any high school event, including but not limited to football, soccer, or any high school event held at the stadium; (ii) before, during, or after any musical event of the type which historically requires extraordinary security measyr/es, based upon prudentt police.protection„ — 1/ ommonly referrec. to as "Rock Concerts". (d) The aforesaid sale by the city or by authorized vendors is subject to and conditioned upon such terms and conditions as are specified by the city manager. Such spcification shall imple- ment policy imposed by the city commission concerning such sale or authorization thereo`. Intoxicating beverages may be served or dispensed in those areas of the stadium specifically designated by the city manager, subject to and conditioned upon such terms and conditions as are specified by the city manager. Except as provided herein, it shall be unlawful for any person to bring alcoholic or intoxicating beverages into the stadium or to possess or to drink alcoholic or intoxicating beverages, as defined in Section 561.01, Florida Statutes. -2- There shall be no change in existing agreements between the city and the stadium concessionaires as a result of the passage of this ordinance." Section 2. All ordinances or parts of ordinances insofar as they are in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase., or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected.
