A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE IN LIEU OF CONDEMNATION, A DUPLEX AND LOT COMPRISED OF 20,192 SQ. FT., M/L, LOCATED A'1' 25-27 N. E- 58th STREET, MIAMI FLORIDA, FOR THE SUM OF SIXTY-EIGHT• TIIOUSAND FIVE HUNDRED FORTY DOLLARS AND NO CENTS ($6S,540,00). AND ALLOCATING SEVENTY THOUSAND ( $70, 000 -00) DOLLARS FROM COMMUNITY DEVELOPMENT FUNDS TO COVER THE COST OF ACQUISITION OF FEE SIMPLE TITLE TO THIS PROPERTY AND OTHER COSTS INCIDENTAL TO THE ACQUISITION. WHEREAS, the property located at 25-27 N, E. 58th Street, Miami, Florida, proposed to be acquired for the development of a neighborhood park for the use of citizens i.nAison-Lemon City area; and WHEREAS, the Office of Community Development has approved the acquisition of this property to provide a neighborhood park in the Edison - Lemon City area, and concurs with the recommendation to acquire this parcel; and WHEREAS, the necessary monies for said acquisition are available in the second year funding of Community Development Projects; and WHEREAS, this acquisition is being accomplished in accordance with the Land Acquisition Policies under Community Development Programs, which include cost of relocation assistance, if required, as detailed in HUD Handbook 1320.1, Real Property Acquisitions; and WHEREAS, the owner of the property has, by Agreement dated the 16th day of November, 1977, offered to convey fee simple title to this property to the City of Miami, Florida, for the negotiated price of Sixty -Eight Thousand Five Hundred Forty ($68,540.00) Dollars; and Florida, condemnation; WHEREAS, it is deemed in the best interests of the City of Miami, to acquire the property at this time through purchase in lieu u "DOCUMENT INDEX ITEM NO. E. 58th Street, Miami, Florida, legally described as: Lots 11, 12, and 13 Block 1 Biscayne Avenue Tract PB 3-195 for the development of a neighborhood park, for the sum of Sixty -Eight Thousand Five Hundred Forty ($68,540.00) Dollars. Section 2. Gunderson November 28, 1977 Acquisition of Land - Edison -Lemon City Area Copy of Resolution; Offer to Purchase By memorandum dated January 9, 1976, authorization was given to acquire three (3) parcels of property for a neighborhood park in the Edison -Lemon City Area. This is the third and final parcel to be acquired. Funds for this acquisition are provided from the Second Year Community Develop- ment allocations. Solicitations for appraisal services were sent to nineteen (19) firms, with six (6) responses. The Appraisers who submitted the lowest fees were selected. The pertinent facts regarding this acquisition are as follows: Appraisers Atlantic Appraisal Associates, Inc. Ft., M/L Improvements Side by Side Duplex 2 Bedroom, 2 Baths - on each side Comprised of 2616 Sq. Ft. Total, including Porch and Garage Zoned R-2 Cost to Acquire $68,540.00 By agreement dated November 16, 1977, the owner agreed to convey Fee Simple Title to the City for the negotiated price of $68,540.00. It is recommended that this parcel be acquired for the negotiated price, as it would be more costly and time consuming to acquire by condemnation. Community Development, Parks Department and Planning Department concur with this recommenda- tion. This acquisition was transacted in accordance to the Land Acquisiti,'n Policies • under the Community Development Programs which include Relocation A•sistance, if required, as determined in HUD handbook, 1320.1 Property Acquisitions.
