Availability of `Funds= in the
City of Miami.,EEC Case
` ,a `
It is my understanding that the City will be able to deposit
15.million dollars into the registry of the court within 20
days after an order of taking in the above styled case, notwith-
standing the fact that 11 million dollars in bonds have not been
sold and may not be sold prior to the entry of the order of
taking.
You should note that the 3.3 million dollars on deposit in the
Florida National Bank have not yet been returned to the City.
Although we will attempt to have it returned, we expect some
resistance from the defendants in the former FEC case since this
sum would guaranty their damages. It is possible that this sum
will not be available at the time of the order of taking.
If for any reason you believe that we will not be able to deposit
sufficient funds in the registry of the court at the time of the
order of taking, which we expect to be in the month of November,
1977, please advise me immediately.

We are sending you this memo so that you can adequately respond to
our previous memo in which we requested that you advise us as to
the availability of funds for the forthcoming quick take proceedings.
We do not expect any of these funds to be available prior to the
