Gunderson, Director F� e Department eor DATE. $USJECT: REFERENCES: ENCLOSURES. • L September 1 197014-g. _ ' Availability of `Funds= in the City of Miami.,EEC Case ` ,a ` It is my understanding that the City will be able to deposit 15.million dollars into the registry of the court within 20 days after an order of taking in the above styled case, notwith- standing the fact that 11 million dollars in bonds have not been sold and may not be sold prior to the entry of the order of taking. You should note that the 3.3 million dollars on deposit in the Florida National Bank have not yet been returned to the City. Although we will attempt to have it returned, we expect some resistance from the defendants in the former FEC case since this sum would guaranty their damages. It is possible that this sum will not be available at the time of the order of taking. If for any reason you believe that we will not be able to deposit sufficient funds in the registry of the court at the time of the order of taking, which we expect to be in the month of November, 1977, please advise me immediately. The City recently filed a motion for the return of said funds since we believed they might be necessary in the new quick take action. We did not set this motion downfforhhearing sid nce iweywere attempting to determine a response from We have now received a response from Holiday Inns in opposition to our motion stating that their claim could well exceed the amount placed in the bank account. The attorneys for the FEC have advised that they are also filing a motion in opposition to the return of said funds.
