S727 AN ORDINANCE ENDING ORDINANCE NO 6871, THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MI.AMI, BY CHANGING THE ZONING CLASSIFICATION OF LOTS 9 AND 10, 'BLOCK 3, WHITEHEAD AND BLAIR SUB (44-78), LOCATED AT 4101 N.W, 7THH STREET, FROM C-+ (GENERAL COMMERCIAL) TO GU (GOVERNMENTAL USE); AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP, MADE A PART OF THE SAID ORDINANCE NO, 6871, BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL ORDI- NANCES, CODE SECTIONS, OR PARTS THEREOF IN CON- FLICT; AND CONTAINING A SEVERABILITY PROVISION. WHEREAS, the Miami Planning Advisory Board at its meeting of September 7, 1977, Item No, 2(a), following an advertised hearing, adopted Resolution No. PAB 40-77 by a 7 to 0 vote recommending a change of zoning classification as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration and due deliberation of this matter, deems it advisable and in the best interest of the City of Miami and its inhabitants to grant a change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami be, and the same is hereby amended by changing the zoning classification of Lots 9 and 10, Block 3, WHITEHEAD AND BLAIR SUB (44-78), located at 4101 N.W. 7th Street, from C-4 (General Commercial) to GU (Governmental Use); and by making the necessary changes in the zoning district map, made a part of the said Ordinance No. 6871, by reference and description in Article III, Section 2 thereof. Section 2. That all laws or parts of laws in conflict herewith be, and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid. the same shall not affect the validity of the ordinance as a whole. Block 10 WEITEHEAD AND BLAL SUB ;44-73) a) Change of Zoning Classification of above site from C-4 (General Commercial) to GC (Governmental Use) and b) Request for permission to construct and operate an addition to the present Fire Station �10 on the above site per ARTICLE XXI - 2, GC (Governmental. Use) Section 3 (1); Zoned C-4 General Commercial) pro- posed to be rezoned GU 'Governmental Use) Fire Station =10 is a 4700 square foot building on a 13, 450 square foot site on the north side of NW 7th Street, west of 41 st Avenue. The station complement is an engine company of 5 men. No on -site parking is presently provided. An improvement program is to be undertaken with 3100, 000 from the 1976 Fire Bond Issue and additional monies result- ing from property sales. This improvement ,.vculd add a ladder company of 5 men con- sistent with the recommendations of the Miami Fire Protection, Rescue and Eraser _enc :r Services `,caster Plan 1977-1987. The eastern half of the existing building, would be demolished and a two-story addition constructed so that the total floor area of the building :would be 6500 square feet. It should be noted that the C-4 district requires a 5' side street setback. It is also anticipated :hat at a later date the entire alley to the north would be acquired by the City, proposed for re- zoning to GU, and utilized for on -site parking spaces, there- by increasing the site to 1S, 150 square feet. A total of 17 parking spaces :would be provided. R ECON1MENDA TIONS PLANNING DEPARTMENT APPROVAL, of the al zoning change and b) construction and operation of the fire station and addition per site plan submitted and on file. Approval of this zovernmentat use in this District is based on the following factors: a) Fire Station -10, and the addition are compatible with the adjacent commercial•uses, zoned C-4 on NW 7th Street and provide a buffer between the traffic on NW 7th Street and residential areas to the north, zoned R-1. b) Fire Stations as public facilities can be established in any zoning district (Article IV Section 35), and are considered compatible with the Miarni Comprehensive Neighborhood Plan. c) The site is located directly facing an arterial Street (NW 7th Street) which provides excellent direct access, while the parking area is accessible from NW al st A •ienue. d) Fire Station =10 is a long-standing use on this site and the expansion is not expected to have an adverse impact on adjacent properties in terms of drainage, light, air or property values. e) The scale of the fire station is generally consistent with commercial development to the :vest; the two story portion will serve to strengthen the importance of this major inter- section (Lejeune Road and NW 7th Street). The expansion includes appropriate landscaping. The side street setback is generally 1', but widens to 5' at the corners of the building and is considered appropriate. g) The expansion of Fire Station 410 is essential for fire protection for this portion of the City as described in the Miami Fire Protection, Rescue and Emerzency Services Master Plan. 1977-1987 PLANNING ADVISORY BOARD CITY COMMISSION PD 9/2/77 10/5/77 10/25/77 (A) Approved (Resolution 40-77) on September 7, 1977 by a 7-0 vote (B) Approved (Resolution 4.1 -77) on September 7, 1977 by a 5-2 vote.
