PR0VID/NG THAT THIS ORDINANCE SHALL RE SUPPLEMENTAL AND IN ADDITION TO THE ORDINANCtJ MAKING APPROPRIATIONS FOR THE FISCAL YEAR ENDING SEPT'EMBER 30, 1978 P'oR THE OPERATION OP THE CITY OP MIAMI, P'LORIDA t PROVIDING THAT IP ANY SECTION, CLAUSt, oR SUBsECTIoN SHALL 8t DECLARtD UNCoN- STITUTIONAL, IT SHALL NOT AP'1 CT THE REMAINING PROVI- SIDNS OP THIS oRDIUANCtE WHEREAS, the Board of the Downtown Development Authority of the City of Miami has approved and submitted to the City Commission a Budget Estimate of the expenditures and revenues of the Authority for the fiscal year 1977-78 as prepared by the Director of the Downtown Development Authority, copies of such estimates having been made available to the newspapers of the City; and WHEREAS, the City Commission has reviewed the Downtown Development Authority's Budget Estimate and has approved appro- priations as herein set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1, The following appropriations for the fiscal year 1977-78 be, and the same are hereby, made for the maintenance and for the purpose of financing the operation and other legal and proper purposes of the Downtowl Development CITY COMMON MIMS C M t, 3 l3 rr Authority of the C t f "Miami , Florida, to wit Appropriation Personal Services $129,200,06 Contractual Services 175019.90 Commodities 6,000.00 fixed & Sundry Charges 24.300.00 Capital Outlay 6350000 Total Required Punds 141 j 49.90 SOURCES OP Rt✓VENUt✓ Add Valorem 'Pax Levy within the Downtown Development District 1976-77 Punds carried over 'Dotal Revenue Par 1977-78 Budget $280,690,00 60.629.90 V11,319490 Section 2. These appropriations are the anticipated expenditure requirements for the Downtown Development Authority but are not mandatory should efficient administration of the authority or altered economic conditions indicate that a curtail- ment in certain expenditures is necessary. The Director of the Downtown Development Authority, with the approval of the Board of the Downtown Development Authority, is specifically authorized to withhold any of these appropriated funds from encumbrance or expenditure should such action appear advantageous to the economi- cal and efficient operation of the Authority. Section 3. The Director of the Downtown Development Authority, with the approval of the Board of the Downtown Develop- ment Authority, is authorized to make transfers between the detailed accounts comprising any of the amounts appropriated by Section 1 hereof, in order that available and unrequired balance in any such account may be used for other necessary and proper purposes and to transfer between any of the amounts appropriated by Sect :on 1. 8715 Except as herein provided, transfere between items appropriated hereby sham be author eed by ordinances amendatory hereto. Sectio i 4. The Director of the Downtown Development Authority is hereby authorized to invite or advertise for bids for the purchase of any material, equipment or service embraced in the aforementioned appropriations, for which formal bidding is required; such bids to be returnable as required by law. Section 5. This ordinance shall be deemed supple- mental and in addition to the ordinance making appropriations for the fiscal year ending September 30, 1978, for the operation of the City of Miami. Section 6. If any section, part of section, paragraph, clause, phrase, or word of this ordinance shall be held to be unconstitutional or void, the remaining provisions of this ordi- nance shall, nevertheless, remain in full force and effect. Section 7. The foregoing ordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 8. The requirement of reading this ordinance on two separate days is hereby dispensed with by a four -fifths vote of the members of the Commission. WHEREAS, the Downtown Development Authority of the City of Miami has prepared a budget for the Fiscal Year 1977/78, and WHEREAS, the Board of the Authority has reviewed the Budget, in a Special Meeting of the Authority on September 16 ,1977, said Budget being based on the Estimated Tax Roll provided by Metropolitan Dade County, and WHEREAS, Ordinance 7370, as amended, of the City of Miami required that the City Commission make appropriations for ;the operations of the Authority by Ordinance, and WHEREAS, the Board of the Authority find, that the proposed Budget is necessary in order to further the objectives of the Authority as authorized by City Ordinance. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA, THAT: Section 1. The budget of the Downtown Development Authority, as submitted by the Director is made a part of this Resolution and is hereby approved and shall be known as the "Annual Budget of the Downtown Development Authority; Fiscal Year October 1, 1977 through September 30, 1978". Section 2. The City Commission of the City of Miami is requested to approve and adopt the Budget and establish the millage, authorized by law to fully support the financial requirements of this Budget. Section 3. The Executive Director and the Treasurer of the Authority are authorized to expend funds, including new salary rates, as provided in said Budget, after approval and adoption and establishment of the millage by the City Commission of the City of Miami, upon the first day of the 1977/78 Fiscal year, October 1, 1977. Section 4. The Director of the Downtown Development Authority is directed to prepare and file with the City Clerk of the City of Miami, a detailed statement of the proposed expenditures and estimated revenues for the Fiscal Year 1977/78, which shall be entitled "Annual Budget of the Downtown Development Authority; Fiscal Year October 1, 1977 through September 30, 1978". Section 5. A copy of this Resolution and the attachment shall be filed with the City Clerk of the City of Miami, after approval and adoption and establishment of the millage by the City Commission of the City of Miami.
