HomeMy WebLinkAboutR-77-0796RESOLUTION NO. 7 7 7 9 6 i RESO%UTION APPROVING, CONFIRMING, AND RATIFYING THE ACTION OF THE CITY MANAGER'S ACCEPTANCE OF A $1,400 GRANT AWARD FROM THE FINE ARTS COUNCIL OF FLORIDA FOR A COMMUNITY OUTREACH, LIVELY ARTS PROJECT AND AUTHORI- ZING THE CITY MANAGER TO EXECUTE ANY OTHER CONTRACT(S) AND/OR AGREEMENT(S) TO IMPLEMENT THE PROGRAM AND FURTHER AUTHORIZING THE ALLOCATION OF $1,400 FROM SPECIAL PROGRAMS AND ACCOUNTS AND COMMUNITY PROGRAMS, RESERVE FOR FIXED AND SUNDRY, MATCHING FUNDS FOR FEDERAL GRANTS, TO BE USED AS MATCHING FUNDS FOR THE COMMUNITY OUTREACH, LIVELY ARTS PROJECT GRANT. WHEREAS, the Fine Arts Council of Florida has awarded the City of Miathi a stun of $1,400 to provide cultural programs; and WHEREAS, the City Manager has executed an agreement with the Fine Arts, Council of Florida accepting the $1,400 grant award; and WHEREAS, this project will expand the delivery of cultural programs to residents of the City of Miami; and WHEREAS, the Fine Arts Council of Florida requires the expenditure of $1,400 in matching funds to earn the grant award; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager's action in accepting the $1,400 grant award from the Fine Arts Council of Florida for a Community Outreach, Lively Arts Project is hereby approved, confirmed, and ratified. The Miami Center/Lowe Art Museum, a section of the Office of Community Affairs, will assume responsibility for the expenditure of funds. The attached resolution would confirm your action in signing the Agreement and allocate 51,400 from Special Programs and Accounts and Community Pro- grams, reserve for Fixed and Sundry charges, Cash Match for Federal Grants to fulfill the grant's matching share requirement. Also attached is the Agreement which you signed accepting the grant and a fact sheet describ- ing the Grant Program in more detail. '' This Agreement, made and entered into this 26th day of July i 191 , by and between: THE FINE ARTS COUNCIL OF FLORIDA an Agency of the State of Florida within the Department of State, Division of Cultural Affairs, hereinafter called "Council" and Citt_of Mi inhi of the City of Mi ami , County of Dade , Florida, hereinafter called "Grantee." WHEREAS, the Council is authorized to contract, within the amounts made available by grant and appropriation therefor, for services and cooperative endeavors in furtherance of arts activities and cultural programming in the State of Florida as outlined in its "Guide to Programs," and WHEREAS, the Grantee is agreeable to the furnishing of such services or to engaging in such cooperative endeavors as hereinafter set out. NOW, THEREFORE, it is agreed between the parties hereto that the Grantee agrees to undertake the sponsorship of a certain project entitled: "Communi ty Out reach and more fully described in the Grantee's application and approved revisions thereto, if any, for a project grant for the period specified in said application or for alternate period, as approved by the Council. Said application is attached hereto and made a part of this AGREEMENT. 1) The Council hereby agrees to participate in the expense of this (these) event(s) to the extent of $ 1,400.00 , to be disbursed in such increments and on such dates as the Council, in its discretion, deems advisable. in no case shall an amount exceeding ninety percent (90°70) of this figure be provided to the Grantee until all terms of this Agreement and applicable attachments are fulfilled. Ten percent (10(ro) of the total grant amount will be withheld until the Grantee has submitted a satisfactory final evaluation as described in paragraph twelve (12) of this Agreement. It is further understood and agreed that the Grantee will inform all contractors and creditors that such contractors and creditors must look only to the Grantee for payment, and that the Grantee will in no way represent to such contractors and creditors that the operation constitutes a joint venture with the Council or the State of Florida. 2) It is agreed and understood that the amount in Clause One (1) is the maximum contribution of the Council, and that this amount shall not be more than fifty percent (500'o) of the non-federal share of the total cost of the project. and that up to twenty-five percent (250'o) of the Grantee's match may be declared in in -kind services. 3) The grantee agrees that funds granted pursuant to this Agreement shall be used exclusively for the purposes and in the manner indicated in its detailed project grant application, a copy of which is contained in the Council's files in Tallahassee. Leon County, Florida. Expenditure of grant funds is SPECIFICALLY PROHIBITED for, but not limited to. the following purposes: a) expenses incurred prior to grant period, b) building, renovating. or remodeling of facilities, c) creation of new oganizations or institutions, d) projects which are restricted to local or exclusive participation or enjoyment, e) capital expenditures, f) had debts, g) private entertainment, h) contingency funds, i) investments of any type. 4) In the event the project incurs total expenses lower than herein anticipated with the effect of making the Council's contribution greater than fifty percent (500'0) of the non-federal share of the total project cost, the Grantee agrees to return to the Council an amount which will render the Council's contribution not in excees of fifty percent (500"o► of the non-federal share of the total cost of the project cost. Any anticipated unexpended funds must be returned to the Council no later than Ju_ne 1, 1978 All grant funds must be expended by the end of the grant period. _June 30y_19. .E 51 It is agreed that the Grantee will include in all promotion. publicity, and adsertising, and in the printed program for the event(s) and/or proiectts), the following credit line: "THIS PROGRAM/PROJECT/EVENT (or other appropriate word) WAS MADE POSSIBLE IN PART THROUGH A GRANT FROM THE FINE ARTS COUNCIL OF FLORIDA. This statement shall apear directly after the name of the Grantee and before the name of the performer, in type and boldness no less than fifty percent (500'0) of that used for the name of the Grantee. 6) FAIR LABOR STANDARDS a) All professional performers and related or supporting professional personnel employed an projects or productions which are financed in whole or in part under this grant will he paid, without subsequent deduction or rebate on any account not less than the minimum compensation as determined by the Secretary of Labor of the United States to be the prevailing minimum compensation for persons employed in similar activities. b) No part of any project or production which is financed in whole or in part under the grant will be per- formed or engaged in under working conditions which are unsanitary or hazardous or dangerous to the health and safety of the employees engaged in such project or production. Compliance with the safety and sanitary laws of the State of Florida shall be prima facie evidence of compliance. Fop '96 7) CIVIL RIGHTS — Title Vi of the Civil Rights Act of 1964 provides that: "No person in the United States shaii. on the grounds of race, color, or national origin. be excluded from participation in, be denied the benefits of, or be subject to discrimination under any program or activity receiving Federal financial assistance." (Section 601) 8) HANDICAPPED — Section 504 of the Rehabilitation Act of 1964 provides that: "No otherwise qualified handicapped individual in the United States, as defined in Section 7(6), shall, solely by reason of his handicap, be excluded from the participation in, be denied the benefits of, or he subjected to discrimination under any program or activity receiving Federal assistance." 9) AUDIT OF RECORDS — The Fine Arts Council of Florida, the National Endowment for the Arts, an agency of the Federal Government, and the Comptroller General of the United States, or any duly authorized representatives, shall have access to any books, documents, papers, and records maintained to account for funds expended under the terms and conditions of this grant for the purpose of making audit, examination, excerpts, and transcripts. 10) STANDARDS FOR GRANTEE FINANCIAL MANAGEMENT SYSTEMS — Grantee financial manage- ment systems shall provide for: a) Accurate, current, and complete disclosure of the financial results of each grant program in accordance with Fine Arts Council evaluation requirements. b) Records which identify adequately the source and application of funds for grant -supported activities. These records shall contain information pertaining to grant awards and authorizations, obligations, unobligated balances, assets, liabilities, outlays, and income. c) Accounting records must be retained for a minimum of three years. 11) The Grantee agrees that it will not assign this contract or any part thereof without the written consent of the Council. 12) The Grantee agrees to provide the Council with such documentation as may be required by the Council and at such time or times that may he required by the Council regarding the Grantee's status as a corporate entity or as a tax- exempt organization as determined or defined by the iRS code. The Grantee further agrees to immediately inform the Council of any changes in its status as a corporation or as a tax-exempt organization under Sections 501(C)(3), 501(C)(4), 509(A) or other relevant and applicable portions of the iRS code. 13) Grantee agrees to submit quarterly and final reports, supportive materials and required documentation as detailed in the Fine Arts Council's "Guide to Programs," applicable portions of which are made a part hereto, to the Council offices located in Tallahassee, Leon County, Florida, no later than the date specified on the report form. 14) The terms of this agreement may be amended with the written consent of both parties. 15) Grantee agrees to offer written invitations to the following persons at least three (3) weeks in advance of the project(s) or event(s) described herein: Chairman, National Endowment for the Arts; local Federal and State legislative delegation; The Secretary of State of the State of Florida. Director, Division of Cultural Affairs, Chairman and Director, Fine Arts Council of Florida.
