I. 3 A RESOLUTION AUTHORIZING THE DIRECTOR OF PtNANCE TO PAY TO CONSUELO HUGGINS AND BRUMER, MOSS, COHEN & RODGERS, HER ATTORNEYS, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $4,050.00 IN FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY AND PROPERTY DAMAGE CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, AND UPON EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS, AND TO PAY TO THE INSURANCE COMPANY OF NORTii AMERICA, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $200.00 IN FULL AND COMPLETE SETTLEMENT OF THEIR PERSONAL INJURY PROTECTION LIEN, CLAIM AND DEMAND AGAINST THE CITY OF MIAMI, AND UPON THE EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, Consuelo Huggins, through her Attorneys, $tamer, Moss, Cohen & Rodgers, filed a claim against the City of Miami for the alleged bodily injury and property damage, and Insurance Company of North America filed a claim against the City of Miami for alleged personal injury protection lien, resulting from an accident involving a City owned vehicle on February 18, 1976, at or near N.W. 12th Avenue and N.W. 5th Street, Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's office, in accordance with Ordinance No. 8417, which creates the City of Miami's Self Insurance Program, and said office recommends that these claims be settled for the sum of $4,050.00 and $200.00 respectively; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENT, INDEX INDEX ITL;,1 Ira. SEP 2 J AA 1t Sept: 23, 1977 V 76-596 Settlement of bodily injury, property damage claim, and personal injury protection lie:, as concerns Consuelo Huggins & the Insurance Company of North America Consuelo Huggins, filed a claim against the City of Miami, through her Attorney, Stewart W. Logan, of the firm of Brumer, Moss, Cohen & Rodgers, involving bodily injury, property damage, and a personal injury protection lien from the Insurance Company of North America, resulting from an accident involving a City of Miami Sanitation truck. This individual was self -insured for the vehicle damage, as no' collision coverage was provided. This accident occurred on February 18, 1976, at 8:25 A.M., on N.W. 12th Avenue, 50 feet north of N.W. 5th Street, Miami, Flotida. Both vehicles were southbound on N.W. 12th Avenue, in the left lane ns the Huggins' vehicle was stopped for a line of traffic. The City unit failed to stop, which resulted in a rear end type collision. Property damage to the claimant vehicle is in the amount of $278.00. Consuelo T. Huggins, a widow, was not gainfully employed and there was no lost time and wage claim alleged. The injury is diagnosed as an acute cervical-dorso lumbar spine sprain with multiple contusions over the body. No permanency is indicated. The special damage material is as follows: DOCTORS S.
