HomeMy WebLinkAboutR-77-0791Wire 942-71 RESOLUTION NO, 7 7 7 9 ' 4 A RESOLUTION AUTHORIZING THE DIRECTOR OF F`t4ANCE TO PAY TO JOSEFINA SANCHEZ AND PEDRO SANCHEZ, INDIVIDUALLY AND AS HUSBAND AND WIFE, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $3,650.00 IN FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY CLAIMS AGAINST THE CITY OF MIAMI, UPON THE EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ANY AND ALL CLAIMS AND DEMANDS. WHEREAS, Josefina Sanchez and Pedro Sanchez filed a claim against the City of Miami for alleged personal injury, resulting from an accident involving a City -owned vehicle on March 11, 1977, at about 9:53 A.M., in front of 4703 S.W. 8th Street, Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of. the City Attorney's office, in accordance with Ordinance No. 8417, which creates the City of Miami's Self Insurance Program, and said office recommends that this claim be settled for the sum of $3,650.00; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENT INDEX if) " _--- Section 1. That the Director ofITFEM financeNO.is hereby authorized to pay to Josefina Sanchez and Pedro Sanchez, without the admission of liability, the sum of $3,650.00 in full and complete settlement of all bodily injury claims and demands against the City of Miami, upon the execution of a release, releasing the City of Miami from all bodily injury claims and demands. Sept. 22, 1977 • V 77-803 Settlement of bodily injury dlaitn, as concerns Josefina Sanchez & Pedro Sanchez vs. The City of Miami Sanitation Dept. & James Wellman Josefina Sanchez and Pedro Sanchez, individually and as husband and wife, have filed a claim against the City of Miami, result- ing from an automobile accident, involving a City of Miami Sanitation Department truck. This accident occurred on March 11, 1977, at 9:53 A.M., in front of 4703 S.N. 8th Street, Miami, Florida. The claimant unit was stoppad in back of the Sanitation unit at a point in time when the Sanitation unit reversed direction, so as to back into an alleyway. The right rear of the Sanitation unit made contact with the left front end of the claimant unit. There was no direction given to tha Sanitation unit operator on the backing procedure. The property damage amount to the claimant vehicle is $572.66. Mr. Sanchez was shaken but did not obtain any services of a physician. He is self employed, operating an automobile repair shop in the Hialeah area, and his wife, Josefina, is normally employed in the operation of the office. Josefina Sanchez received injury to the neck, thoracic spine, and the interscapular region. There was also the indication that menstrual irregularities developed as a result of the emotional trauma of this accident. The treating physician rated the claimant with five percent minimal perman3nt partial disability to the body as a whole.
