HomeMy WebLinkAboutR-77-0790tto RESOLUTION NO, 76 -'790 A RESOLUTION AUTHORIZING THE DIRECTOR OF i'INANCE TO PAY TO JOSE PEREZ AND ALINA PEREZ, INDIVIDUALLY AND AS HUSBAND AND WIFE, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $1,500, IN FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY CLAIMS AGAINST THE CITY OF MIAMI, UPON EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, Jose Perez and Alina Perez filed a claim against the City of Miami for alleged personal injury, resulting`. from an accident on June 1, 1977, at about 11:00 A.M., at or near the intersection of Brickell Avenue and S.W. 26th Road, Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's office, in accordance with Ordinance No. 8417, which creates the City of Miami's Self Insurance Program, and said office recommends that this claim be settled for the sum of $1,500.00; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENT 1 DEX,.�. r� i FTcND' Section 1. That the Director of i e isilereby authorized to pay to Jose Perez and Alina Perez, without the admission of liability, the sum of $1,500.00 in full and complete settlement of all bodily injury, claims and demands against the City of Miami, upon the execution of a release, releasing the City of Miami from all bodily injury, claims and demands. P/A: Brickell Avenue & S.W. 26th Road, Miami, Florida V 77-862 Jose Perez has"- £il-d a claim against the City of Miami, resulting from an accident, involving a City of Miami Sanitation truck. This accident occurred on June 1, 1977, at 11:00 A.M., at or near Brickell Avenue and S.W. 26th Road, Miami, Florida. The Perez unit was stopped for a traffic signal on caution heading toward the toll booth on S.W. 26th Road. The Sanitation vehicle was in the same direction, when its operator noted the Perez vehicle stopped. There was a rearend collision and the Perez vehicle was pushed some thirty feet into the intersection of U.S. #1. The property damage was $699.04. Jose Perez received a cervical strain and there is no permanent disability. Medical treatment was minimal. The special damages are as follows: DOCTORS Iiialeah Hospital Dr. Yates Lost wages from two places DATES OF TREATMENT AMOUNT 6/1/77 6/1 & 2/77 Total Medical of employment: 6/2 thru 17/77 Total Special Damages $284.75 168.00 - - $452.75 237.31 $690.06 The property damage claim was settled earlier and we can now settle the bodily injury claim for $1,500.00.
