HomeMy WebLinkAboutR-77-0779RESOLUTION NO, 77-779 Al RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH JENNINGS TOWING SERVICE FOR THE RETRIEVAL OF ONE (1) 1965 INTERNATIONAL 10-YARD DUMP TRUCK AND ONE (1) 1972 CAT D7 BULLDOZER PRESENTLY SUBMERGED IN SLUDGE LAGOON AT VIRGINIA KEY DISPOSAL PIT, EXPENDITURE IS NOT TO EXCEED $8,500.00; WITH FUNDS ALLOCATED FROM MOTOR EQUIPMENT REPLACE- MENT FUND. WHEREAS, the City of Miami in its operation of the Virginia ey Disposal Facility, also known as the Virginia Key Disposal Pit, did lose aforementioned equipment in an attempt to control a fire • in a section of the disposal area formerly used as a sewage sludge disposal lagoon; and WHEREAS, this equipment became mired and sank out of sight to the bottom of the sludge lagoon, some 20 feet in depth; and w WHEREAS, an attempt has been put forth by a contractor F"" c� Z to emp yed bythe city under an expired agreement to retrieve the O = 2 jequipment on the basis of retrieval and payment and/or no retrieval Sand no payment; and C)LL. WHEREAS, the contractor did not retrieve, the City sought CP bids for retrieval from other qualified contractors, receiving three "DOCUMENT INDEX such bids on June 27, 1977; and AAn� �o WHEREAS, the contractor did not rIeT�r'ibCity has again sought bids for retrieval from other qualified contractors receiving six such bids on September 26, 1977; and WHEREAS, having further use for this valuable equipment whose replacement cost would exceed $100,000 it is incumbent upon the City to put forth a planned effort at retrieval; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. GriKm, Jr, Assistant Cityc Manager L " OC1 7 ta1 Retrieval of Bulldozer and Truck - Virginia Key Disposal Pit 8icds have been received the second time for the retrieval of the equipment at the Virginia Key Dump. Six bids were received ranging from $8,500.00 to $17,900.00 as a high bid. Although Mr. Medera, Director of Sanitation has not recommended the low bidder because of his previous failure, I find it in the best interest to the City of Miami that Jennings Towing Service be given another chance. Payment to the con- tractor is dependent upon successful retrieval. t•tr. Jennings feels that this can be accomplished for a maximum amount of $8,500.00 in a two week period. The next low bid in addition to being higher in price has several requirements imposed on the City. There is no estimate as to what this additional work will cost, but in my opinion it could be considerable. I recommend that the attached resolution awarding the contract to Jennings Towing Service in an amount not to exceed $8,500.00 be adopted by the Commission. Kenco Services - Hialeah, Florida $17,900.00 2. Triangle Auto Center, Port Richey, Florida $15,000.00 3. Text -Mach Import -Export, Inc. - Coral Gables, Florida $14,800.00 plus 4. Biscayne Construction Co. - Miami, Florida $13,000.00 title 5. Robert Sommers - Miami, Florida $ 9,750.00 6. Jennings Towing Service - Boca Raton, Florida S 8,500.00* *5500.00 discount for use of City equipment ($8,00.00) Bidder No. 6 is the low dollar bidder and was unsuccessful in his pre- vious attempt under contract. This office granted him two extra weeks beyond his expiration date since his efforts were admirable. His plan now is to flip the dozer over on its side onto a ledge and then pull it out with power winches. In view of the fact that this bidder has had the opportunity to achieve the goal, employed various methods and techniques unsuccessfully and was granted extra time for completion, in addition to every aid from this office in City equipment usage, I have no reason at this point to believe his new effort will succeed. I believe it is time for a new approach with new efforts. Accordingly, 1 suggest that an award be made to bidder no. 5, who was the low bidder on the last go around, when bidder no. 6 was second low. Since there exists a relationship between myself and bidder no. 5, I can- not recommend an award, thereby causing a possible conflict of interest. Therefore, the selection of a bidder on this work must rest in the hands of others, however, when that selection is made, I will assume the respon- sibility of administration and supervision.
