HomeMy WebLinkAboutR-77-0746j REsoLUTioN No , ' ` 7 4 A RESOLUTION CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE A PORTION OF THAT CERTAIN NORTH -SOUTH 20-FOOT WIDE ALLEY LYING SOUTH OF THE LIMITED ACCESS RIGHT-OF-WAY OF THE 836 EXPRESSWAY AND NORTH OF N.W. 11 TERRACE, JUST WEST OF NORTH MIAMI AVENUE, SUBJECT TO THE GRANTING OF EASEMENT TO SOUTHERN BELL. WHEREAS, the abutting owner on both sides of the northerly approximately 80-foot long portion of the captioned alley has requested closure of same for better utilization of his land; and WHEREAS, the City of Miami has no objections to the clos- ing of this portion of said alley as it would not affect the usage or access for other abutting owners; and WHEREAS, the only existing utility in said portion of the alley is a telephone cable for which the appertaining owner has agreed to grant an easement to Southern Bell; and WHEREAS, this resolution is deemed as an interim measure permitting the closing of said portion of this alley, however, if the remainder of the alley is closed, a requirement thereof will be a replatting of the area so that all references to the alley can be eradicated from the Public Records; and WHEREAS, it is now in order for the Commission of the City of Miami to sanction the closure of the aforesaid alley; "DOCUMENT INDEX — ib, " CITY COMMISSION MEETING OF SEP3 31977 mum 7 7 - ■ NOW) THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION Dr THE CITY OF MIAMI, FLORIDA: Section 1. That portion of that certain 20-foot wide north -side alley lying between the westerly projection of the. south boundary of Lot 3, Block 17, amended plat of Baldwin and Oxar Subdivision (B-87) and the southwesterly limited access Right -of -Way State Road No. 836 as shown on Right -of - Way map recorded in Plat Book 83, at Page 70, Sheet 2, of the Public Records of Dade County, Florida, (subject to appertain- ing owner granting easement to Southern Bell for existing telephone cable thereinabove), be, and the same hereby is; closed. Parkes Director Department of Public WO k8 geptett ber 20, 1917 kesolution Closing Portion of 20 Foot Alley in Block 17, Baldwin and Oxar Subd.(B-87) Resolution and Sketch The owner of property located at the northerly end and on both sides of, a portion of a north -south 20-foot wide alley, has made a request to have this part of the alley which divides his property closed, for better utilization of his land. This alley is bounded on the north by the southwesterly limited access right-of-way of the 836 Expressway; on the south by the northerly right-of-way line of the westerly extension of N.W. 11 Terrace; and lying rnidway. between North Miami Avenue on the east and the southerly extension of N.W. Miami Court. (Sketch Attached). This department has no objection to the closure of this portion of the alley as it would not affect the usage or access for other abutting owners. The owner is reserving an easement for Southern Bell's tele- phone cable which is the only utility existing in the appertaining area. In the past, the City Commission has allowed some alleys and streets to be closed by resolution rather than property replatting. As an interim measure, closure by resolution would be acceptable. In the future, if the remainder of the alley is closed, this department will then require that the area be re -platted so that all references to the alley can be eradicated from the Public Records. It is now in order for the City Commission to approve the closing of the appertaining; portion of the aforesaid alley. The Department of Public Works recommends adoption by the City of Miami Commission of the attached resolution to close that portion of the 20- foot wide north -south alley lying between the westerly projection of the south boundary of Lot 3, Block 17, amended plat of Baldwin and Oxar, Subdivision (B-87) and the southwesterly limited access right-of-way State Road No 836 as shown on right-of-way map recorded in Plat Book 83, at Page 70, Sheet 2, of the Public Records of Dade County, Florida, subject to appertaining owner granting easement to Southern Bell for existing telephone cable therein above.
