HomeMy WebLinkAboutO-08704AN ORDINANCE AMEND1NC RULE XIX, SECTtt N 2 AND SECT/ON 3 OP THE CIVIL SERVICE RULES AND REGULATIONS or THE CITY Off` MIAMI, f'LORI1 A, EFFECTIVE I ECEMI3ER 15, 1961, AS AMENDED, E1 , AS CONTAINED IN ORDINANCE NO. 6945, AS AMENDED, BY PROVIDING THAT, WITH REGARD TO THE SAID RULES, EMPLOYEES IN THE INTERNATIONAL ASSOCIATION OF rum 1 Iot/TERS ISA/WAININt UNIT WILL ACCRUE VACATION AND SICK LEAVE IN ACCORDANCE WITH THE PROVISIONS OF THE CURRENT LAt3OR AGREEMENT; .REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREO1r IN CON"LtCT, INSOFAR AS THEY ARE IN CONFLICT, AND CONTAIN- ING A SEVERARILITY PROVISION. WHEREAS, the Civil Service l3oard, at its meeting of August 23, 1977, voted to amend Rule XIX, Section 2 and Section 3 of the Civil Service Rules and Regulations of the City of Miaani, as set forth herein; and WHEREAS, it is the desire of this body to incorporate these pro- visions in the Civil Service Rules and Regulations of the City of Miami; NOW, THEREFORE, BE IT ORDAINED 13Y THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Rule XIX, Section 2 and Section 3 of the Civil Service Rules and Regulations of the City of Miami, Florida, effective December 15, 1961, as amended, as contained in Ordinance No. 6945, as amended, is hereby further 1/ amended in the following particulars: "Section 2, Vacation with Pay * * * * * * b. 5. Firefighters, when working a g6-hour-week 49. 8 hour week vacation is si• 46}teurs•of-duty ten (10) hours per month (Where employees have not qualified by a full year's employment for the entire annual vacation, vacation time earned shall be on the basis of 10/12 days for each month worked on a 5-day per week schedule; 11 / 12 days on a 5 1/2-day per week schedule; 18/12 days on a 6-day per week schedules 21/12 days on a 7-day per week schedules and 17 -teur of-dts + 10 hour per month. fox Firefighters working a 66-i r-�xk 49,8 ham work a k, i c. Extra Vacation for Years of Service; Extra vacation days for years of service shall be allowed upon the completion of the required years of actual continuous service as shown below; 1. All other ordinances or parts of ordinances, insofar as they are inconsistent or in conflict with the provisions of this Ordinance, are hereby repealed. Section 3. If any section, sentence, clause, phrase, or word of this Ordinance is for any reason held or declared to be unconstitutional, inoper- ative or void, such holding or invalidity shall not affect the remaining portions of this Ordinance, and it shall be construed to have been the intent of the Com- mission of the City of Miami to pass this Ordinance without such unconstitutional, invalid or inoperative part therein; and the remainder of this Ordinance, after the exclusion of such part or parts shall be deemed and held to be valid as if such parts had not been included therein. Knox, Jr., City Attorney, pursuant to my request of August 23, 1977 following the Civil Service Board's approval of the amendment at its meeting on that date. In accordance with your request that the Board expedite approval of the proposed amend- ments in order that an ordinance amendment may be placed en the September 8, 1977 City Commission Agenda, it is respectfully requested that this amendment be placed thereon to enable the Commission to consider adoption of same as required under Section 63 of the Charter.
