AN MIRAN= AMENDING MIAMI CITY CODE, CHAPTER
64, ENVIRONMENTAL PRESERVATION, BY DELETING
PARAGRAPHS (a) AND (g) OP SECTION 644, PRO-
VTD NC FOR AN ENVIRONMENTAL PRESERVATION
REVIEW BOARD OF PIVE MEMBERS, WITH TWO
ALTERNATE MEMBERS AND BY ADDING NEW SECTIONS
O.AND (g) TO PROVIDE FOR A SEVEN MEMBER
BOARD; BY REPEALING ALL ORDINANCES, CODE
SECTIONS, OR PARTS THEREOF IN CONFLICT; AND
CONTAINING A SEVERABILITY PROVISION,
WHEREAS, the Environmental Preservation Review Board
at its meeting of August 9, 1977, passed and adopted a resolution
requesting the Commission to change the environmental preservation
chapter of the City Code as hereinafter set forth; and
WHEREAS, the Commission, after careful consideration,
deems it advisable to change the Code, as requested by the
Environmental Preservation Review Board;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OP MIAMI, FLORIDA:
Section 1. Paragraphs (a) and (g) of the Miami City
Code, Section 64-4, Environmental Preservation Review Board, be
and the same are hereby deleted.
Section 2. New Paragraphs (a) and (g) of the Miami City
Code, Section 64-4, Environmental preservation review board, are
hereby added to read as follows:
(a) Establishment; composition; appointment
of members.
There is hereby established a board to
be known as the environmental preservation review
board. The board shall consist of seven members,
to be appointed in the following manner:
(1) One or more members shall be registered
landscape architects, appointed by the city commission
from a list prepared by the Florida Chapter, American
Society of Landscape Architects.
(2) One or more members shall be nurseymen,
appointed by the city commission from a list pre-
pared by the Dade County Chapter, Florida Nurserymen
and Growers Association,
(3) One or more members shall be registered
architects. appointed by the city commission from e
list prepared by the South Florida Chapter. American
institute of Architects,
(4) One or more members shall be members
of an environmental =organisation, such as., but
not limited to, the Environmental Quality Action
Committee of the Greater Miami Chamber of Commerce,
the Beautification Council of South bade, Friends
of the Earth, the Sierra Club, Survive .and the
Tropical Audabon Society, Members shall be ap-
pointed by the city commission from lists prepared
by, but not limited to, such organizations,
(5) One or more members shall be lay
citieens who are interested in environmental pre-
servation appointed by the city cotmniasion from
lists prepared by neighborhood organi2atiotis,

(g) Removal of members. Members of the environ-
mental preservation review board may be removed for
cause by a vote of not less than three members of
the city commission. Cause for removal may include
excessive absences, (Ord. No. 8301, § 1.)
Section 3. That all laws or parts of laws in conflict
herewith be, and the same are hereby repealed insofar as they are
in conflict.
Section 4. Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the ordinance as a whole.

There have been several changes of a minor nature to the Ordinance
establishing the Environmental Preservation Review Board. In ad-
dition to those changes, there have been changes in the member-
ship of that Board, most having occurred in the last six months.
in the process of providing for new appointments due to resignations
of certain members, it was discovered that faithful and competent
service provided by Alternate Members of this Board was not duly
recognized in that these alternates were not being considered for
promotion to regular members.
One reason for this is that the Ordinance establishing the Board care-
fully specified that four of the five members had to be professionals
selected from lists provided by specified organizations. Therefore,
in order to provide for a broader representation in voting members
as well as to provide for the continued utilization of experienced and
concientious people having served as alternate members, the Board
has suggested that the Alternate Member classification be dropped in
favor of having seven regular voting members.
The amending Ordinance attached, if approved by the City Commission,
will effect this desired modification in the composition of the Board.
When this is accomplished, the Board will consist of seven voting
members, with a required quorum of four (4) at each meeting. At
present there are two (2) vacancies on the Board. I will prepare a
memorandum to the City Commission in the near future, outlining
the requirements of the Ordinance for appointments and soliciting
the Commission's nominees. One of the vacancies must be filled
by selecting from a list of nurserypersons, submitted by the Dade
County Chapter of the Florida Nurserymen and Growers Association.
The five currently occupied positions include: David Scully, Land-
scape Architect; Henry Alexander (Chinn), Architect; Michael Simon-
hoff, Environmentalist; Kathy Cole, interested layperson; Stephen
Zack (current Alternate).

Review Board
Ordinance
On August 9, 1977, the Environmental Preservation Review Board
passed and adopted a resolution requesting this office to redraft
a portion of the Miami City Code relating to the number of members
on the Board.
The present ordinance provides for five members and two alternate
members. The Board requested that the Board be comprised of seven
members with no alternate members.
