RESOLUTION NO. 77-736
A RESOLUTION GRANTING A ONE-YEAR EXTENSION OF
THE VARIANCE GRANTED BY THE ZONING BOARD
RESOLUTION NO. 40-77 FROM ORDINANCE NO. 6871,
ARTICLE XXIII, SECTION 4(27) TO PERMIT A SECOND
STORY ADDITION TO THE EXISTING BUILDING ON LOT
11 LESS W10' AND LESS THE N2" OF THE E2' AND
LOT 12 LESS W10', BLOCK 1, BILTMORE COURT (7-37),
BEING 3925 N. MIAMI AVENUE, AS PER PLANS ON FILE,
WAIVING 11 OF 11 REQUIRED OFF-STREET PARKING
SPACES; ZONED C-4 (LIBERAL COMMERCIAL).
WHEREAS, Article XXXI of the Comprehensive Zoning
Ordinance No. 6871 permits an extension of a Variance by the
City Manager with approval by the City Commission, for a one-
year period; and
WHEREAS, the City Manager recommends a one-year
extension of the Variance granted by Zoning Board Resolution
No. 40-77;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The request for a one-year extension of the
Variance granted by the Zoning Board Resolution No. 40-77 from
Ordinance No. 6871, Article XXIII, Section 4(27) to permit a
second story addition to the existing building on Lot 11 less
W10' and less the N2" of the E2' and Lot 12 less W10', Block 1,
Biltmore Court (7-37), being 3925 N. Miami Avenue, as per plans
on file, waiving 11 of 11 required off-street parking spaces,
zoned C-4 (Liberal Commercial), be and the same is hereby granted.
PASSED AND ADOPTED this 15TH day of SEPTEMBER , 1977.

ENCLOSURES.
ARTICLE XXXI of the Comprehensive Zoning Ordinance No, 6871 provides
that any Variance shall expire six months after the effective date
of the Variance unless a Building Permit or a Certificate of Use has
been issued based upon the Variance. The Ordirance further provides
that the City Manager may, after review and determiniation that sub-
stantial progress has been achieved by the applicant in terms of
project planning, extend the expiration date of the Variance for an
additional period of time not to exceed one year, subject to approval
by the City Commission.
This Department finds no objection to the granting of the extension
of time for this Variance.
We are requesting the City Attorney's office, by copy of this memo,
to prepare the proper. Resolution for this extension.
