HomeMy WebLinkAboutR-77-0735APPROVED AS TO FORM AND CORRECTNES MEA:bk 8/18/77 RESOLUTION NO. 77-755 A RESOLUTION GRANTING A ONE-YEAR EXTENSION OF Tilt VARIANCE GRANTED BY THE ZONING BOARD RESOLUTION NO. 36-77 FROM ORDINANCE NO. 6871, ARTICLE XXIII, Section 4(32), TO PERMIT CON- STRUCTION OF A TWO-STORY ADDITION TO AN EXISTING ONE STORY COMMERCIAL BUILDING, AND CONSTRUCTION OF A PROPOSED TWO STORY COM- MERCIAL BUILDING ON LOTS 46 THROUGH 50 LESS N10' OF LOT 46, BLOCK 6, MIAMI SUB.ACRES AMD (4-73), BEING APPROXIMATELY 2261-87 S.W. 37TH AVENUE, AS PER PLANS ON FILE, WAIVING ALL OFF-STREET PARKING (63 SPACES);IN CON- JUNCTION WITH CONDITIONAL USE; ZONED C-2 (Community Commercial). WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance No. 6871 permits an extension of a Variance by the City Manager with approval by the City Commission, for a one- year period; and WHEREAS, the City Manager recommends a one-year extension of the Variance granted by Zoning Board Resolution No. 36-77; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one-year extension of the Variance granted by the Zoning Board Resolution No. 36-77 from Ordinance No. 6871, Article XXIII, Section 4(32), to permit construction of a two-story addition to an existing one story commercial building, and construction of a proposed two story commercial building on Lots 46 through 50 less N10' of Lot 46, Block 6, Miami Sub.Acres Amd (4-73), being approximately 2261-87 S.W. 37th Avenue, as per plans on file, waiving all off- street parking (63 spaces); in conjunction with Conditional Use; zoned C-2 (Community Commercial), be and the same is hereby granted. W. 37th Avenu ENCLOSURES: ARTICLE .'C{XI of the Comprehensive Zoning Ordinance No. 5871, provides that any Variance shall expire six months after the effective date of the Variance unless a Building Permit or a Certificate of Use has been issued based upon the Variance. The Ordinance further provides that the City Manager may, after review and determination that sub- stantial progress has been achieved by the applicant in terms of pro- ject planning, extend the expiration date of the Variance for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extension of time for this Variance. We are requesting the City Attorney's office, by copy of this memo, to prepare the proper Resolution for this extension.
