WHEREAS, the City Cemmiesioh adopted ordinance No. 8589 on November 11, 1976, as amended, establishing revenues and appropriations for the fiscal year 1976 47; and WHEREAS, the oiympia Building at 174 East P agler Street, Miami, Florida, is owned by the City of Miami, which has the responsibility to perform capital improvements required by the county Building code; and WHEREAS, the operation and management of the aforesaid building is the responsibility of the Off-street Parking Authority Board; and WHEREAS, the cost of improvements to the Olympia Building which are required to comply with Metropolitan Dade County Ordinance No, 75-34, relating to the structural inspection of older buildings, is estimated to be $135,000; and WHEREAS, the City Commission initiated the first phase of the improvements by adopting Resolution No. 76-731 on July 22, 1976, allocating $50,000 from the Capital Improvement Fund - Unallocated Funds to be expended by the Department of Off -Street Parking; and WHEREAS, it is crucial to the safety of the Olympia Building's occupants that the remaining improvements be accomplished - namely,construc- tion of a fire escape; and WHEREAS, a total. of $85,000 is required to construct a fire escape at the Qlympia Building/ and WNEAPAS# an amount of $ 5,000 in the general rand Unallocated !Wenn is available far allocation to Special programs and Accounts and Cam pity Progrena as a contribution far Olympia.Building impro remente3 NOW, THEREPORE, BE tT OADATNED DV THE COMMON OP THE CITY or MIAMI, Mt!b t Section 1.. Section 1 of Ordinance too. 8589, adopted November 11, 19761es amended, the Annual Appropriations Ordinance for fiscal year 1976.47, is hereby further amended in the following particulars t' "Sectioh 1. The following appropriatiohs are made for the carrying oh of the municipal purposes of the City of Miami, Florida, for the fiscal year 1976.47, including the payment of principal and interest on all General obligation Bonds. Departments, Boards, and Offices GENtAAL FUND * * Special Programs and Accounts and Community programs Appropriation Amount 631-3241-+506 $9,109,:6O6 TOTAL GENERAL FUND 6 4-r144r3.34- $74,229,134 Unallocated Balance $ 143,690 Section 2. The sum of $85,000 is hereby allocated as a contribution from Special Programs and Accounts and such sun is authorized to be expended by the Department of Off -Street Parking for proposed improvements to the Olympia Building at 174 East Flagler Street, Miami, Florida. Section 3. All ordinances, code sections or parts thereof in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 4. If any section, sentence, clause, phrase or word of this ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding or invalidity shall not affect the remaining portions of this ordinance, and it shall be construed to have been the intent of the City Commission to pass this ordinance without such unconstitutional, invalid. or inoperative part therein; and the remainder of this ordinance. after the ex- clusion of ouch part or parts shall be deemed and held to be valid as if such parts had not been included therein. The City Commission adopted oh Jay 22, 1976, a resolution allocating $50,00 for part of the required improvements. The Commission acknow- ledged at that time that the total necessary improvements would cost $136000, and stated its intent to fund the remaining $85 000 during fiscal year 1977-78. In view of the critical safety -related nature of the remaining needed improvemeht - construction of a fire escape - the birector of the Department of off-street Parking, Richard La taw, has requested that the City proceed immediately. The attached proposed ordinance would appropriate $85,000 from the General Fund Unallocated Palance to Special Programs and Accounts for the purpose of providing a contri- bution for the above -mentioned improvement.
