AN ORDINANCE AMENDING THE CODE OP THE CITY
OP MIAMI, FLORIDA, BY SUBSTITUTING A NSW
$2a2+4.1 THEREIN, W1 CN PROVIDES FOR INSPECTION
AND SERVICE FENS POP ZONING CERTIFICATES OF
USE FOR NEW BUILDINGS AND PREMISES AND .At.SO
FOR ANNUAL RNINSPEC'TtON OF !autumns AND
PREMISES POR RENEWAL °CERTIFICATES AND ACCESSORY
USE CERTIFICATES OF OCCUPANCY; CONTAINING A
REPEALER PROVISION; A SEVERAgI.ITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Comprehensive Zoning Ordinance 6871, enacted May 2, 1961,
ARTICLE XXIX ADMINISTRATION, Section 4 "Certificates Required", which
established Certificates of Occupancy, and Accessory Use Certificates of
Occupancy.; and which provided for Annual Renewal of Accessory Use Cer-
tificates of occupancy, and also ordained that fees be paid for such
certification; and
WHEREAS, the City Commission deems it advisable and in the beat
interests of the inhabitants of the City of Miami to change the previously
established fees; and
WHEREAS, the City Cothmission finds that a genuine need exists for
increasing said fees;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OP
MMIAMI, FLORIDA:
Section 1. Article IV:"Departments. Division 1. Building Department" of
the Oode of the City of Miami, Florida, as amended, is hereby further amended by
repealing Section 2-24.1 in its entirety and enacting a new Section 2-24.1 to read
as follows;
"Sec. 2-24-1. Zoning certificate of use rewired; annual reinspection
of buildings and premises; fees for inspections and
issuance of certificates.
A. Inspection and Service Pies for
Certificate of Occupancy.
All persona applying for a Certificate of Occupancy for the use or occupancy
of vacant or iuproved land or for a change of use of the land or for a change
in the use of an existing building shall pay the follcming inspection and
sewice ffees;
1. IL for 1st 3,000 sq. ft.. .. J25.00
for each additional 1,000 sq. ft. or part
in excess of 3,000 sq.tt. . ... 5.00
2. WHOLES= (including warehouse and shops)

assessed -a fee as provided for under retail
sales.
D. PEES rOR ACCESSORY USE CERTIFICATES OP OCCUPANCY
All persons desiring to use a residential
building structure located within an R►1,
R-2, R-3, R-4, or R-5 District for a home
occupation shall apply to the Building
Department for an Accessory Use Certifi-
cate, which shall be granted upon payment
of an annual fee of $15.00 to the City of
Miami and when issued shall be valid through
the following September 30th. In instances
where a person 65 years of age or over is
engaged in the conduct of home occupancy,
there shall be no required payment of an
accessory fee in conjuction with the
issuance of an Accessory Use Certificate or
the subsequent renewal of such certificate.
All renewals of Accessory Use Certificates
of Occupancy shall be made on or before
October 1st of each calendar year."

Section 2. All ordinances, code sections, or parts thereof in
conflict herewith, insofar as they are in conflict, are hereby
repealed.
Section 3. Should any :section, part of section, paragraph, clause,
phrase, or word of this ordinance be declared invalid, the remaining
provisions of this ordinance shah not be affected.
Section 4. This Ordinance shall become effective on October 10,
1977

As per your request, tam submitting the following
back-up material for our proposed fee increases, which
i strongly recommend be adopted as soon ss possible.
I. Permit Pee Schedule Ord. No. 5343.
Last amendment was under Ord. No.1493 adopted
November 24, 197S. This increased the fees
between 11% and 30%. All fees were not increas-
ed at this time.
21. Accessory Use Certificate of Occupancy:
No change or increase since adoption of Ord.
No. 7076 on December 5, 1962.
III. Certificate of Use Annual Renewal:
Ord. No. 7954 .adopted April 22, 1971. Last
amendment was under Ord. No. 1313 adopted
September 12, 1974 increasing fees approxi-
mately 20%.
IV. Land (or Plan) Review Fee, Ord. No. 8108 adopt-
ed November 16, 1972. No change since.
V. New Certificate of Use Fee Ord. No. 8467 adopt-
ed September 26, 1975.
We have calculated that the cost per hour for an inspc
including fringe benefits and overhead, is a proximat*:
$20.00 (see attached breakdown.) (Exhibit A
In comparing the cost of inspections and plan :review
the permit fee paid, we find that the cost is from 27
300% more than the fee. Our proposed fee increase va4.
from 25% to 61%. The Mechanical fees, except for Elegy:
Inspection fees, which are set by the State, were not''.
ed in 1975 and the proposed increase will bring them
to actual inspectional cost. (See attached sample of permit
fee versus cost) (Exhibit E)

The &and er Plan Review pee has been reined and tees varied
by type of projects to be nate indicative of eetual review
ascessary. The existing fee applied to all projects regard*
less of complexity of project.
The new Certificate of Use Pee has also been increased to take
into account the required number of inspections and time involv-
ed. 'The new fee is based on type of project and not one fee,
as exists, regardless of time and cost.
The proposed schedule of the Annual Certificate of use
renewal fees has been raised approximately 25%, A fee of
$10.00 Boas set for the lower fees which is higher than '25%,
but is necessary to meet the actual cost. An inspection,
including necessary follow-up, takes approximately 3D minutes,
At $20.00 an hour this brings the coat to $10.00, This does
not include referrals to other divisions (Structural, Plumb-
ing, Electrical, etc.). The present fee is $5.00.
The,Accessory Use Certificate of Use fee, not changed since 1.982,
simplifies the charge as well as bringing it up closer to reflect
the increase in cost during the past 15 years.
Also included is a comparison by division of actual cost to
the City for all services versus revenue_ collected by fees.
An you will note, the largest gap ,is in the Zoning Division,
wbioh is responsible for the greatest number of non -revenue -
producing ,services.(txhibit C)
