HomeMy WebLinkAboutR-77-0701RESOLUTION NO, 7 7 7 0_1 A`itESODUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO WILFREDO DIEZ AND OLGA DIEZ, WITH AN ADDITIONAL PAYEE, ATKINS BODY WORKS, THE REPAIRING FACILITY, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $1,487.77 IN FULL AND COMPLETE SETTLEMENT OF ANY AND ALL CLAIMS AGAINST THE CITY OF MIAMI, UPON ' THE EXECUTION OF A RELEASE, RELEASING THE CITY OF-MIAMI FROM ALL CLAIMS AND DEMANDS. •4I WHEREAS, Wilfredo Diez and Olga Diez filed a claim •against the City of Miami, for alleged property damage, resulting from an accident involving a City owned vehicle on July 5, 1977, at about 9:15 A.M., at or near N.W. 20th Street and N.W. 14th Avenue, Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's office, in accordance with Ordinance No. 8417, which creates the City of Miami's Self Insurance Program, and said office recommends that this claim be settled for the sum of $1,487.77; NOW, THEREFORE, BE IT RESOLVED BY THE OF "DOCUMENT JTI N D EX THE CITY OF MIAMI, FLORIDA: ITEM NO Section 1. That the Director of Finance is hereby authorized to pay to Wilfredo Diez, Olga Diez, and Atkins Body Works, without the admission of liability, the sum of $1,487.77 in full and complete settlement of any and all claims against the City of Miami, upon the execution of a release, releasing the City of Miami from any and all claims and demands. P/A: N.W. 20th Street near N.W. 14th Avenue Miami, Florida Wilfredo and Olga Diez have filed a claim against the City of Miami, resulting from a vehicle accident, involving a City of Miami Police vehicle. This accident occurred on July 5, 1977, at 9:15 A.M., on N.W. 20th Street, near N.W. 14th Avenue, Miami, Florida. The Police vehicle was eastbound on 20th Street in the right traffic lane, while the claimant vehicle was eastbound in the left traffic lane. Without advance warning, the Police vehicle started a U-turn in the middle of a block, so that its operator could attend what appeared to be an injured dog. As this was initiated, the front right end of the claimant vehicle immediately to the left of the Police unit, made contact with the left front fender and door area. The rear of the vehicle also made contact in this movement. The City vehicle operator did not take proper precaution to make sure the lanes were cleared before this action was taken. This is a matter that we can settle for property damage, which is found to be proper in the amount of $1,487.77. The claimant vehicle is owned b7 Wilfredo Diez, while it is being driven in this instance by his wife, Olga. We are able to conclude this matter without bodily injury expense at this point. The itemized repairs to the vehicle are $1,487.77.
