A tSOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE
1N LIEU OF CONDEMNATION THE VACANT PROPERTY LOCATED
ON THE NORTHWEST CORNER OF SOUTHEAST SECOND AVENUE AND
SOUTHEAST FOURTH STREET, MIAMI, FLORIDA, FOR THE SUM
OF TWO (HUNDRED EIGHTY-FIVE THOUSAND ($285,000.00)
DOLLARS NET AND ALLOCATING TWO HUNDRED NINETY-FIVE
THOUSAND ($295,000.00) DOLLARS FROM CONVENTION CENTER
BOND FUNDS TO COVER TILE COST OF ACQUISITION OF FEE
SIMPLE TITLE TO THIS PROPERTY AND OTHER COSTS INCIDENT-
AL TO THE ACQUISITION.
WHEREAS, the vacant property located on the Northwest corner o
Southeast Second Avenue and Southeast Fourth Street, Miami, Florida, is pro=
posed to be acquired for the expansion of the Convention Center site, and
WHEREAS, the Convention Center Committee has approved the acquisi-
tion of this vacant property to provide additional land that will be necessary
for entrance and egress to the property, and concurs with the recommendation to
acquire this parcel; and
WHEREAS, the necessary monies for said acquisition are available
in the Convention Center Bond Fund; and
WHEREAS, this acquisition is in accordance with the Land Acquisi-
tion Policies under Community Development Programs as detailed
led in HUD Handbook

WHEREAS, the appraised value was $261,250.00, and through a series
of negotiations a final negotiated price of Two Hundred Eighty-five Thousand
($285,000.00) Dollars net was arrived at to acquire said property as the City
will pay all costs of abstract, documentary stamps, surtaxes and recording
expenses, but the Ad Valorem taxes shall be pro -rated at the time of closing,
and
WHEREAS, it is more advantageous and in the best interest of the
City of Miami to acquire this property by purchase through negotiation rather
than condemnation because of the cost factor of legal expenses and reimbursements

WHEREAS, the owner of the property has, by letter dated June 17,
1977, offered to convey fee simple title to this property to the City of Miami,
Florida for the price of Two Hundred Eight -Five Thousand ($285,000.00) Dollars

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
FLORIDA:

Acquisition of Land
Magnuson Property
Copy of Resolution;
By Notion No. 76-1054, the City Commission authorized and directed the City
Manager to obtain an appraisal and negotiate a price on a parcel of property
known as the Magnuson property, containing approximately 5,000 sq. ft., as a
needed adjunct to the proposed Convention Center Complex, and to report to
the City Commission either a negotiated price, or his recommendation.
In accordance to that motion, the acquisition process was instituted, with
the solicitation sent out for proposals to 18 appraisers, and 5 proposals Were
received. The two appraisers selected, were the lowest of the five bids sub-
mitted.
The pertinent facts regarding this acquisition are as follows:

After a series of negotiations, a final negotiated price of $285,000.00 net
as agreed upon, subject to the final approval by the City Commission. This
negotiated price is in excess of the normal bonus allowable by Resolution No.
77-73, but if we were to condemn the property for public use, the cost of
attorneys' fees, court costs, and other costs incidental to the condemnation
proceedings would be in excess of the final negotiated price. Therefore, it
is recommended that this property be acquired at the said price.
As Federal funds may be involved, this acquisition was transacted in accordance
to the Land Acquisition Policies as determined in HUD Handbook 1320.1, Real
Property Acquisitions.
