A RESOLUTION REVERSING THE ZONING BOARD's
DENIAL OF REQUEST FOR VARIANCE FROM ORDI-
NANCE NO. 6871, ARTICLE XXVII, SECTION 1,
TO PERMIT ESTABLISHMENT OF A LIQUOR LICENSE
FOR A BAR AND PACKAGE STORE ON LOTS 8 AND 9,
BLOCK 5, FOREST PARK FIRST ADD (6-6), BEING
6285 N.W. 7TH AVENUE, AS PER FLOOR PLAN ON
FILE, BEING 217.4', 320', 547.5' AND 647.9'
(2500' REQUIRED) FROM OTHER LICENSEES, ALSO
BEING 55' FROM A CHURCH (300' REQUIRED), IN
CONJUNCTION WITH CONDITIONAL USE APPLICATION,
ZONED C-4A (BOULEVARD COMMERCIAL).
WHEREAS, the Miami Zoning Board, at its meeting of
June 20, 1977, Item No. 6(b), following an advertising Hearing,
adopted Resolution No. ZB 107-77 by a 6 to 1 vote denying the
Variance as hereinafter set forth; and
WHEREAS, the Commission, after due deliberation and
careful consideration of this matter, has determined that the
applicant has presented a legal hardship and that the Zoning
Board erred in this matter;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:

Section 1. The Zoning Board's denial of request for
Variance from Ordinance No. 6871, Article XXVII, Section 1, to
permit establishment of a Liquor License for a bar and package
store on Lots 8 and 9, Block 5, FOREST PARK FIRST ADD (6-6), being
6285 N.W. 7th Avenue, as per floor plan on File, being 217.4',
320', 547.,5' and 647.9' (2500' required) from other licenses,
also being 55' from a church (300' required), in conjunction with
Conditional Use application; zoned C-4A (Boulevard Commercial) be
and the same is hereby reversed and said request be and is hereby
granted,

Variance Application to permit establishment of a
liquor license for a bar and package store being
within 2500' from four other licensees and within
300' from a church. A Conditional Use approval
for the bar is also under consideration.
Applicant states that a nearby new entrance & exit
to I-95 has caused DOTT to eliminate on -street
parking on NW 62nd Street. As a consequence,
about 5007„ of his business has been lost, making
it necessary to find a new location.
The Zoning Board previously granted approval,
March 21, 1977, but that application did not include
the necessary waiver as to distance requirement
from a church.
DENIAL: A hardship does not exist by which to ,approve
the requested variances.
Denied, ,Tune 20, 1977, resolution ZB 106-77 and
ZB 107-77, by a 6-1 vote.
Fourteen objections were received by mail and eleven
objectors appeared at the public hearing.
