RESOLUTION NO. 77-606
A tESOLUTION PERMANENTLY GRANTING THE WAIVER OP
DEVELOPMENT FOR 15 OF THE 29 PARKING SPACES
REQUIRED IN CONJUNCTION WITH THE CONSTRUCTION
OF A 23-UNIT APARTMENT BUILDING FOR THE ELDERLY
ON N.W. 1ST AVENUE, EAST SIDE, BETWEEN N.W.
76TH AND 77TH STREETS (SITE N0. 20), BEING LOTS
5 AND 6, BLOCK 2, PHOENIX PARK (6-80), LOCATED
IN AN R-3 (LOW DENSITY MULTIPLF) DISTRICT.
WHEREAS, the City Commission granted the waiver of:
Parking as set forth herein for one-year periods on November 1
1970; and
WHEREAS, the site has been reviewed by the Chief
Zoning Inspector for seven (7) consecutive years; and
WHEREAS, there has never been a problem with the waiver
of development of these parking spaces;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE:
CITY OF MIAMI, FLORIDA:
Section 1. That the waiver of development for 15 of
the 29 parking spaces required in conjunction with the construction
of a 23-unit apartment building for the elderly on N.W. 1st Avenue,
East Side, between N.W. 76th and 77th Streets (Site No. 20), being
Lots 5 and 6, Block 2, Phoenix Park (6-80), located in an R-3 (Low
Density Multiple) District, be and it is hereby permanently granted.
PASSED AND ADOPTED this 21 day of JULY
1977.

N.W. 1st Avenue, east side,
between N.W. 76th and 77th Streets
On November 19, 1970, the City Commission adopted Resolution No.
42005 granting the waiver of the development of 15 of 29 parking
spaces for a period of one year in conjunction with a 23-unit
apartment building for the elderly. This waiver has been auto-
matically renewed yearly to this date.
Attached is a report from the Chief Zonimi Inspector recommending
the permanent waiver of these spaces or to increase the renewal
periods from one year to three years.
We are, by copy of this memorandum, requesting the City Attorneys
office to prepare a Resolution for the permanent waiver of these
parking spaces.

The City Commission passed the above Resolution granting relief
from the requirements of the Comprehensive Zoning Ordinance, to
be automatically renewed each year for one year periods, until
such time as the Commission shall rescind its waiver.
Would you please inspect the sub,tct property to make sure that
the intent of the Resolution is being met, and return this form
to us, showing the results of the inspection below.

Recommend automatic renewal of Resolution.
Recommend that the City Commission review this matter. Discovered
the following problems: An inspection on June 13, 1977, between
#42005
hour of 7 : 1 5 to 7 : 30 PM, revealed two
of fourteen parking spaces
being utilised, I\eC011mend permanent wtliver or increase renewal
periods from one year to three years.
