HomeMy WebLinkAboutR-77-0602-A-a RESOLUTION NO. 77-E92 k A RESOLUTION GRANTING A SIX-MONTH EXTENSION OF COMMISSION RESOLUTION NO. 77-63(A) WHICH GRANTED A SIX-MONTH EXTENSION OF ZONING BOARD RESOLUTION NO. 124-76 WHICH ('RANTED THE CONDITIONAL USE AS LISTED IN ORDINANCE 6871, ARTICLE XV, SECTION 2(8)(d), TO PERMIT CONSTRUCTION OF BUILDING CON- TAINING 299 DWELLING UNITS ON LOTS 12 THRU 16, BLOCK 1, NELSON VILLA & GARDEN OF EDEN AMD (30-20) & UNPLATTED, BEING APPROXIMATELY 535 N.E. 15TH STREET, SUBJECT TO THE FOLLOWING CONDITIONS: 1. LANDSCAPING & SITE PLANNING PORTION OF WORKING DRAWINGS SHALL BE SUBJECT TO APPROVAL BY PLANNING DEPARTMENT. REGISTERED LANDSCAPE ARCHITECTURAL CONSULTANT BE EMPLOYED FOR DESIGN & SITE PLANNING OF LANDSCAPING WHICH INCLUDES THE 16TH STREET PEDESTRIAN MALL & THAT PORTION OF TRINITY CHURCH ADJACENT TO THE PROJECT. A CONTINUOUS LANDSCAPED PLANTER BE PROVIDED ON THE OFF-STREET PARKING GARAGE & RECREATION DECK AS INDICATED IN PRELIMINARY DRAWINGS. LANDSCAPE TREATMENT ON TWENTY-SIX FOOT AVERAGE WATERFRONT AREA & OTHER GROUND LEVEL AREAS BE PRO- VIDED AN OPEN GROUND FLOOR VISTA FROM TRINITY CHURCH TO BISCAYNE BAY THROUGH THE COM2TERCIAL AREA BE PROVIDED. 8. A SCULPTURED WALL & WATERFALL TREATMENT ON THE WEST SIDE ADJACENT TO TRINITY CATHEDRAL BE PROVIDED; ZONED C-3 (CENTRAL COMMERCIAL). "DOCUMENT INDEX ITEM N0. WHEREAS, Article XXXII of the Comprehensive Zoning Ordinance No. 6871 provides that a Conditional Use shall expire six (6) months after the effective date of the Conditional Use unless a Building Permit or a Certificate of Use has been issued based upon the Conditional Use; and WHEREAS, the Ordinance further provides that the City Manager may, after review and determination that substantial prog- ress has been achieved by the applicant in terms of project planning, extend the expiration date of the Conditional Use for an additional period of time not to exceed one year, subject to the approval of the City Commission; and WHEREAS, a six-month extension of the Conditional Use, as hereinafter set forth, has been granted; and WHEREAS, the City Manager has recommended the grant of an additional six-month extension; CITY COMMISSION MEETING OF JUL 2 1 1277 77•60 RESCIMION NQ MOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE (;1TV OF MIAMI, FLORIDA: Section 1. The request for a six-month extension of Resolution No. 77-63(A) which granted a six-month extension of Zoning Board Resolution No. 124-76 which granted the Conditional Use as listed in Ordinance 6871, Article XV, Section 2(8)(d), to permit construction of building containing 299 dwelling units on Lots 12 thru 16, Block 1, NELSON VILLA & GARDEN OF EDEN AMD (30,-20) & linplatted, being aporoximately 535 N.E. 15th Street, subject to the following conditions: 1. Landscaping & site planning portion of working drawings shall be subject to approval by Planning Department. Registered landscape architectural consultant be employed for design & site planning of landscaping which includes the 16th Street pedestrian mall & that portion of Trinity Church adjacent to the project. Property be platted with dedication of 12.5 feet of 16th Street adjacent to the zoned right-of-way line. 16th Street be developed as a landscaped pedestrian mall & that the developer maintain that portion of mall adjacent to the project. A continuous landscaped planter be provided on the off-street parking garage & recreation deck as indicated in preliminary drawings. Landscape treatment on twenty-six foot average waterfront area & other ground level areas be provided. An open ground floor vista from Trinity Church to Biscayne Bay through the commercial area be provided. . A sculptured wall & waterfall treatment on the west side adjacent to Trinity Cathedral be provided; zoned C-3 (Central Commercial), be and the same is hereby granted. At. the Commission Hearing on January 2f), i';77, the Commission approved a six month extension under Resolution No. 77-63(A) with the proviso that in case we found ourselves needing the additional time, they would act. on it. We respectfully r+±qur•:st the grant..ing of an additional .;ix month extension for the commencement, of this project. Although we expect our permit appli cati on to be submitted within the next 90 days, it is rea:soliable to calculate a certain amount of tine, approxi- mately a month, be allocated for the examination of these voluminous plans by the various sections of the Building Department.
