HomeMy WebLinkAboutR-77-0601MEA:bk 7/1/77 RESOLUTION NO. 77-601 A RESOLUTION AFFIRMING THE ZONING BOARD'S DENIAL OF THE REQUEST FOR CONDITIONAL USE AS LISTED IN ORDINANCE NO. 6871, ARTICLE V, SECTION 1(6)(j), TO PERMIT OPERATION OF A DAY NURSERY ON LOT 11, BLOCK 3, PRINCESS PARK KN MANOR l((0-18),NE BEING 6784 TAMIAMI CANAL ROAD; WHEREAS, the Miami Zoning Board, at its meeting of May 16, 1977, Item No. 6, following an advertised Hearing, adopted Resolution No. ZB 87-77 by a 7 to 0 vote denying Conditional Use as listed in Ordinance No. 6871, Article V, Section 1(6)(j), as hereinafter set forth; and WHEREAS, the applicant has taken his appeal to the Commission; and WHEREAS, the Commission finds that the Zoning Board properly denied this matter since the establishment of this use in the proposed location would be injurious to the neighborhood and/or adjacent properties and would be otherwise detrimental to the public welfare; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Board's denial of the request for Conditional Use as listed in Ordinance No. 6871, Article V, Section 1(6)(j), to permit operation of a day nursery on Lot 11, Block 3, Princess Park Manor (60-18), being 6784 Tamiami Canal Road; zoned R-1 (One Family), be and the same is hereby affirmed. Applicant states that he owns a nursery located at 81 Gran Canal. Drive which must be moved to a new location. Proposed site would allow him to continue the operation. APPROVAL in accord with the limitations and requirements of the Zoning Ordinance for this use, and subject to the providing of a site plan for plan- ning Departfi nt approval indicating play areas, drop off areas, landscaping, and wall locations. Day care facilities are an established need in the community, and the subject site is of sufficient size to contain a limited day care facility. Plans were not submitted indicating the play areas walls, hedges, landscaping, which should be provided prior to the issuance of any building permit. Recommend denial on May 16, 1977 by a 7-0 vote.
