Revocation o AdUlt toV 6 hicense rit_FI:kENdes! thcLBsURr§: The Code of the City of Miami, at Section 30.11, provides that: "The license of any person for the operation of any business may be revoked by the city commission at any time, upon notice and hearing, for violation of this Code or any other ordinance of the city or law of the state, or for any other good and sufficient reason; provided, that this section shall not affect the power of the municipal court to revoke certain licenses where such revocation is specifically provided for by law. Whenever any city license upon any premises in the city has been revoked for any cause whatsoever, no subsequent license or certificate of occupancy shall be issued by the city for the premises for a similar occupation or business or profession to that which has been revoked for a period of ninety days subsequent to the effective date of the revocation. Any city license which is revoked or suspended for a specified or limited period of time less than ninety days is exempt from the operation of this section." Additionally, the statutes of the state of Florida permit the revoca- tion of occupational licenses where the licensee has been con"►icted of an offense which is directly related to the specific occupation, trade, vocation, profession or business for which the license is issued. The following business entities are owned or operated by individuals who have recently been convicted of offenses which may be characterized as "sex related" and are directly related to the business enterprises that these individuals may own or operate, which are broadly characterized as adult entertainment facilities: Escort Services International Downtown Theatre, Inc. The individuals whose licenses are sought to be revoked are entitled to appear, before the City Commission pursuant to notice and defend against the contemplated revocation, While the entire area of the law related to obscenity and pornography is in a state of constant change, and while one cannot accurately predict a municipality's ability to withstand a constitutional challenge, I am confident that should the Commission decide to reVoke these licenses, it would have done so pursuant to the reason- able exercise of the Commission's police power to regulate business activities and to undertake actions that are reasonably calculated to protect the health, safe, welfare and morals of the citizens of the City of Miami, C K,Jr/bbb Joseph R.
