A RESOLUTION OF THE MIAMI CITY COMMISSION GRANTING THE APPEAL
FILED BY THE DEPARTMENT OF HOUSING AND COMMUNITY
MODIFYING THE DECISION OF THE MIAMI HISTORIC AND
SECTION 23-6.2(B)(4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
CERTIFICATE OF APPROPRIATENESS TO PERMIT NEW CONSTRUCTION
AND SITE IMPROVEMENTS ON A PROPERTY LOCATED APPROXIMATELY
AT 411 NORTHEAST 69 STREET MIAMI, FLORIDA, 33138, WITHIN THE
PALM GROVE HISTORIC DISTRICT; WITH FOLIO NUMBER 01-3218-004-
0920.
WHEREAS, on January 6, 2026, the Historic and Environmental Preservation Board

improvements on a property located approximately at 411 Northeast 69 Street with the Folio
Number 01-3218-004-
WHEREAS, the application for the SCOA regarding the Property was for the following:
new construction and site improvements, located within the Palm Grove Historic District,
WHEREAS, at the conclusion of the hearing, a motion to defer the Application resulted
in a unanimous vote of seven (7) of the HEPB members, constituting a deferral with
recommendations of the Application; and
WHEREAS, on February 3, 2026, the HEPB, at a duly noticed hearing, considered Item
No. HEPB. 2, pursuant to Section 23-6.2(b)(4) of the City Code, the application for a SCOA
regarding the Property, and
WHEREAS, at the conclusion of the hearing, a motion to approve the Application with
the staff recommended conditions and an additional condition to provide a tile roof rather than a
shingle roof resulted in a vote of seven to two (7-2) of the HEPB members, constituting an
approval with conditions of the Application and adopted Resolution No. HEPB-R-26-010; and

WHEREAS, the Department of Housing and Community Development on behalf of the

6.2(e) of the City Code regarding the tile roof condition; and
WHEREAS, the Property is vacant lot in the Palm Grove Historic District and is non-
contributing; and
WHEREAS, specifically, the appeal challenged the condition that required a tile roof
rather than a shingle roof; and
WHEREAS, a shingle roof within the Palm Grove Historic District is in accordance with
the Secretary of the Interior's Standards; and
WHEREAS, it is found that the proposed development on the Property, including a
shingle roof, does not adversely affect the historic, architectural, or aesthetic character of the
subject structure or the relationship and congruity between the subject structure and its
neighboring structures and surroundings; and
WHEREAS, it is found that the proposed development on the Property, including a
shingle roof, does not adversely affect the special character or special historic, architectural, or
aesthetic interest or value of the overall historic district; and
WHEREAS, several of the surrounding structures and homes in the area have shingle
roofs; and
WHEREAS, based on the testimony and evidence presented and in the record, after due
notice and an opportunity to be heard has been afforded to all parties and members of the
public, it is found that there is competent substantial evidence in the record to grant the appeal
the Application request satisfies the requirements for an SCOA without the tile roof condition;
and
WHEREAS, based on the above, the City Commission grants the appeal and modifies
Resolution No. HEPB-R- 26-010 to remove Condition #8 related to a tile roof as it pertains to the
SCOA for the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission grants the appeal and modifies the decision of the
HEPB as set forth in Resolution No. HEPB-R-26-010, approving the SCOA Application for the
Property with the staff recommended conditions and removing Condition #8 contained in
Resolution No. HEPB-R-26-010 regarding the tile roof.

Section 3. This Resolution shall become effective immediately upon its adoption and

signature of the Mayor.
APPROVED AS TO FORM AND CORRECTNESS:

If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission
