City of Miami Legislation Resolution Enactment Number: R-26-0096 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18938 Final Action Date:2/26/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A LANDSCAPE AND STORMWATER MAINTENANCE MEMORANDUM OF AGREEMENT ("MMOA") BETWEEN THE CITY OF MIAMI ("CITY") AND THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") ON STATE ROADS AND AN INTER -AGENCY AGREEMENT WITH MIAMI-DADE COUNTY ("MDC") ON COUNTY STREETS AS NEEDED. WHEREAS, the City of Miami ("City") in its efforts to provide more efficient services for its residents is seeking to supplement the maintenance of roads, streets, and other right-of-way within its neighborhoods; and WHEREAS, the City does not have jurisdiction over certain roads and streets to be able to conduct landscaping such as tree trimming, median lawn and hedge maintenance, or stormwater maintenance such as drainage cleaning, without the consent of the Florida Department of Transportation ("FDOT") or Miami -Dade County ("MDC"); and WHEREAS, the City would also find it beneficial to be able to implement litter control, street sweeping and pressure cleaning of roads/streets where not otherwise possible because of the lack of jurisdiction over certain roads and streets; and WHEREAS, it is the intent of the City to enter into a Maintenance Memorandum of Agreement ("MMOA") with FDOT or inter -agency agreement with MDC designating and setting forth the City's supplemental responsibilities as set forth herein on state and county roads/streets, subject to the availability of funding at the time of need; and WHEREAS, the City will identify the most impacted FDOT and MDC thoroughfares that may require the supplemental responsibilities as set forth herein to be undertaken; and WHEREAS, the City authorizes the City Manager to negotiate and execute agreements, in a form acceptable to the City Attorney, for said purposes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to negotiate and execute either a MMOA with FDOT or inter -agency agreement with MDC for the purposes stated herein. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provision.
