Dear Property Owner: The Greater Miami Expressway Agency (GMX) in coordination with the Florida Department of Transportation (FDOT) is proposing improvements to State Road 836 / Dolphin Expressway. The construction of such improvements includes the enhancements on SR 836 from NW 17th Avenue to the Midtown Interchange. These enhancements include double -decking SR 836, beginning just east of the toll gantry at NW 17th Avenue, rising over the center of SR 836, and touching down at 1-395, east of the 1-95 Interchange. The double -decked section will provide drivers with a direct connection to the MacArthur Causeway that is free of local entry and exit traffic. In addition, the existing eastbound SR 836 ramp to northbound 1-95 will be widened to include an additional lane reducing the congestion that drivers currently experience. Please see attached Fact Sheet for details. Parcel 877 is intended to be conveyed to the City of Miami for a sidewalk easement that will be constructed in the State's Right of Way. WHEREAS, the Miami -Dade Expressway Authority ("MDX") is a body politic and corporate, a public instrumentality, and an agency of the State of Florida established under the Florida Expressway Authority Act, as amended ("Act"), and Ordinance No. 94- 215, adopted on December 13, 1994 by the Board of County Commissioners of Miami - Dade County; and WHEREAS, through its adoption of the Act, the Florida Legislature enacted Part I of Chapter 348, Florida Statutes ("Part I"), declaring that there is a public need for the rapid construction of safe and efficient transportation facilities and providing a mechanism to effectuate construction of such transportation facilities; and WHEREAS, as an expressway authority created and established under the Act, MDX may exercise all powers necessary, appurtenant, convenient, or incidental to the carrying out of the purposes desk in Part I; and WHEREAS, Part I authorizes MDX to acquire, hold, constrict, improve, maintain, operate, and own an expressway system, and to construct additional expressways for the purpose of expanding and improving the expressway system which it currently operates; and Page 1 of4 WHEREAS, MDX maintains a five-year work program to identify and prioritize expansion and capacity improvement projects that it anticipates funding over the next five years, and it periodically evaluates and modifies specific projects that are included in a Five -Year Transportation Improvement Program (`TIP"); and WHEREAS, MDX approved in February 2014 a Fiscal Year 2015-2019 Work Program, which incorporates the curtest TIP and designates Project 83611 (SR 836 / I-95 Interchange Improvements; "Project 83611") as an existing system improvement project to widen roadways and reconstruct bridges, modify interchanges, and upgrade other corridor components to current design standards; and WHEREAS, in conjunction with transportation consultants and through public / agency coordination, FDOT, in partnership with MDX, prepared a Project Development and Environment study (`PD&E") for Project 83611, and atter public inspection and public hearing, approved it for the purpose of improving operational conditions, correcting safety deficiencies, increasing capacity, and enhancing access along the eastern 1.8 mile portion of the SR 836 corridor, and WHEREAS, the PD&E contains a comprehensive analysis of the real property impacts associated with alternate routes and configurations, and designates a preferred route and recommended configuration for construction of Project 83611; and WHEREAS, in March 2014, MDX adopted a Property Acquisition Policy, which authorizes it to acquire any interest in real property that it deans necessary for the fulfillment of project goals, and delegates authority to the Executive Director, or his designee, to acquire real property under Section 348.0008 ("Acquisition of Lands and Property"), Florida Statutes, through negotiated conveyance or the power of eminent domain; and WHEREAS, it is necessary for MDX to exercise its authority under Part I to acquire interests in real property at specific locations for the purpose of constructing Project 83611 along a prefe„Pled route and through a recommended configuration to improve operational conditions, correct safety deficiencies, increase capacity, and enhance access along the eastern 1.8 mile portion of the SR 836 corridor. NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI-DADE EXPRESSWAY AUTHORITY: Section 1: The recitals contained in the preamble to this Resolution are incorporated by reference herein. Section 2: It is declared that it is necessary to acquire, through negotiated conveyance or the power of eminent domain, interests in real property for construction of Project 83611 along a preferred route and through a recommended configuration to widen roadways and reconstruct bridges, modify interchanges, and upgrade other corridor components to current design standards. It is further declared that such acquisitions serve Page 2of4 a public purpose, to wit: to improve operational conditions, correct safety deficiencies, increase capacity, and enhance access along the eastern 1.8 mile portion of the SR 836 corridor. Section 3: The Executive Director and all others designated to act on his behalf are authorized to acquire interests in real property in accordance with MDX's Property Acquisition Policy, and to initiate eminent domain proceedings pursuant to Florida Statute Chapters 73 and 74, and Part I, and to file petitions, pleadings, affidavits, declarations of taking, and any other docents authorized by Florida Statute or rule of court to acquire interests in real property for construction of Project 83611. Section 4: The Executive Director and all others designated to act on his behalf are authorized to contract with engineers, real estate appraisers, title examiners, counsel, and other expert witnesses and consultants in connection with efforts to acquire interests in real property. Section 5: The Executive Director and all others designated to act on his behalf are authorized to take such further actions as are reasonably necessary to fully accomplish the purposes hereinabove directed. Section 6: If any section, paragraph, clause, or provision of this Resolution shall be held to be invalid or ineffective for any reason, the remainder of this Resolution shall continue in full force and effect, it being expressly found and declared that the remainder of this Resolution would have been adopted despite the invalidity or ineffectiveness of such section, paragraph, clause, or provision. Section 7: This Resolution shall take effect immediately upon its adoption, and any provisions of any previous resolutions in conflict with the provisions herein are superseded. The Easement Area may be used by the Grantee for the sole purpose of maintaining a sidewalk for public use. The parties agree this Perpetual Easement shall be automatically void if the Grantee ceases to use it as a sidewalk for a period of one year and the Grantee will promptly cooperate and execute anything reasonably required by Grantor or its attorney to release this Perpetual Easement. This Perpetual Easement contains the entire agreement between the parties relating to the rights hereby granted and the obligations hereby assumed. Any oral representations or modifications concerning this Perpetual Easement shall be of no force or effect. Grantee will have the right to enforce the terms of Perpetual Easement and the rights and obligations hereby created by the exercise of any rights and remedies provided under the laws of the State of Florida, including, without limitation, the right to sue for damages for breach, injunction, or specific performance. Notwithstanding the rights granted to Grantee herein, the Grantor reserves the right to enter into the Easement Area for the purpose of maintaining the SR 836 roadway. 1 The Grantee shall be solely responsible to maintain the Easement Area and the sidewalk constructed therein. In the event that Grantee fails to maintain the Easement Area, the Grantor shall give the Grantee notice of the same. If Grantee fails to maintain within ten (10) days after receiving the notice from the Grantor, the Grantor, in its sole and absolute discretion, shall have the right but not the obligation to perform the required maintenance and Grantee shall reimburse Grantor for any costs expended by Grantor. Subject to the limitations of Section 768.28, Florida Statutes, as amended, by acceptance of this instrument, the Grantee agrees to indemnify, defend at its sole cost and expense, and hold harmless the Grantor from all and against all suits, claims, judgments, and all loss, damage, costs or charges including attorney's fees and court costs arising directly or indirectly from the use or existence of the Grantee's Improvements within the Easement Area. The Grantee acknowledges its liability for torts to the extent provided and allowed under Section 768.28, Florida Statutes, as amended. This indemnification shall survive any cancellation or expiration of this Perpetual Easement. - Any contractors utilized by Grantee in connection with activities undertaken in connection with this Easement shall: (1) indemnify, hold harmless, and defend, at their sole cost and expense, the Grantor and the Grantee for their negligent acts or omissions of the contractor and its subcontractors or their failure to secure necessary permits, approvals , bonding or insurance or to comply with applicable codes, laws and regulations in connection with any activities undertaken on the Easement Area; and (2) obtain and provide to Grantor a certificate of insurance naming the Miami -Dade Expressway Authority as an Additional Insured. Any disputes between the parties under this instrument will be resolved in accordance with the Florida Governmental Conflict Resolution Act, Ch. 164, Fla. Stat., as amended from time to time. The enhancements on SR 836 are from NW 17 Avenue to the Midtown Interchange. These enhancements include double -decking SR 836, beginning just east of the toll gantry at NW 17 Avenue, rising over the center of SR 838, and touching down at 1-395, east of the 1-95 interchange. The double -decked section will provide drivers with a direct connection to the MacArthur Causeway that is free of local entry and exit traffic. The existing SR 836 roadway and bridges will serve as a collector distributor system that allows drivers to enter and exit from the existing local roads and 1-95. This collector distributor system will reduce the existing weaving movements resulting in enhanced safely and better traffic operations on SR 836. In addition, the existing eastbound SR 836 ramp to northbound 1-95 will be widened to include an additional lane reducing the congestion that drivers currently experience. These enhancements are from NW 8 Street to NW 29 Street and include the total replacement of the concrete pavement for both the northbound end southbound travel lanes. An auxiliary lane will be added along north- bound 1-95 from north of NW 17 Street to NW 29 Street to receive the additional traffic 1rem the eastbound SR 836 ramp to northbound 1-95 and enhance the flow of traffic through the Mdtown Interchange. The project also includes the construction of a new connector ramp from southbound 1-95 to westbound SR 836. This new connector ramp will enhance the flow of traffic and reduce weaving movements. Thls portion of the project will also enhance safety. N STAR P AND HIBI 1-395 RECONSTRUCTION ENHANCEMENTS Enhancements along 1-395 are from the SR 836/1-95/1-395 (Midtown) Interchange to the MacArthur Causeway, approximately 1.4 miles long. The project will completely reconstruct the existing facility and create a signature bridge that will span 1,025 feet over NE 2 Avenue and SRSBiscayne Boulevard, redefining the Miami skyline with its six sweeping arches. The project will create additional capacity on 1-395 with a total of three through lanes in each direction and provide separate connector ramps for traffic to and from 1-95. The existing 1-395 eastbound off -ramps at NE 2 Avenue will be moved west to North Miami Avenue, and the westbound on -ramps at NE 1 Avenue will be shifted to the west of North Miami Avenue. The limits on 1-95 are from NW 8 Street to NW 29 Street. The project is expected to be completed in late 2027 at a cost of $840 million. This schedule could change due to weather or other unforeseen circumstances. THIS PROJECT WIL Transform our COMMt!NIT" by reconstructing 1-395, including an iconic bridge over Biscayne Boulevard and allow for the connection of Overtown, Downtown Miami, Omni, and Edgewater to each other by a contiguous trail that includes community activity areas. Enhance for commuters by reducing weaving movements associated with drivers entering and exiting SR 836 and 1-95 at the Midtown Interchange. Safety will also be enhanced for pedestrians under the new bridges with creation of the trail and enhanced crosswalks. Increase for residents, commuters and tourists by increasing capacity on SR 836, 1-95 and I-395. SR 836 will be double -decked to allow for a direct connection between SR 836 and the MacArthur Causeway. Mobility in Overtown will also be improved with the connection of NW 2 Avenue under 1-395 and improvements to arterial roads. Be designed and constructed with in mind for commuters, residents and local maintaining agencies. The features of the trail have been designed to incorporate long term durability and sustainability while achieving aesthetic and community enhancements. lb DOUBLE -DECKED SR 836 WI ALLAPATTAN This project is a continuation of GMX's work program to modernize the SR 836 corridor. The enhancements on SR 836 are from NW 17 Avenue to the Midtown Interchange. These enhancements include double -decking SR 836, beginning just east of the toll gantry at NW 17 Avenue, rising over the center of SR 836, and touching down at I-395, east of the 1-95 interchange. The double -decked section will provide drivers with a direct connection to the MacArthur Causeway that is free of local entry and exit traffic. The existing SR 836 roadway and bridges will serve as a collector distributor system that allows drivers to enter and exit from the existing local roads and 1-95. This collector distributor system will reduce the existing weaving movements resulting in enhanced safety and better traffic operations on SR 836. In addition, the existing eastbound SR 836 ramp to northbound 1-95 will be widened to include an additional lane reducing the congestion that drivers currently experience. An auxiliary lane will be added along north- bound 1-95 from north of NW 17 Street to NW 29 Street to receive the additional traffic from the eastbound SR 836 ramp to northbound 1-95 and enhance the flow of traffic through the Midtown Interchange. The project also includes the construction of a new connector ramp from souhbound 1-95 to westbound SR 836. This new connector ramp will enhance the flow of traffic and reduce weaving movements. This portion of the project will also enhance safety. v• IR STAR, P AND Nlel I-3a5 RECONSTRUCTION ENHANCEMENTS Enhancements along 1-395 are from the SR 83611-95/1-395 (Midtown) Interchange to the MacArthur Causeway, approximately 1.4 miles tong. The project will completely reconstruct the existing facility and create a signature bridge that will span 1,025 feet over NE 2 Avenue and SR5/Biscayne Boulevard, redefining the Miami skyline with its six sweeping arches. The project will create additional capacity on 1-395 with a total of three through lanes in each direction and provide separate connector ramps for traffic to and from 1-95. The existing 1-395 eastbound off -ramps at NE 2 Avenue will be moved west to North Miami Avenue, and the westbound on -ramps at NE 1 Avenue will be shifted to the west of North Miami Avenue. NW 2 Avenue will also be reconnected under 1-395, providing residents greater access. The signature bridge and the adjoining structures will allow for the transformation of the area undemeath to vibrant community spaces linked together by a contiguous trail for the enjoyment of Overtown residents, nearby communities and visitors.
