The audit of the positions will better meet the needs of the department and will attract a larger applicant pool and retain employees. R-21-0402 ADOPTED SEPTEMBER 23, 2021, AND RESOLUTION NO. R-21-0408 ADOPTED OCTOBER 1, 2021; AUTHORIZING THE CITY MANAGER TO MAKE ANY NECESSARY CHANGES TO ADJUST, AMEND, AND APPROPRIATE THE FISCAL YEAR 2025-2026 OPERATING BUDGET, FIVE-YEAR FINANCIAL PLAN, STRATEGIC PLAN, AND MULTI -YEAR CAPITAL PLAN REGARDING CITY SERVICES AND RESOURCES AS NECESSARY, LEGALLY ALLOWED, AND APPLICABLE IN ORDER TO AUDIT AND CREATE SAID POSITIONS FOR THE DEPARTMENT; RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS OF THE CITY MANAGER AND DESIGNATED CITY DEPARTMENTS TO UPDATE THE RELEVANT FINANCIAL CONTROLS, PROJECT CLOSE-OUTS, ACCOUNTING ENTRIES, AND COMPUTER SYSTEMS; PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, on September 25, 2025, the City Commission adopted Resolution No. R- 25-0413 approving the General Fund Budget for the City of Miami ("City") for the Fiscal Year beginning October 1, 2025 and ending September 30, 2026 ("Fiscal Year 2025-26") in the amount of $1,224,745,000 and the total Budget for all non -capital funds in the amount of $1,830,273,000 (collectively, "Adopted Budget"); and WHEREAS, the City Commission adopted Resolution No. R-21-0408 on October 1, 2021, during a special meeting, which, among other things, established a budgetary restriction on the Department of Police ("Police") and the Department of Fire -Rescue ("Fire -Rescue"); and WHEREAS, the budgetary restriction adopted in Resolution No. R-21-0408 on October 1, 2021, reads, in part, "that notwithstanding anything in Resolution No. R-21-0402 or the Capital Plan to the contrary, an affirmative vote of the City Commission is required prior to any and all movements of monies that are different from the line item -budgets' approved amounts as adopted on September 13, 2021 for the Capital Plan and as adopted on September 23, 2021 for Resolution No. R-21-0402, for the departmental budgets of the Department of Police and the Department of Fire -Rescue, provided that such requirements shall not apply to Fire -Rescue for Urban Search and Rescue ("USAR") funds, Urban Security Initiative ("UASI") funds, or for movements of money pursuant to a catastrophic event" ("Restriction"); and WHEREAS, the City Commission adopted Resolution No. R-22-0230 on June 23, 2022, amending the Restriction established pursuant to Resolution No. R-21-0408 in order to limit the Restriction on Police and Fire -Rescue to any and all movements of monies in excess of one hundred thousand dollars ($100,000.00); and WHEREAS, pursuant to the City Commission's directives, the Police Department seeks to audit certain civilian positions by reclassifying one (1) vacant and frozen Administrative Aide I position and one (1) vacant and frozen Clerk I position, each with a zero -dollar budget allocation, to create one (1) Latent Print Examiner position; reclassifying one (1) vacant and frozen Administrative Aide II position, with a zero -dollar budget allocation, to create one (1) Police Communications Records Custodian position; and creating one (1) new City funded Victim Advocate position; and WHEREAS, the foregoing reclassifications and position creation are structured as a budget reallocation and result in no net fiscal impact, as the costs associated with the new positions are fully offset through the reductions of $150,000.00 from Account Code 00001.191501.552010.0.0, Motor Fuel budgeted line item; and WHEREAS, reclassifying one (1) vacant Administrative Aide I position and (1) vacant Clerk I position to create one (1) Latent Print Examiner position to help to reduce the backlog of latent print cases, improve productivity, and help to disseminate identification reports to detectives in a timely manner; and WHEREAS, reclassifying one (1) Administrative Aide II position to create one (1) Police Communications Records Custodian position for coordinating and responding to over 2500 public records requests yearly, that is essential to comply with Chapter 119, Florida Statutes, to include but not limited to appearing in court and giving sworn depositions for the Communications Unit; and WHEREAS, creating one (1) City -funded Victim Advocate position critical to maintain service continuity and honoring our commitment to victims and witnesses of crime; and WHEREAS, it is in the best interests of the City to authorize the City Manager to make any and all necessary changes to adjust, amend, and appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan, and Capital Plan regarding City services and resources as necessary and legally allowed; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to approve the audit of certain civilian positions with a fiscal impact estimated at $150,000.00 for Fiscal Year 2025-2026, which shall be fully funded through the reallocation of appropriated funds from Account Code 00001.191501.552010.0.0 Motor Fuel budgeted line item, resulting in no net fiscal impact. Said actions include: the reclassification of one (1) vacant Administrative Aide I position and (1) vacant Clerk I position to create one (1) Latent Print Examiner position to help to reduce the backlog of latent print cases, improve productivity, and help to disseminate identification reports to detectives in a timely manner; one (1) Administrative Aide 11 position to create one (1) Police Communications Records Custodian position for coordinating and responding to over 2,500 public records requests yearly, that is essential to comply with Chapter 119, Florida Statute, to include but not limited to appearing in court and giving sworn depositions for the Communications Unit; create a new City -funded Victim Advocate position that is critical to maintain service continuity and honoring our commitment to victims and witnesses of crime, as required pursuant to Resolution No. R-21-0402 adopted September 23, 2021 and Resolution No. R-21- 0408 adopted October 1, 2021. Section 3. The City Manager is further authorized' to make any necessary changes to adjust, amend, and appropriate to the Fiscal Year 2025-2026 operating budget, five-year financial plan, strategic plan, and multi -year capital plan regarding city services and resources as necessary, legally allowed, and applicable. Section 4. The City Manager is further authorized,' along with the designated City Departments, to update the relevant financial controls, project close-outs, accounting entries, and computer systems are hereby ratified, approved, and confirmed. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions, and Resolution Nos. R-21-0402 and 21-0408. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
