Purpose of Item:
A Resolution of the Miami City Commission authorizing the purchase of a Ford Cargo
Van to support Internet Crimes Against Children investigations that require the
transportation of specialized equipment, in the amount of $64,870.00; allocating funds
from the Law Enforcement Trust Fund, Project Number 19-690001, Award 1169, Task
04, Expenditure Equipment, Organization 191602 and Account Code
12500.191602.664000.0.0, such expenditures having been approved by the Chief of
Police and in compliance with the directives provided in Section 932.7055, Florida State
Statutes, as amended.
Background of Item:
Section 932.7055, Florida State Statutes, authorizes the expenditure of forfeiture cash
or proceeds for certain law enforcement purposes not considered normal operating
expenses. Pursuant to the provisions of Section 932.7055, Florida State Statutes, any
local law enforcement agency that acquires at least $15,000 pursuant to the Florida
Contraband Forfeiture Act within a fiscal year must expend or donate no less than 25
percent of such proceeds for the support or operation of any drug treatment, drug abuse
education, drug prevention, crime prevention, safe neighborhood, or school resource
officer program or programs. Such funds may be used only for school resource officer,
crime prevention, safe neighborhoods, drug abuse education and prevention programs,
or for other law enforcement purposes that the governing body of the municipality
deems appropriate. The City of Miami ("City") Police Department ("MPD") deems it is
imperative to purchase a Ford Cargo Van to support Internet Crimes Against Children
investigations that require the transportation of specialized equipment. A dedicated
vehicle would significantly enhance operational efficiency, safety, and the ability to
respond promptly to investigative needs. The funds necessary to purchase the vehicle
have not been included in the MPD's general operating budget and are available in
MPD's Law Enforcement Trust Fund ("LETF"). The Chief of Police has recommended
adoption of this Resolution and has determined that this expenditure of funds complies
with Section 932.7055, Florida State Statutes.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE
PURCHASE OF A FORD CARGO VAN IN THE AMOUNT OF SIXTY-FOUR
THOUSAND EIGHT HUNDRED SEVENTY DOLLARS ($64,870.00), FOR THE CITY
OF MIAMI'S ("CITY") POLICE DEPARTMENT ("DEPARTMENT") TO BE UTILIZED
FOR INVESTIGATIONS RELATED TO INTERNET CRIMES AGAINST CHILDREN
THAT REQUIRE THE TRANSPORTATION OF SPECIALIZED EQUIPMENT;
ALLOCATING FUNDS FROM THE DEPARTMENT'S LAW ENFORCEMENT TRUST
FUND, PROJECT NUMBER 19-690001, AWARD 1169, TASK 04, EXPENDITURE
EQUIPMENT, ORGANIZATION 191602 AND ACCOUNT CODE
12500.191602.664000.0.0, SUCH EXPENDITURES HAVING BEEN APPROVED BY
THE CHIEF OF POLICE AND IN COMPLIANCE WITH THE DIRECTIVES PROVIDED
IN SECTION 932.7055, FLORIDA STATUTES, AS AMENDED.
WHEREAS, Section 932.7055, Florida Statutes, as amended, authorizes the
expenditure of forfeiture cash or proceeds for certain law enforcement purposes not
considered normal operating expenses; and
WHEREAS, pursuant to the provisions of Section 932.7055(5)(c)3., Florida Statutes,
a local law enforcement agency that acquires at least fifteen thousand dollars ($15,000.00)
pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or
donate no less than twenty-five percent (25%) of such proceeds for the support or operation
of any drug treatment, drug abuse education, drug prevention, crime prevention, safe
neighborhood, or school resource officer program or programs; and
WHEREAS, local law enforcement agencies have the discretion to determine which
program or programs will receive the designated proceeds; and
WHEREAS, such funds may be used only for school resource officers, crime
prevention, safe neighborhood, drug abuse education and prevention programs, or for other
law enforcement purposes that the governing body of the municipality deems appropriate;
and
WHEREAS, the City of Miami ("City") Police Department ("MPD") deems it is
imperative to purchase a Ford Cargo Van to be utilized for investigations related to internet
crimes against children that require the transportation of specialized equipment; and
WHEREAS, a dedicated vehicle would significantly enhance operational efficiency,
safety, and the ability to respond promptly to investigative needs; and
WHEREAS, the funds necessary to purchase the vehicle have not been included in
the MPD's general operating budget and are available in MPD's Law Enforcement Trust
Fund ("LETF"); and
WHEREAS, the Chief of Police has recommended adoption of this Resolution and
has determined that this expenditure of LETF funds complies with Section 932.7055,
Florida State Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The purchase of a Ford Cargo Van, in an amount not to exceed sixty-
four thousand eight hundred seventy dollars ($64,870.00), to be utilized for investigations
related to internet crimes against children that require the transportation of specialized
equipment is hereby authorized.'
Section 3. Funds for the purchase of a Ford Cargo Van shall be allocated from
MPD's LETF Project Number 19-690001, Award 1169, Task 04, Expenditure Equipment,
Organization 191602 and Account Code 12500.191602.664000.0.0, such expenditures
having been approved by the Chief of Police in compliance with Section 932.7055, Florida
Statutes, as amended.
Section 4. This Resolution shall become effective immediately upon its adoption.

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
