ENCLOSURES: Updated Legislation
The purpose of this substitution memorandum is to provide updated legislation for File ID
#18014 (PZ.5) on the February 26, 2026 City Commission Agenda, which relates to Miami
21 Zoning Code text amendment - Auto Related Uses.
The update is necessary to:
1. Clarify that the requirements for additional off-street parking and access standards
shall only apply to facilities with 'more than twenty-five (25) vehicles', rather than
facilities with 'twenty-five (25) vehicles or more', as written.
Upon approval, the updated legislation for the above -referenced Miami 21 Zoning Code
amendment will be provided to the City Clerk's Office for distribution to the Mayor and all
Commissioners.

18014 : AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114,
THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"),
AMENDING ARTICLE 6, TITLED "SUPPLEMENTAL REGULATIONS," TO CLARIFY AUTO -RELATED
COMMERCIAL REGULATIONS, UPDATE ASSOCIATED DESIGN STANDARDS, AND STREAMLINE THE
PROCESS FOR THE REESTABLISHMENT OF THOSE RECENTLY OPERATING; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning
Ordinance of the City of Miami, Florida, which has been amended from time to time ("Miami 21 Code"); and
WHEREAS, the Office of the City Manager appointed a Steering Committee to evaluate existing Miami
21 Code entitlements with the intent of identifying opportunities for process improvements and recommending
legislative amendments ("Entitlement Reform Program"); and
WHEREAS, on October 15, 2025, this Board voted to recommend approval to the Miami City Commission
of an ordinance amending the Miami 21 Code regarding auto -related commercial regulations, via Resolution No.
PZAB-R-25-069; and
WHEREAS, the City would like to make additional changes to the ordinance regarding auto -related
commercial regulations; and
WHEREAS, as such, this Board rescinds the previous Resolution No. PZAB-R-25-069 related to an
amendment of the Miami 21 Code regarding auto -related commercial regulations and replacing such this with
Resolution containing the additional changes; and
WHEREAS, an amendment to the Miami 21 Code is necessary to clarify regulations and update design
standards relating to Auto -Related Commercial Uses, including Car Washes, Gas Stations, and Vehicle Rental
Facilities; and
WHEREAS, similar uses such as gas stations and car washes create similar urban conditions and should
be regulated with the same design standards and flexibilities; and w

WHEREAS, small-scale car rental facilities are appropriate services within local-neighbot1oods with
design standards, and larger facilities more appropriately directed to major arterials; and

WHEREAS, an amendment to the Miami 21 Code is needed to streamline the reestablishme of recently
operating Auto -Related Commercial Uses while still requiring screening and landscape to create appropriate
transitions with Abutting properties and mitigate visual impacts; and
WHEREAS, consideration has been given to the relationship of this proposed amendment to the goals,
objectives and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), with appropriate
consideration as to whether the proposed change will further the goals, objectives and policies of the MCNP; the
Miami 21 Code; and other City regulations; and
WHEREAS, consideration has been given to the need and justification for the proposed change, including
changed or changing conditions that make the passage of the proposed change necessary; and
WHEREAS, after careful consideration of this matter, the City Commission deems it advisable and in the
best interest of the general welfare of the City and its inhabitants to amend the Miami 21 Code as hereinafter set

forth.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING APPEALS BOARD OF THE
CITY OF MIAMI, FLORIDA.
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted and
incorporated as if fully set forth in this Section.
Section 2. The Planning, Zoning and Appeals Board hereby rescinds Resolution No. PZAB-R-25-069
related to an amendment of the Miami 21 Code regarding auto -related commercial regulations and replacing
such with this Resolution.
Section 3. The Planning, Zoning and Appeals Board hereby recommends to the City Commission
Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, is further amended by making
modifications to Article 6. in the following particulars:'

Section 4. It is the intention that the provisions of this Ordinance shall become and be made a part of
the Zoning Ordinance of the City of Miami, Florida, which provisions may be re -numbered or re -lettered and
that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such
intention.
Section 5. If any section, part of a section, paragraph, clause, phrase, or word of this Resolution is
declared invalid, the remaining provisions of this Resolution shall not be affected.
Section 6. This Resolution shall become effective immediately upon adoption.

Section 3. It is the intention that the provisions of this Ordinance shall become abbe

or re -lettered and that the word "ordinance" may be changed to "section", "article", or
other appropriate word to accomplish such intention.
Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this
Resolution is declared invalid, the remaining provisions of this Ordinance shall not be affected.
