Legislation File Number: 18871 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/12/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ALLOCATING ADDITIONAL FUNDS FROM THE DISTRICT 3 COMMISSIONER'S SHARE OF THE FUNDS APPORTIONED BETWEEN THE FIVE (5) COMMISSION DISTRICTS PURSUANT TO THE ANTI -POVERTY INITIATIVE FORMULA FOR THE COMMISSIONER OF EACH DISTRICT IN A TOTAL AMOUNT NOT TO EXCEED ONE MILLION SEVENTY-SIX THOUSAND THREE HUNDRED ONE AND 00/100 DOLLARS ($1,076,301.00) FOR THE DISTRICT SPONSORED DISTRICT 3 SENIOR RENTAL ASSISTANCE PROGRAM ("PROGRAM"), AS SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, SUBJECT TO APPLICABLE REQUIREMENTS OF ALL FEDERAL, STATE, AND LOCAL LAWS, INCLUDING THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AND CODE OF THE CITY OF MIAMI, AS AMENDED, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; THE USE, ALLOCATION, AND APPROPRIATION OF THE FUNDS REFERENCED HEREIN ARE SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS AND THE RECEIPT OF ALL NECESSARY APPROVALS, INCLUDING, BUT NOT LIMITED TO THE CITY ATTORNEY, AUTHORIZING THE CITY MANAGER TO MAKE ANY CHANGES TO ADJUST, AMEND, AND APPROPRIATE THE CITY'S OPERATING BUDGET, FIVE-YEAR FINANCIAL PLAN, STRATEGIC PLAN, MULTI -YEAR CAPITAL PLAN, AND OTHER DOCUMENTS AS NECESSARY AND APPLICABLE, PURSUANT TO THE PROVISIONS OF THIS RESOLUTION, AUTHORIZING, RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS BY THE CITY MANAGER AND THE DESIGNATED CITY DEPARTMENTS TO UPDATE THE RELEVANT FINANCIAL CONTROLS, PROJECTS CLOSE-OUTS, ACCOUNTING ENTRIES, AND COMPUTER SYSTEM IN CONNECTION HEREWITH. SPONSOR(S): Commissioner Rolando Escalona WHEREAS, pursuant to Resolution No.R-25-0431, adopted on October 9, 2025, the City of Miami apportioned Five Million Two Hundred Fifty Thousand Two Hundred Fifty -One and 19/100 Dollars ($5,250,251.19) in available funds between the five (5) Commission Districts pursuant to the Anti -Poverty Initiative ("API") Formula for the Commissioner of each District to allocate and appropriate by future resolutions(s) to district specific affordable housing and/or senior rental assistance programs; and WHEREAS, the Office of the District 3 Commissioner was apportioned One Million Seventy -Six Thousand Three Hundred One and 00/100 Dollars ($1,076,301.00) for affordable housing and/or senior rental assistance programs pursuant to the API Formula; and City of Miami Page 1 of 3 File ID: 18871 (Revision: A) Printed On: 2/24✓2026 18871 Legislation -SUB ITHIS DOCUMENT IS A SUBSTITUTION TO ORIGINAL. File ID: 18871 nactment Number: R-26-0069 WHEREAS, on December 12, 2019, pursuant to Resolution No. R-19-0516, the City Commission approved the creation of the permanent senior Rental Assistance Program, as amended from time to time ("Senior Rental Assistance Program"); and WHEREAS, the goal of the Senior Rental Assistance Program is to alleviate the burden caused by dramatic rent increases for the senior residents who are on a fixed income and find it difficult to afford rising rents; and WHEREAS, due to the high rents and cost of living in the City, the Office of the District 3 Commissioner wishes to allocate One Million Seventy -Six Thousand Three Hundred One and 00/100 Dollars ($1,076,301.00) of its funds to support its "District 3 Senior Rental Assistance Program," to provide additional funding to the Senior Rental Assistance Program to assist District 3 senior residents that are currently facing eviction and require rental assistance ("District 3 Program"); and WHEREAS, the District 3 Commissioner ("Commissioner") wishes to provide funds in an amount not to exceed One Million Seventy -Six Thousand Three Hundred One and 00/100 Dollars ($1,076,301.00) ("Funds") for the District 3 Program, as specified in Exhibit "A," attached and incorporated; and WHEREAS, the City Commission finds that this allocation is an allowable use and complies with the provisions of Resolution No. R-25-0431; and WHEREAS, the City Manager is requesting authority from the Commission to negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for the allocation of the Funds for the District 3 Program; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY -'OF MIAMI, FLORIDA: -� r-n Section 1. The recitals and findings contained in the Preamble to this Resolution area, adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to allocate the Funds for the Distrrct3 Program, as specified in Exhibit "A," attached and incorporated. I>.) fs- Iv Section 3. The City Manager is further authorized' to negotiate and execute any andNall necessary documents, modifications, and amendments, all in forms acceptable to the City Attorney, for said purpose. Section 4. The use, allocation, and appropriation of the funds referenced herein is subject to all federal, State, and local laws that regulate the use of such funds and the receipt of all necessary approvals, including, but not limited to the City Attorney. Section 5. This Resolution shall become effective immediately upon its adoption. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
