FROM: James Reyes City Manager SUBJECT: Substitution for RE 10 —Approve Purchase from Mythics, LLC — Oracle OPAL and Authorize Access — OMNIA Partners REFERENCES: February 12, 2026 City Commission Meeting ENCLOSURES: Revised Item RE 10 The Departments of Building, Innovation and Information Technology and Procurement respectfully request that the following item be substituted in the February 12, 2026 City Commission Meeting: Item RE 10 on the February 12, 2026 City Commission Meeting Agenda is an item to approve the purchase of Oracle products and services, specifically the Oracle Permitting and Licensing ("OPAL") system as further specified in exhibit "A," attached and incorporated from Mythics, LLC (formerly Mythics, Incorporated) utilizing contract no. 180233 secured by Maricopa County, Arizona pursuant to a competitive process in compliance with City laws, policies, and procedures, available through OMNIA Partners. In addition, RE10 authorizes access to all competitively solicited and awarded contracts available via the national cooperative OMNIA Partners. Mythics has made every reasonable attempt to ensure that the information contained within this proposal is accurate, current, and properly sets forth the requirements as have been determined at the time of submission. The parties acknowledge and agree that the other party assumes no responsibility for errors that may be contained in or for misinterpretations that readers may infer from this document. 1. Description of Services and Deliverables. A. Definitions. "Mythics, LLC" or "Mythics" shall mean the entity that executed the Agreement. ii. "City of Miami's Process" shall mean City of Miami's business processes related to, but outside of, the Oracle Cloud Applications. "Cloud" is a general term meaning the delivery of hosted services over the Internet. iv. "Cloud Updates" shall mean product releases of the Oracle Fusion Cloud Services. v. "Complexity" shall mean the complexity of an Oracle Cloud Application extensibility as defined in the Oracle Professional Services Complexity Definitions available at https://www.oracle.com/a/ocom/docs/complexity- definitions.pdf. There are five Complexity levels: Very Easy Complexity, Easy Complexity, Moderate Complexity, Complex Complexity, and Very Complex Complexity. vi. "Configure" and "Configuration" shall mean the setup of the Oracle Cloud Application using the Standard Functionality provided within the Oracle Fusion Cloud Services release planned for Go Live. vii. "Conversion" shall mean the data conversions set forth in Section 7.B (Conversions) and subject to the Complexity definitions. viii. "Countries" or "Country" shall mean the country or countries set forth in Section 1.D.vi (Country Assumptions). ix. "Custom Reports" shall mean the custom reports listed in Section 1.D. Scope Assumptions, RowG3 (Custom Reports) below and modifications to Standard Reports and are subject to the Complexity definitions. x. "Data Governance" shall mean a set of disciplines, processes and technologies, for ensuring the accuracy, completeness, timeliness and consistency of multiple domains of City of Miami's data across the Oracle Cloud Applications, Non -Oracle Systems, and across City of Miami's business processes, functional areas, organizations and geographies. t. xi. "Deliverable" means the discrete output(s) of either Mythics or City of City of Miami as specified in the "Deliverable Name" column of the table in Section 1.E of this exhibit. xii. "ERP" shall mean Oracle Fusion Cloud Enterprise Resource Planning. xiii. "Existing Process" shall mean City of Miami's legacy business processes prior to the onset of the project. xiv. "Extensions" shall mean a customization or enhancement to standard Oracle Fusion Cloud Applications implemented to address requirements not met by Standard Functionality. Extensions may include new user interface components, additional business logic, integrations, or workflow changes, and are built using Oracle -approved tools. Extensions are set forth in Section 7.0 (Extensions). xv. :ffGlobal Design" shall mean the part of the Services when (i) the To -Be Process and Oracle Cloud Applications late designed and harmonized to document the Global Template (if applicable); (ii) the strategy for rOpttversions, Integrations, Reports, training, and communications are developed; and (iii) the sequence and gr.opping of Countries/regions are confirmed. Global Design may be referred to as "Enterprise Design" if the •'Services are for a single Country. xvie .."Global Template" shall mean the globally consistent To -Be Process, Configurations, Conversions, Integrations, and Reports that all Countries/regions/business units will adapt to. xvii. "Go -Live" is complete for a Wave (as described in the timeline in Section 1.C.i of this exhibit if the project consists 'of more than a single Wave) when each of the Deliverables identified as "production" in the Deliverables Section -'below for such Wave has been accepted pursuant to the acceptance process set forth in Section 2 (Acceptance of Deliverables). xviii. "Integrations" shall mean the data integrations set forth in Section 7.A (Integrations) and subject to the Complexity definitions. xix. "Non -Oracle Systems" shall mean any applications, systems, databases, or business processes other than the in - scope Oracle Cloud Applications set forth in Section 1.B.i. xx. "Ongoing Support Model" shall mean the model (as set forth in the Ongoing Support Model Deliverable described in Section 1.E (Deliverables) below) under which City of Miami will support the Oracle Cloud Applications following the Post Go -Live Assistance Period. xxi. "Oracle Cloud Application(s)" shall mean the in -scope Oracle software application module(s) to be implemented based on the Oracle Fusion Cloud Services as listed in Section 1.B.i. xxii. "Oracle Cloud Operations" shall mean the Oracle organization in charge of operating the subscribed Oracle Cloud Services. xxiii. "Oracle Cloud Services" shall mean the Oracle hosted Cloud offering separately subscribed by City of Miami for the Oracle Cloud Applications. xxiv. "Oracle Modern Best Practices" shall mean a collection of business processes that are pre -defined by Oracle and are designed to map to certain portions of the Standard Functionality contained in the respective Oracle Cloud Application. xxv. "Oracle Permitting and Licensing" and "OPAL" shall mean Oracle's Permitting and Licensing. xxvi. "Oracle True Cloud Method+" and "TCM+" shall mean the Oracle Cloud delivery approach (i.e., methods, Deliverables) that underpins the execution of Cloud projects. xxvii. "Post Go -Live Assistance" shall mean limited Team Mythics functional and technical resources to respond to support tickets or requests documented and dispositioned by City of Miami and provided to Team Mythics, which are specific to the Solution, during the Post Go -Live Assistance Period. Post Go -Live Assistance excludes the introduction of any scope not specified in this exhibit such as functionality, integrations and processes. xxviii. Post Go -Live Assistance Period" shall mean: a. The period beginning upon Go -Live during Wave 1 and ending twelve (12) weeks after. There are two (2) Go -Lives planned for Wave 1 and each will have twelve (12) weeks of Post Go -Live Assistance, totaling twenty-four (24) weeks for Wave 1. b. The period beginning upon Go -Live of Wave 2 and ending twelve (12) weeks of Post Go -Live Assistance after Wave 2 Go -Live. C. The period beginning upon Go -Live during Wave 3 and twelve (12) weeks after. There are two (2) Go -Lives planned for Wave 3 and each will have twelve (12) weeks of Post Go -Live Assistance, totaling eighty twenty-four (24) weeks for Wave 3. d. The period beginning upon Go -Live of Wave 4 and ending sixteen (16) weeks of Post Go -Live Assistance after Wave 4 Go -Live. xxix. "Project Backlog" or "Product Backlog" shall mean the set of defined User Stories which encompass all the functional requirements for the project. xxx. "Prototype" shall mean a non -production environment used to tailor aspects of the Solution and an associated activity to demonstrate and Validate the Solution as further described in this exhibit xxxi. "Record types" includes the following: a. A "Building Permit" record type is a record configuration within OPAL for a specific construction activity (e.g., new construction, residential remodel, electrical). Each unique type includes, but is not limited to, intake fields, validation rules, workflow, inspection schedule, fee schedule and calculations, required documents, plan review steps, notifications, statuses, etc. b. A "Business License" record type is a record configuration within OPAL for a specific business activity or operating model (e.g., food service, contractor, home -based). Each unique type includes, but is not limited to, intake data, validation rules, workflow, fee schedule and calculations, required documents, inspection Li schedule, compliance checks, notifications, statuses, etc. C. ' A "Code Enforcement Case and/or Violation" record type is a record configuration within OPAL for a code - violation (e.g., property maintenance, zoning, fire). Each unique type includes, but is not limited to, intake data, classification and severity logic, inspections/re-inspections, processes, notices and citations, timelines, fines/penalties, corrective actions, required documents, notifications, statuses, etc. d A "Planning and Zoning Application/ Entitlement' record type is a record configuration within OPAL for land use and development approvals (e.g., conditional use, variance, subdivision, site plan). Each unique type includes, but is not limited to, intake data, public notice/hearing steps, workflows, fee schedule, requirements documents, plan reviews, conditions of approval, milestone tracking, appeals/continuances, inspections, fee schedules, statuses, notifications, etc. xxxii. "Reports" shall mean the Standard Reports and the Custom Reports. xxviii. "Solution" as used in this exhibit, shall mean the Oracle Cloud Applications and the Configurations, Reports, Conversions, and Integrations as specified in this exhibit and is not intended to bind Team Mythics to "solve" any product related issues or problems. xxxiv. "Sprint" as used in this exhibit, is a period of four (4) weeks that focuses on configuring Oracle Cloud Applications and the Configurations, Reports, Conversions, and Integrations, to meet the documented business requirements. xxxv. "Standard Functionality" shall mean the standard functionality of the Oracle Cloud Applications as set forth in the relevant product documentation. "Standard Reports" shall mean the unmodified reports available in Standard Functionality of the Oracle Cloud Applications. 511) 1/60 MYTHICS xxxvi. "Training Materials" shall mean the content to be used for City of Miami training specified in the Training Plan Deliverable. xxxviii. "User Stories" shall mean the individual defined stories that outline specific functional requirements for the project as documented in the Project Backlog or the applicable Sprint Product Backlog report. xxxix. "Validation" or "Validate" shall mean a test or testing to confirm that the Oracle Cloud Applications are performing in accordance with the Global Template. xl. "Wave" shall mean a discrete segment of the Services as specified in Section 1.C.i if the project consists of more than a single Wave. B. Cloud Applications and Scope of Services. Oracle Cloud Applications. r` Using Oracle TCM+ and as further set forth in this exhibit, Team Mythics will implement Standard Functionality for the following Oracle Cloud Applications, modules, and processes: Pillar Application ERP Module(s) Processes Oracle Fusion Permitting and Community Licensing Cloud Development Service Oracle Platform as a Service ("PaaS") Permitting, Planning, Code Enforcement & Business Licensing, including artificial intelligence ("AI") agents that are part of Standard Functionality Analytics Cloud Citizen Portal dashboard and reporting ERP Oracle PaaS Intelligent Advisor Online permit search iL. ERP Oracle PaaS Integration Cloud Third -party integrations ERP Oracle PaaS OTBI Oracle Transactional Business Intelligence ("OTBI") Services Overview. Team Mythics will perform the following as described in this exhibit: a. Perform project management, governance, and deployment activities for the Oracle Cloud Applications as specified in Section 1.C.iii. b. Review and Analyze the City's documented requirements and process flows as specified in Section 1.C.iii. c. Define and document User Stories/Requirements and Product Backlog as specified in Section 1.C.iii. d. Configure and Validate the Oracle Cloud Applications as specified in Section 1.C.iii leveraging standard configuration, workflow, and administration features available through native OPAL administration tools and Oracle -approved tools for Extensions, as described in Section 1.C.iii. e. Design the Integration Strategy and integrate the Oracle Cloud Applications with City of Miami's systems as specified in Section 1.C.iii for the Integrations. g. Design an organizational change management strategy and work with City of Miami to document training and communications to deliver to City of Miami's end users as specified in Section 1.C.iii. C. Project Approach and TCM+ Stage Overview. The Services will be provided using Oracle TCM+, which includes five (5) stages: Mobilize, Design, Localize and Validate, Go -Live, and Optimize & Innovate as specified in the table in Section 1.C.ii below. The specific role of each party is set forth in Section 1.C.iii. Project Timeline. The project will consist of the following four (4) Waves. TCM+ Stage Overview (_) MOBILIZE DESIGN The purpose of this stage is to ramp up the project team, establish the team culture, and confirm delivery expectations. During this stage, the team will collaborate to define how we will govern the project. This includes: • Identifying the teammates empowered to make decisions. • Agreeing on a cadence in which we monitor and report progress. • Communicating the change control process. • Drafting and confirming the Project Plan as part of the Project Initiation Deliverable, including planning the Global Design workshop objectives, schedule, participants, and logistics. • Establishing the Project Charter and Governance Model Deliverable. • Communicating the Deliverable acceptance framework in accordance with the Governance Model for the Project Initiation Deliverable. This stage includes a Global Design phase at the outset of the project across all participating departments, to ensure a thorough capture of business requirements and configuration needs across the City of Miami's enterprise. As part of this phase, the team will review the City of Miami's documented requirements and business processes. Global Design is dedicated to validating scope across the project and identifying any necessary scope changes (subject to the Change Control set forth in the Policies). The team will coordinate a series of workshops to: • Review the City of Miami's existing documented requirements and business processes • Discuss the To -Be Process • Discuss Configuration of the Oracle Cloud Applications • Develop and review the Project Backlog Deliverable • Conduct gap analysis and document the gaps, if any • One (1) Prototype will be built for each Wave. The technology teammates will work to define the Integration Strategy and Data Conversion Strategy as part of the Technical Strategies and Plan Deliverable which confirm and finalize the Integration and Conversion inventories. LOCALIZ E AND VALIDAT E GO -LIVE This stage is dedicated to refming the Configuration of the Oracle Cloud Applications. The team facilitates the following meetings, in multiple sprints, to discuss and adapt the Existing Process and requirement specifications to build upon the Project Backlog from the Design stage. • Sprint planning meetings to identify the User Stories to be included in each sprint. • Sprint retrospective and review meetings happen at the end of each sprint to review the Product Backlog and demo incremental product configuration. • During each sprint, each User Story will be validated by Team Mythics' staff prior to being assigned to the City of Miami for testing. A user acceptance test ("UAT") is also completed, if needed, focusing on training and engaging the user community. Communications and training to the end user population will be drafted, finalized, and delivered. A Cutover Checklist Deliverable is also defined during this period in preparation for Go Live. During this stage, Conversions are Validated in preparation for Go -Live. The team executes the Cutover Checklist to deploy the Oracle Cloud Applications, Integrations, and data to the production environment. Delivery of communications and training to end users will continue. The City of Miami acknowledges that the performance of the Services may involve use of resources from a country or location other than that in which the services are to be performed ("non-native resources"). The use of nonnative resources may create a tax reporting and filing obligation for such resource in such country or location and may cause Team Mythics to incur incremental tax costs and other administrative costs (e.g., costs arising from tax preparation, reporting and filing obligations) associated with placing a non-native resource in the country or location in which the services are be performed. These costs ("Resource Costs") are separate from and in addition to expenses, and the City of Miami agrees to pay Resource Costs to Team Mythics within thirty (30) days of the date of an invoice(s) for such Resource Costs. 4. Project Management. Team Mythics and the City of Miami each agree to designate a project manager who shall work together to facilitate an efficient delivery of the Services. The City of Miami's project manager shall have the authority to approve Services. Team Mythics shall have the sole right to exercise direct control and supervision over the work assignments of Team Mythics resources. 5. City of Miami's Cooperation. A. The Services scope in this exhibit is limited to up to two (2) non -production environments and one (1) production environment procured separately by the City of Miami. The final project environments will be defined in the Environment Management Plan Deliverable. The non -production environment(s) will be required to allow the flexibility needed for meeting the timelines while having parallel Configuration, Validation, and Integration/Conversion activities. For Services related to Oracle Cloud Services, obtain and maintain the Oracle Cloud Services under separate contract prior to and during the Services. 2. Victims of human trafficking are young children, teenagers, and adults. Thousands of victims are trafficked annually across international borders worldwide. Many of these victims are trafficked into this state. Victims of human trafficking also include citizens of the United States and those persons trafficked domestically within the borders of the United States. The Legislature finds that victims of human trafficking are subjected to force, fraud, or coercion for the purpose of sexual exploitation or forced labor. (b) The Legislature finds that while many victims of human trafficking are forced to work in prostitution or the sexual entertainment industry, trafficking also occurs in forms of labor exploitation, such as domestic servitude, restaurant work, janitorial work, sweatshop factory work, and migrant agricultural work. (c) The Legislature finds that traffickers use various techniques to instill fear in victims and to keep them enslaved. Some traffickers keep their victims under lock and key. However, the most frequently used practices are less obvious techniques that include isolating victims from the public and family members; confiscating passports, visas, or other identification documents; using or threatening to use violence toward victims or their families; telling victims that they will be imprisoned or deported for immigration violations if they contact authorities; and controlling the victims' funds by holding the money ostensibly for safekeeping. (d) It is the intent of the Legislature that the perpetrators of human trafficking be penalized for their illegal conduct and that the victims of trafficking be protected and assisted by this state and its agencies. In furtherance of this policy, it is the intent of the Legislature that the state Supreme Court, The Florida Bar, and relevant state agencies prepare and implement training programs in order that judges, attorneys, law enforcement personnel, investigators, and others are able to identify traffickers and victims of human trafficking and direct victims to appropriate agencies for assistance. It is the intent of the Legislature that the Department of Children and Families and other state agencies cooperate with other state and federal agencies to ensure that victims of human trafficking can access social services and benefits to alleviate their plight. (2) As used in this section, the term: (a) "Coercion" means: 1. Using or threatening to use physical force against any person; 2. Restraining, isolating, or confining or threatening to restrain, isolate, or confine any person without lawful authority and against her or his will; 3. Using lending or other credit methods to establish a debt by any person when labor or services are pledged as a security for the debt, if the value of the labor or services as reasonably assessed is not applied toward the liquidation of the debt, the length and nature of the labor or services are not respectively limited and defined; 4. Destroying, concealing, removing, confiscating, withholding, or possessing any actual or purported passport, visa, or other immigration document, or any other actual or purported government identification document, of any person; 5. Causing or threatening to cause financial harm to any person; 6. Enticing or luring any person by fraud or deceit; or 7. Providing a controlled substance as outlined in Schedule I or Schedule II of s. 893.03 to any person for the purpose of exploitation of that person. (b) "Commercial sexual activity" means any violation of chapter 796 or an attempt to commit any such offense, and includes sexually explicit performances and the production of pornography. (c) "Financial harm" includes extortionate extension of credit, loan sharking as defined in s. 687.071, or employment contracts that violate the statute of frauds as provided in s. 725.01. (d) "Human trafficking" means transporting, soliciting, recruiting, harboring, providing, enticing, maintaining, purchasing, patronizing, procuring, or obtaining another person for the purpose of exploitation of that person. (e) "Labor" means work of economic or financial value. (f) "Maintain" means, in relation to labor or services, to secure or make possible continued performance thereof, regardless of any initial agreement on the part of the victim to perform such type service. (g) "Obtain" means, in relation to labor, commercial sexual activity, or services, to receive, take possession of, or take custody of another person or secure performance thereof. (h) "Services" means any act committed at the behest of, under the supervision of, or for the benefit of another. The term includes, but is not limited to, forced marriage, servitude, or the removal of organs. (i) "Sexually explicit performance" means an act or show, whether public or private, that is live, photographed, recorded, or videotaped and intended to arouse or satisfy the sexual desires or appeal to the prurient interest. (j) "Unauthorized alien" means an alien who is not authorized under federal law to be employed in the United States, as provided in 8 U.S.C. s. 1324a(h)(3). The term shall be interpreted consistently with that section and any applicable federal rules or regulations. (k) "Venture" means any group of two or more individuals associated in fact, whether or not a legal entity. (3) Any person who knowingly, or in reckless disregard of the facts, engages in human trafficking, or attempts to engage in human trafficking, or benefits financially by receiving anything of value from participation in a venture that has subjected a person to human trafficking: (a)1. (g) For commercial sexual activity in which any child younger than 18 years of age or an adult believed by the person to be a child younger than 18 years of age, or in which any person who is mentally defective or mentally incapacitated as those terms are defined in s. 794.011(1), is involved commits a life felony, punishable as provided in s. 775.082(3)(a)6., s. 775.083, or s. 775.084. For each instance of human trafficking of any individual under this subsection, a separate crime is committed and a separate punishment is authorized. (4)(a) Any parent, legal guardian, or other person having custody or control of a minor who sells or otherwise transfers custody or control of such minor, or offers to sell or otherwise transfer custody of such minor, with knowledge or in reckless disregard of the fact that, as a consequence of the sale or transfer, the minor will be subject to human trafficking commits a life felony, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. (b) Any person who, for the purpose of committing or facilitating an offense under this section, permanently brands, or directs to be branded, a victim of an offense under this section commits a second degree felony, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. For purposes of this subsection, the term "permanently branded" means a mark on the individual's body that, if it can be removed or repaired at all, can only be removed or repaired by surgical means, laser treatment, or other medical procedure. (5) The Criminal Justice Standards and Training Commission shall establish standards for basic and advanced training programs for law enforcement officers in the subjects of investigating and preventing human trafficking crimes. Every basic skills course required for law enforcement officers to obtain initial certification must include training on human trafficking crime prevention and investigation. (6) Each state attorney shall develop standards of instruction for prosecutors to receive training on the investigation and prosecution of human trafficking crimes and shall provide for periodic and timely instruction. (7) Any real property or personal property that was used, attempted to be used, or intended to be used in violation of this section may be seized and shall be forfeited as provided by the Florida Contraband Forfeiture Act. After satisfying any liens on the property, the remaining proceeds from the sale of any property seized under this section and owned by a defendant convicted of a violation of this section must first be allocated to pay any order of restitution of a human trafficking victim in the criminal case for which the owner was convicted. If there are multiple human trafficking victims in the criminal case, the remaining proceeds must be allocated equally among the victims to pay restitution. If the proceeds are sufficient to pay any such order of restitution, any remaining proceeds ns t be disbursed as required by s. 932.7055(5)-(9). (8) Thecd'egree of an offense shall be reclassified as follows if a person causes great bodily harm, permanent disability, rialermanent disfigurement to another person during the commission of an offense under this section: (a) A fEony of the second degree shall be reclassified as a felony of the first degree. (b) A felony of the first degree shall be reclassified as a life felony. (9) In a -prosecution under this section, the defendant's ignorance of the victim's age, the victim's misrepresentation of his or her age, or the defendant's bona fide belief of the victim's age cannot be raised as a defense. (10)(a) information about the location of a residential facility offering services for adult victims of human trafficking involving commercial sexual activity, which is held by an agency, as defined in s. 119.011, is confidential and exempt from s. 119.07(1) and s. 24(a), Art. I of the State Constitution. This exemption applies to such confidential and exempt information held by an agency before, on, or after the effective date of the exemption. (b) Information about the location of a residential facility offering services for adult victims of human trafficking involving commercial sexual activity may be provided to an agency, as defined in s. 119.011, as necessary to maintain health and safety standards and to address emergency situations in the residential facility. (c) The exemptions from s. 119.07(1) and s. 24(a), Art. I of the State Constitution provided in this subsection do not apply to facilities licensed by the Agency for Health Care Administration. (11) A victim's lack of chastity or the willingness or consent of a victim is not a defense to prosecution under this section if the victim was under 18 years of age at the time of the offense. (12) The Legislature encourages each state attorney to adopt a pro -prosecution policy for human trafficking offenses, as provided in this section. After consulting the victim, or making a good faith attempt to consult the victim, the state attorney shall determine the filing, nonfiling, or diversion of criminal charges even in circumstances when there is no cooperation from a victim or over the objection of the victim, if necessary. (13) When a contract is executed, renewed, or extended between a nongovernmental entity and a governmental entity, the nongovernmental entity must provide the governmental entity with an affidavit signed by an officer or a representative of the nongovernmental entity under penalty of perjury attesting that the nongovernmental entity does not use coercion for labor or services as defined in this section. For purposes of this subsection, the term "governmental entity" has the same meaning as in s. 287.138(1).
