WHEREAS, Chapter 170, Florida Statutes, authorizes municipalities, subject to the approval of a majority of the affected property owners, to levy and collect special assessments within retail and commercial districts to fund supplemental services and improvements that directly benefit the assessed properties, including but not limited to enhanced public safety, sanitation, beautification, marketing, and economic development initiatives; and WHEREAS, the City of Miami ("City") has successfully established multiple Business Improvement Districts ("BIDs") pursuant to Chapter 170, Florida Statutes, which have proven to be effective by enhancing neighborhood safety, cleanliness within the areas, creating business retention, increasing visitor activity, and impacting long-term property values; and WHEREAS, these existing BIDs provide visible and measurable benefits to property and business owners by delivering enhanced security patrols, improved maintenance and sanitation services, streetscape beautification, coordinated marketing and events, and capital improvements that contribute to safer, cleaner, and more economically resilient commercial corridors; and WHEREAS, BIDs further serve as a mechanism to leverage public and private funding, grants, sponsorships, and partnerships, thereby maximizing reinvestment in the district and ensuring that resources generated within the area are reinvested directly back into that same community; and WHEREAS, Calle Ocho is a culturally significant and economically vital corridor within the City that would benefit from a coordinated, locally governed reinvestment strategy focused on enhancing public safety, cleanliness, walkability, business attraction, and overall quality of life for residents, visitors, and business owners; and WHEREAS, the City Commission desires to direct the City Manager to evaluate the establishment of a Business Improvement District along Calle Ocho and to collaborate with the City Attorney, City Clerk, and the District 3 Commissioner to initiate the statutory process required to create the Calle Ocho Business Improvement District, subject to property owner approval and the process outlined in Chapter 170, Florida Statutes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby directs the City Manager to evaluate the Calle Ocho corridor and to work in coordination with the City Attorney, City Clerk, and District 3 City Commissioner to initiate the process to establish a Special Assessment District to be known as the Calle Ocho Business Improvement District ("Calle Ocho BID"), for the purpose of enhancing public safety, cleanliness, economic vitality, and reinvestment in the area. Section 3. The proposed Calle Ocho BID shall be structured to levy and collect a special assessment for a period of ten (10) years, subject to the approval of a majority of affected property owners, in accordance with the procedures set forth in Chapter 170, Florida Statutes, with all funds generated to be reinvested within the district for services and improvements that directly benefit assessed properties.
