CONTINUED OPERATION OF THE VIRGINIA KEY �I D^�ISPOSAL FACILITY, ALSO KNOWN AS THE VRGINIA KEY DUMP, THEREBY JUSTIFYING NON-COMPETITIVE SELECTION OF AN ENGINEER- ING CONSULTANT; FURTHER AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR PROFESSIONAL SERVICES WITH GREENLEAF AND TELESCA, ENGINEERING CONSULTANTS, FOR PREPARATION OF AN "ENGINEERING PLAN FOR CLOSURE" OF THE VIRGINIA KEY DUMP WITH FUNDS THEREFOR IN AN AMOUNT NOT TO EXCEED $50,000 ALLOCATED FROM POLLUTION CONTROL BONDS. WHEREAS, the City of Miami in its operation of the Virginia Key Disposal Facility, also known as the Virginia Key Dump, has been cited recently and frequently for improper operation under Chapter 403, Florida Statutes and has been ordered to close said facility on July 1, 1977; and WHEREAS, there exists a valid public emergency due to the hazard and danger to public health caused from any delay in City waste collection and disposal services which necessitates continued operation of the Virginia Key Dump beyond the July, 1977 closure date; and WHEREAS, the closure of said facility has been conditionally extended from July, 1977 until the Dade County Transit Station on N. As you are aware, this department took immediate steps to correct the operational problems and instituted strict procedures to be followed henceforth. These actions on the City's part tended to establish creditability with the environ- mental agencies, and we were successful in getting DER to stay closure action subject to our maintaining the fill in conform- ance with operational regulations and submitting an engineering plan for ultimate closure and abandonment of the site. DER regulations set forth the date of July 1977 as the closure date for all dumps and landfills operating without benefit of a landfill operating permit. We have been operational under a temporary operating permit and must continue this operation until the Dade County Transfer Station on 20th Street is open and becomes available for our use. The opening date of this facility is scheduled for February 1978. It is now necessary to submit our engineering plan for closure and toward that end, four local engineering firms were contacted by Vince Grimm and requested to submit informal proposals. Two firms responded and were interviewed by this office. We wish to negotiate a contract with the tentatively selected firm of Greenleaf & Telesca under the provisions of Title 18, Chapter 287.055 Public Business, Consultants Competitive Negotiation Act. Contained in paragraph 3, sub -paragraph "2," is a provi- sion which allows an agency head to negotiate a professional services agreement in "cases of valid public emergencies so certified by the agency head." In view of the dire need to sustain the Virginia Key operation and a July date of forced closure by DER, it is the opinion of this department that an emergency exists. In view of this circumstance, based upon an opinion offered by the Legal Department, it is necessary to have the City Commission adopt a resolution authorizing us to proceed. with negotiation and enter a contract with the tentatively selected engineering firm.
