BLAB OP NEW BISCAYNE, according to the plat thereof,
recorded ih Plat Book "B" at Page 16, of the Public
Records of Dade County, Florida, less, however, a strip
of land 4 feet in width off of the NW'LY side thereof
heretofore dedicated to the City of Miami, as described
in Clerk's File 67R-11237,
A Parcel of submerged land in Biscayne Bay Sec. 22-54-41
described as Lying SE'ly of and abutting Lot 24 and
SW'ly 1/2 of Lot 23 (less N'ly 4') of Block 43 of SAMUEL
RtHODES AMENDED MAP OF NEW BISCAYNE, P3, B/16, more
particularly described as follows: Begin at SW'ly
corner of said Lot 23, said corner being in the mean high
water line of Biscayne Bay; thence S 40° 23' 32" F. along
SE'ly extension of SW'ly line of Lot 24, a distance of
536.57' to a point in the Bulkhead Line established for
this area shown on map in PB 74/3 (Sheet 5); thence
N 21° 41' 51" W along said Bulkhead Line a distance of
84.87 feet to the intersection with SE'ly 1/2 of Lot 23;
thence N 40° 23' 32" W along said SE'ly extension a
distance of 497.47 feet to the mean high water line
boundry of said SW'ly 1/4 of Lot 23 and of said Lot 24,
a distance of 75.00 feet, M/L to the POB, as described
in Clerk's File 68R-115129,
together with improvements thereon, any and all rights
appurtenant thereto, and together with any and all
riparian rights.
Section 2. It is hereby found and determined that the
acquisition of the control and ownership in fee simple title of
the property described in Section 1. above is for public use and
purpose, to wit: providing the land area and facilities essential
and desirable for the public and citizens of the City of Miami to
use and enjoy the park, recreational and related uses incidental
thereto on the shores of Biscayne Bay in the Dinner Key Area,
pursuant to the comprehensive and developing concepts of the Dinner
Key Master Plan, the object of which is to open the property
fronting on Biscayne Bay and the recreational advantages of Biscayne
Bay to the use and enjoyment of the greatest number and variety of
people possible, and to provide marina, park, recreational and
public service facilities related thereto within the total complex

Section 3. That the. City of Miami, Florida, its agents
and employees are hereby directed to acquire by gift, purchase or
condemnation, the fee simple title in and to the property
described in Section 1. above, as soon as it is legally possible,
including the filing of a declaration of taking and utilization
of any and all statutes of the State of Florida applicable thereto,.

During the latter part of Marchf the City Commission requested that we attempt to
determine a source of funding for the proposed purchase of the Miley Property cur.-
rently being occupied by Monty Trainor. As you will recall, some time ago Mr.
Trainor proposed that he would lease the Underwood Boat Shed from the City and
rehabilitate that building to provide a water -oriented commercial activity on that
site. Mr. Trainor also proposed that the City purchase the Miley Property which
he currently occupies under lease from Mr. Miley, and then lease that property
back to him for a period of thirty (30) years. The proposed purchase price for
the Miley Property is $950,000.00, plus attorney's fees in the amount of $60,000,00,
for a total outlay of $1,010,000.00.
Several weeks ago, we presented the City Commission with a status report on
the various projects and funding sources in which the City is currently involved.
We indicated in that report that the purchase of the Miley Property was a project
which was tentatively committed by the City Commission with no funding source
identified.
The options for the purchase of the Miley Property include: Parks for People Bond
Issue, General Fund, and the Capital Improvement Funds. There is currently 3.8
million dollars of the Parks for People Bond Issue available exclusive of monies
committed to FEC purchase. As we pointed out in the presentation to the City Com-
'mission in the Project Status Report, the allocation for Coconut Grove from Parks
Hfor People has already been exceeded by 1.4 million dollars. In order to use
;Parks for People money to acquire the Miley Property, the City Commission would
-need to begin transferring funds from other districts.
ye should recognize that the proposed lease with Mr. Trainor for this property
would generate a minimum of $65,000 a year which could be used to replace Parks
for People monies. However, if Mr. Trainor experienced difficulties these funds
would not be available. Further, many of the projects which should be undertaken
with Parks for People funding would be, of necessity, deferred until sufficient
revenues were generated to replace "borrowed funds."
The General Fund is not a reasonable alternative given the budget reductions
that were made in order to balance this past budget.
The current balance in the Capital Improvement Fund is $1,402,324. On April 28
we presented the City Commission with a Physical Project Status Report which
outlined the funding and construction status of a number of projects. Listed

People Mover is likely to be $1.6 million based on the reduced scope of
• the project, The Capital Improvement Program balance could be committed
• to this most needed project.
The proposal for the purchase of the Miley Property calls for a minimum
down payment of $450,000 with the remainder to be paid over six years
from either the income generated from the Miley and Kelley properties
combined or advance on rent from both properties. It is possible to
• acquire the Miley Property with the remaining balance in the Capital
Improvement Vund, however, the City will be liable for the remaining
six payments regardless of whether or not Mr. Trainor's enterprises •
would generate sufficient revenue to cover this indebtedness.
