year expiration limitations for approved 'Variances of
Conditional Uses.
This amendment is in accord with City Commission policy to
provide development process controls that aid, not hinder,
developers. It extends the present time limitations for
Variances and Conditional Uses, and eliminates the necessity
for the City Manager and City Commission to approve time
extensions.
With the adoption of the two Board legislation in 1973, the
Zoning Ordinance provisions for variances and conditional use
approval were amended to provide that: the approval would
expire six months after the effective date of the action taken
by the Board; decisions of the Zoning Board could be appealed
to the City Commission; a request for a time extension must
be submitted to the City Manager thirty (30) days prior to the
approval expiration date; the City Manager may extend the
time limitation for a period up to one (1) year with the City
Commission's approval.
Since the adoption of the new legislation, in many cases, the six
(6) rnonth time period has not been sufficient to allow the
developer to prepare detailed plans, arrange financing, and
obtain the necessary permits. Also, .t is apparent the
current system is not in accord with the City Commission
policy to provide development process controls that aid
developers. For instance, since January of 1974, the City
Commission has considered 24 requests for time extensions
and has approved all 24.
If this ordinance revision is adopted by the Commission, the
Director of the Building Department will be requested to
extend the initial six month expiration date for applicants
currently granted variances and conditional uses in favor
of a two year expiration date: the revised time limitation to
start with the initial grant to the applicant.

The Miami Planning Advisory Board, at its meeting of March 2, 1977,
Item #3, following an advertised Hearing, adopted Resolution No.
PAB 21-77 by a 7 to 0 vote recommending that ARTICLE XXXI - VARIANCES
and ARTICLE XXXII - CONDITIONAL USES, of the Comprehensive Zoning
Ordinance No. 6871 be amended by deleting Section 3, sub -section (2)
in both Articles to change the six (6) month expiration liimmitattions
for approved Variances or Conditional Uses to two (2) years, a
shown
on Page 28 of the Planning Advisory Board Minutes.
Two objectors were present at the meeting.
An ORDINANCE to provide for this Ordinance Amendment has been prepared
by the City Attorney's office and submitted for consideration of the
City Commission.

COMPREHENSIVE ZONING ORDINANCE FOR THE CITY

ARTICLE XXXILCONDITIONAL USE AND SUBSTITUTING
A NiEuSECTION 3, SUB -SECTION (2) IN BOTH
ARTICLES BY CHANGING THE EXPIRATION LIMITATIONS
FOR APPROVED VARIANCES OR CONDITIONAL USES FROM
SIX MONTHS TO TWO YEARS;, BY REPEALING ALL
ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN
CONFLICT; AND CONTAINING A SEVERABILITY PROVISION.,
WHEREAS, the Miami Planning Advisory Board,
meeting of March 2, 1977, Item No. 3, following at advertised
hearing, adopted Resolution No. PAB 21-77 by a 7 to 0 vote,
recommending that Section 3, Sub -section (2) in both Article
XXXI-Variances and ARticle XXXII-Conditional Use be deleted
and a new Section 3, Sub -section (2) be substituted in both
Articles by changing the expiration limitations for approved
variances or conditional uses from six months to two years; and
WHEREAS, the City Commission, after careful consideration
and due deliberation of this matter, deems it advisable and in the
best interests of the City of Miami and its inhabitants to grant
said substitution;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami be, and the same is hereby amended
by deleting Section 3, Sub -section (2) in both Article XXXI-
Variances and Article XXXII-Conditional Use, and substituting a
new Section 3, Sub -section (2) in both Articles, to read as follows:
