BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:

Section 2. The reductions in the aforesaid appropriations set forth in
Section I hereof, totaling S23,791,96 are hereby available for reappropriation for
the purpose of providing police physical examinations during the fiscal year
1976-77.
Section 3. All ordinances, code sections, or parts thereof in conflict here-
with, insofar as they are in conflict are hereby repealed.
Section 4. If any section, sentence, clause, phrase, or word of this ordinance
is for any reason held or declared to be unconstitutional, invalid, inoperative or
void, such holding or invalidity shall not affect the remaining portions of this
ordinance, and it shall be construed to have been the intent of the City Commission
to pass this ordinance without such unconstitutional, invalid. or inoperative part
therein, and the remainder of this ordinance, after the exclusion of such part or
parts shall be deemed and held to be valid as if such parts had not been included
therein.
Section 5. This ordinance is hereby declared to be emergency measure on
the ground of urgent public need for the preservation of peace, health, safety and
property in the City of Miami.
Section 6. The requirement of reading this ordinance on two separate days is

buring the process of budget adjusttrent related to the four
and ones -half percent (4 1/2%) cut back, it-iwa's determined that
the Police Department was faced with having to reduce its
personnel compliment or secure approximately $24,000 from
another source so that it might continue Police Physical Ex-
amination during Fiscal Year 1976-77.
Through the efforts of the Police Department, the Department
of Human Resources and the Office of Community Affairs, it Was
determined that the funds required to continue providing
Police Examinations could be reappropriated from encumbered
1974-75 Federal Revenue Sharing commitments based on the Fiscal
Year 1974-75. A review of encumbered Revenue Sharing appropri-
ations disclosed the following agencies that retained balances
in their Revenue Sharing Accounts:

Urban League New Skills Bank
Legal Services of Greater Miami
AVAILABLE FOR
REAPPROPRIATION
$ 8,766.56

TOTAL $23,791.96
All of the aforementioned agencies have been contacted and are
aware that their total allocation for 1974-75 has been concluded.
As a consequence the above mentioned $23,791.96 is available
for reappropriation.
Consequently, you will find attached to this memorandum an
emergency ordinance to amend the appropriation ordinance and
an emergency ordinance providing the appropriated amount to be
included within the Police Budget for the purpose of providing
police Physical Examinations. It is therefore appropriate for
the Commission to approve the attached ordinances.
