vote reaffirmed its support of the City Adrian-
istration's original recommendation to enter in-
to a Recognition Acknowledgement of the Sanita-
• tion Employees Association as the representative
• of employees in the Sanitation Department of the
City of Miami. •

At the speoial City Commission meeting of May

the City of Miami the administration's view that
it was improper for the Sanitation Employees
Association to attempt through arguments to the
City Commission, to influence the outcome of an.
administrative hearing of the Public Employee
Relations Commission of the State of Florida.

This will memorali2e our early telephone conversation,
wherein 1 indicated that there appeared to be a question
of fact as to the effective date of the USIA Consent Decree,
'in light of our memorandum of understanding with Justice.
bur Director of Human Resources by his pencil notation
upon the attached memorandum has indicated that he at
least considered the matter and exercised his professional
judgment as to whether or not these promotions should be
made. You are, of course, aware of the legal principal
which indicates that the exercise of a discretion in these
matters is presumed to be valid, absent a showing of gross
abuse of that administrative discretion.
