HomeMy WebLinkAboutO-14439City of Miami Ordinance 14439 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17938 Final Action Date: 1/22/2026 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 10/ARTICLE I/DIVISION 2/SECTION 10-18 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "BUILDINGS/IN GENERAL/BUILDING ADMINISTRATION, FEES, AND WAIVERS/BUILDING PERMIT FEE SCHEDULE; WAIVERS; ELEVATOR, ESCALATOR, BOILER ETC.," AMENDING SECTION 10-18 OF THE CITY CODE TO INCORPORATE CURRENT ELEVATOR INSPECTION FEES, BOILER AND UNFIRED PRESSURE VESSEL FEES, AND FINES FOR NON-COMPLIANCE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Section 10-18 of the Code of the City of Miami, Florida, as amended ("City Code"), provides for the permit fee schedule and waivers related to elevators, escalators, boilers, etc.; and WHEREAS, the City of Miami ("City") has a dynamic real estate market with continued commercial and residential development requiring robust building safety and maintenance regulations; and WHEREAS, the City wishes to streamline the process of regulating and enforcing compliance for elevator, escalator, boiler, and unfired pressure vessel inspections to ensure safety and efficiency; and WHEREAS, incorporating existing fees into a standardized table format enhances clarity and accessibility for residents, property owners, and contractors; and WHEREAS, the establishment of new inspection fees for elevators, escalators, and mechanical equipment in new construction ensures that development projects contribute to maintaining public safety and regulatory oversight; and WHEREAS, ensuring compliance with elevator, escalator, boiler, and unfired pressure vessel regulations protects residents, including vulnerable populations such as seniors and persons with disabilities, from hazardous conditions; and WHEREAS, establishing clear penalties for non-compliance encourages accountability and enhances enforcement capabilities; and WHEREAS, the City Commission believes these amendments to Section 10-18 of the City Code are in the best interests of both our business and residential communities; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 4 File ID: 17938 (Revision:) Printed On: 1/27/2026 File ID: 17938 Enactment Number: 14439 Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 10 of the Code of the City of Miami, Florida, as amended, is amended in the following particulars:1 "CHAPTER 10 BUILDINGS Sec. 10-18. Building Permit fee schedule; waivers; elevator, escalator, boiler etc. * c. Elevator/Escalator/Boiler and Unfired Pressure Vessel Fees and Fines for Non -Compliance. 1.a, Recurring/Annual Fees. 1. Certificate of Operations: $200.00 per elevator/escalator 2. Elevator/escalator duplicate certificate: $100.00 per elevator/escalator 3. Elevator/escalator delinquent certificate: $50.00 per elevator/escalator /1. Temporary certificate of Operations: $100.00 per elevator/escalator 5. Elevator/escalator annual inspection: $200.00 per elevator/escalator 6. Elevator/escalator re inspection fee: $100.00 per elevator/escalator 7. Elevator witness: A. One year test: $200.00 B. Five year test: $250.00 8. Elevator emergency power/fire recall test: $1,000.00 per test 0. Elevator/escalator removal fcc: $500.00 per elevator/escalator 10. High pre -sure boiler annual inspection: $135.00 per boiler 11. Low pre -sure boiler annual inspection: $135.00 per boiler 1 Words and/or figures stricken through shall be deleted. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately after final reading and adoption thereof.2 APPROVED AS TO FORM AND CORRECTNESS: 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
