Arefrb 4/27/77 ORDINANCE NO, 8647 AN EMERGENCY ORDINANCE AMENDING 'ORDINANCE NO, 2230, ADOPTED unman 6, 1939, AS AMizNDEi , WHICH ESTABLISHED THE MIAMI CITY EMPLOYEES' RETIREMENT SYSTEM, AC SAID ORDINANCE APPEARS IN CODIFICATION FORM A8 PART OP CHAPTER 2 ©P THE CODE OP THE CITY OP MIAMI, FLORIDA, 1957, AS AMENDED, MORE PARTICULARLY BY AMENDING Sr;CT7ON 3-96 t 3) (d) THEREAT' fY PROVIDING THAT THE CITY COMMISSIONER SflE1VtNG ON THE t30ARD OP TRUSTEES WHICH ADMINIS- TERS THE MIAMI CITY EMPLOYEES' RETIREMENT TRUST DE THE CHAIRMAN OP SAID BOARD WHO MAY VOTE ONLY 2N THE EVENT OP A TIE VOTE OP THE BOARD; REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT, INSOFAR AS THEY ARE IN CONFLICT, CONTAINING A SEVERAB2LITY PRO- VISION. WHEREAS, the Miami City Employees' Retirement System (Ordinance No. 2230, December 6, 1939) was not included as a portion of the new Code of the City of Miami, Florida, effective September 1, 1967, as adopted by Ordinance No. 7585 (July 25, 1967); and WHEREAS, said System now exists in codified form as it appears in Chapter 2 of the Code of the City of Miami, Florida, 1957, as amended, in addition to basic ordinance form; and WIfl RSAS, any addition or amendments to said System can thus be made by reference to said Chapter 2 of the Code of the 'ity of Miami, Florida, as amended; and WKFREAS,, the City of Miami has entered into agreements with the International Association of Firefighters, AFL-CIO, Local No. 587, and the Fraternal Order of Police; and WHEREAS, said agreements provide for the composition, of the Board of Trustees to administer the Miami City Employees' Retire- ment System Trust; and WHEREAS, it is the desire of the City of Miami. City Commission to implement the provisions of such agreements; NOW, THEREFORE, DE IT ORDAINED Rif THE COMMISSIQN or T4HE CITE OP MIAMI, FLORIDA; Sectit= ).. A majority of the members of the beard of trustees shall constitute a quorum for the purpose of meeting and transacting business= provided, that no recommendation or proposition submitted to the board of trustees may be passed or acted upon, except upon the affirmative vote of a majority of the entire membership." Section 2. A11 ordinances, code sections, or parts thereof i.n conflict herewith, insofar as they are in conflicted are hereby repealed. Section 3. if any section. part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remain- ing provisions of this Ordinance shall not be affected. Section 4. The foregoing ordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health, safety and property of the City. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a four -fifths vote of the members of the Commission. PASSED AND ADOPTED this - A day of APR!' 1977.
