HomeMy WebLinkAboutO-08640• ORDINANCE NO, 8640 AN ORDINANCE AMENDING ORDNANCE NO, On, THE COMPREHENSIVE ZONING ORDINANCE or THE CITY OP MtAMI, BY Atln/NG A NEW SUBSECTION (5) TO SECTION 44, ARTICLE IV GENERAL PROVISIONS, TO PROVIDE THAT NO REGULATED USE SHALL RESUME OPERATION ONCE DISCONai TINNED OR ABANDONED, UNTIL IT MEETS THE PROVISIONS OF SECTION 44 AND OTt4ER APPLICABLE REGULATIONS OP THE ZONING ORDINANCE; REPEALING ALL 'ORDINANCES, CODE SECTIONS, °OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERARILITY PROVISION. WHEREAS, ttte Miami Planning Advisory Board, at its meeting of February 16, 1977, Item #5, following an advertised Hearing, adopted Resolution :No. PAB 17-77 by a 7 to 0 vote recommending an amendment to Ordinance 6871, by adding a new Sub -section (5) to Section 44, ARTICLE IV -GENERAL PROVISIONS, as hereinafter set forth; and WHEREAS, the Commission deems it advisable in the best interest of the inhabitants of the City of Miami to amend said ordinance as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OP THE CITY OF MIAMI, FLORIDA: Section 1.Ordinance 1o. 6871, the Comprehensive Zoning Ordinance of the City of Miami be, and the same is hereby amended by adding a new Sub -section (5) to Section 44, ARTICLE IV - GENERAL PROVISIONS, to read as follows: (5) Notwithstanding other provisions of this ordinance, no regulated use shall resume operation once it has been discontinued or abandoned unless and until it meets all the provisions of this section. Section 2. That all laws or parts of laws in conflict herewith be, and the same are hereby repealed insofar as they are in conflict, Section 3.Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole. NA AA M PLANNING FACT SHEET APPLICANT City of Miami Departments of Law and Planning, Jan. 20, 1977 REQUEST Consideration to amend the Comprehensive Zoning Ordinance 6871 by adding a new sub -section (5) to Section 44, ARTICLE tV, GENERAL PROVISIONS, to provide that no adult enterta.inrnent regulated use shall resume operation, once discontinued or abandoned, until it meets all the provisions of Section 44, EXPLANATION The existing Zoning Ordinance presently provides that for a period of up to 6 months, a non• conforming use may be replaced with another non conforming use. Where a non -conforming use, occupying a conforming building or structure, is discontinued for a period of more than six months, any new use after that period of time shall conform to the use regulations of that district. The proposed arn' ndm•,nt, in essence, eliminates the potential of replacing one non -conforming adult enter- tainment establishm.mt with another non •conforming adult entertainment establishment. RECOMMENDATIONS LAW DEPARTMENT APPROVAL PLANNING DEPARTMENT APPROVAL PLANNING ADVISORY BOARD Recommended approval February 16, 1977, by a 7-0 vote.
