APPLICANT City of Miami Departments of Law and Planning, Jan. 20, 1977
REQUEST Consideration to amend the Comprehensive Zoning
Ordinance 6871 by adding a new sub -section (5) to
Section 44, ARTICLE tV, GENERAL PROVISIONS,
to provide that no adult enterta.inrnent regulated use
shall resume operation, once discontinued or abandoned,
until it meets all the provisions of Section 44,
EXPLANATION
The existing Zoning Ordinance presently provides that
for a period of up to 6 months, a non• conforming use
may be replaced with another non conforming use.
Where a non -conforming use, occupying a conforming
building or structure, is discontinued for a period of
more than six months, any new use after that period
of time shall conform to the use regulations of that
district.
The proposed arn' ndm•,nt, in essence, eliminates the
potential of replacing one non -conforming adult enter-
tainment establishm.mt with another non •conforming
adult entertainment establishment.
