AN ORDINANCE AMENDING SECTION 62-42 OP THE
CITY CODE ENTITLED "REMOVAL" CONCERNING REMOVAL
OF MEMBERS AND ALTERNATE MEMBERS OE THE PLANNING
ADVISORY BOARD AND ZONING BOARD BY DELETING SUB-
SECTION b. THEREOP AND BY ADDING A NEW SUBSECTION
b, TO PROVIDE A POINT SYSTEM I'0R ABSENCES AND
TARDINESS GP MEMBERS AND ALTERNATE MEMBERS
REPEALING ALL ORDINANCES, COD SECTIONS OR PARTS
THEREor' IN CONFLICT INSOFAR AS THEY ARE IN CON-
FLICT; AND CONTAINING A SEVERABILITY PROVISION.
WHEREAS, on ,duly 16, 1975, ]fir. E. R. Bartley, the
City of Miami' s Zoning Consultant, prepared a report on the
implementation of the two board system; and
WHEREAS, Dr. Bartley, in his report, indicated a
problem had arisen regarding absenteeism; and
WHEREAS, on February 12, 1976, the City Commission
met in joint meeting with the Planning Advisory Board and the
Zoning Board to consider Dr. Bartley' s Report; and
WHEREAS, the Commission passed a Motion of Intent,
asking for a revision of the rules regarding absenteeism, and
suggested that a point system be established; and
WHEREAS, the Miami Planning Advisory Board, at its
meeting of February 16, 1977, Item No. 2, following an advertised
Hearing, adopted Resolution No. PAB 14-77 by a 7 to 0 vote,
recommending the revision of the City Code, Chapter 62, Section 62-22
as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA;
Section 1. Section 62-22 of the City Code, entitled
"Removal" be and the same is hereby amended by deleting Subsection b.
f and by adding a new Subsection b. to read as folio
"b. There is hereby established a point system.
Eadh member or alternate member of the
Planning Advisory Board and the Zoning Board
who has an unexcused absence from a regularly
scheduled Meeting of the Board, shall receive
5 points. Por the purpose of this Article an
excused absence shall be defined as personal
or family illness, death in the family or
away on City business. If a member arrives
after the beginning of the first agenda item
or leaves before the termination of the last
agenda item, 2 points shall be added. A
member of the Planning Advisory Board and of
the Zoning Board shall automatically be
removed when any member or alternate member
of either Board at any time in one calendar
year has more than 15 points."
Section 2. All ordinances, code sections, or parts
thereof in conflict herewith, insofar as they are in conflict,
are hereby repealed.
Section 3. Should any part or provision of this
ordinance be declared by a court of competent jurisdiction
be invalid, the same shall not affect the validity of the
ordinance as a whole.

Consideration of revising Section 62=22, of the City Code
by deleting subsscctioti b and adding in lieu thereof a hew
sots=section b to provide a point system for absences and
tardiness of hiettibet's and alternate members of the Planning
Advisory Board and Zoning Board from regularly scheduled
meetings: providing a definition for excused absences; and
further providing for automatic removal if the allowable
number of points is exceeded.
This itttrm was discussed in the report "planning and lark
Implementation under the Two 13oard System" prepared by
Dr. Et -nest R. Bartley dated July, 1975, wherein Dr. t3artley
indicated that a problem had arisen regarding absenteeism.
This item was also discussed at a Joint City Commission/
Planning Advisory Board/Zoning Board meeting of February
12, 1976. The City Commission passed a Motion of Intent
dated February 12, 1976, as follows:

ZONING I30ARDS, RASED UPON DR. E, R.
BARTLE?'S REPORT OF JULY 16, 1975t
1) Periodic briefings to update changes.
2) There shall be no City Commission member liaison,
rather, liaison to be accomplished by staff member,
to be present at all Board and Commission meetings,
to communicate, expedite and inform.
3) All conclusions of both Boards are to be summarized
on a one or two page sheet expressing both the
prevalent view and descending view, as a general
synopsis of actions.
Tighter or stricter rules regarding absenteeism of
Board members based on a "point" system, i. e. ,
licensing system whereby membership may be
revoked after a certain number of absences or points

5) No tolling of time limitations during the 31 day
va.tation period in August; also, City Commission
shall be able to refer an item to a.ti appropriate
City department without the tolling of time

to be available to Commission and Board members
